NCBVA Rounds Up the Best For 2006 Annual Convention

This year's Plant Tour will be an exceptional experience at Suhor Industries' newly expanded and renovated state-of-the-art facility in San Antonio. Suhor Industries, with headquarters in Over-

land Park, KS, is the largest manufacturer of burial vaults in the U.S. SI Funeral Services in San Antonio is a 25,000 square foot facility that produces more

than 6,000 vaults per year. The first batch of concrete was poured from the new system on July 27 and while the renovation process will be ongoing, most will be completed just prior to the Plant Tour on Tuesday, February 21, 2006. While Suhor Industries produces Doric, Wilbert and Trigard vaults, the San Antonio plant is a Wilbert licensee. Joseph Suhor is President and CEO of Suhor Industries, Inc.

Attendees will board buses at the Westin Riverwalk Hotel for the 30-minute ride to the manufacturing plant. The tour will last about 90 minutes.

The Annual Convention begins Sunday, February 19 with a Reception and Riverboat Cruise down the famous Paseo Del Rio which winds through downtown San Antonio under towering cypresses, oaks and willows and alongside beautiful gardens, retail shops and restaurants.

The convention offers two full days of educational programming that will inspire busi-ness owners and managers of small and large businesses alike, including Motivational Speaker Walter Bond; Leadership expert Chip Madera, and Editor-in-chief of The Concrete Producer, Rick Yelton. There is also ample time for visits with suppliers to see the latest in products and services. Motivational and inspirational humorist Suzie Humphreys will speak at the Installation Banquet on the final evening of the convention.

Industry News and Notes Teddy Bears Add a Soft Touch to Trigard's Serenity Collection Trigard's Serenity collection of infant, toddler, and youth combination casket/burial vaults will now include a comforting Trigard teddy bear. Although many hospitals and funeral homes offer some type of grieving program, the parents still walk away with empty arms. Trigard desires to give the parents something to cuddle and cry with, and to help them get through those first agonizing nights. Every bear carries a condolence card for the hurting parents that states "I am with you always."

Wilbert and Artist Donate Painting to ABC show Artist Ray Simon, whose work is distributed exclusively to the deathcare industry through Wilbert's licensee network, recently created a customized painting for ABC's hit show Extreme Makeover: Home Edition. Entitled "A Mother's Love," the exclusive customized painting was given to the Novak family on the show's December 4 episode. Simon made the portrait in memory of Jackie Novak, who died this past Mother's Day, leaving her husband, Jeff, and their three young children behind. Simon learned of the Novak's story from the local press surrounding the arrival of the Extreme Makeover: Home Edition team and was moved by the family's loss. Simon is recognized across North America for his paintings that capture the essence of the people and places they depict.

Problem of Unclaimed Remains Most funeral directors admit to having a few urns of unclaimed remains stowed away in file cabinets, garages or basements. Occasionally, a family cannot agree on what to do with their loved one's ashes, or the person who made the arrangements died without telling anyone about the urn in storage. The Cremation Association of North America estimates 5% of remains are never picked up. The phenomenon is an unspoken problem in the

industry. Most funeral home directors, however, are reluctant to clear the shelves. Some never do. Their fear is that a family member will turn up years later asking for the remains.

Power Struggle Following Storms Florida Funeral Industry officials want to make restoring power to funeral homes a higher priority after hurricanes. A spokes-man for the Florida Funeral Directors Asso-ciation said hospitals, police departments, gas stations and supermarkets took prece-dence over funeral homes in getting their power restored following Hurricane Wilma which wracked the southern areas of the state in October. Keeping bodies without proper refrigeration creates a health issue. The association's executive director said it has taken funeral homes weeks to recover from Wilma and damage was a lot more ex-tensive than they had anticipated.

Appointment of an Agent Directs Desired Disposition of Remains

I am sure you have seen or read the stories in the media, including the funeral industry's trade journals, about the litigation, the family quarrels, and the need to include a review of funeral and burial arrangements in the estate planning process. As a vault manufacturer and major supplier to funeral homes, you should be aware of this matter so that you can intelligently converse with your customers and maybe even supply them with the appropriate form to fill out.

For most general practitioners as well as trust and estate attorneys, the estate planning process usually involves dealing with personal wishes, preparation and execution of documents, review of assets, titling, and beneficiary designations. Once the individual's desires have been understood, the document signed, and the requisite paperwork brought into line to ensure proper flow of assets to beneficiaries, it is generally assumed that the attorney's work is over.

For some clients, however, particularly those who are alone with no close family (a group which most often includes the elderly), estate planning should also include a review of one's wishes for funeral and burial arrangements.

The sad stories that we all have read and heard about demonstrate the need to plan for an ultimate resting place. According to the Senior Law Section of the American Bar Association, a statutory step in this direction is being proposed in New York with a draft amendment to the public health law dealing with the disposition of a decedent's remains. Its purpose is to establish the right of a spouse/domestic partner, family members, and others to dispose of the remains.

Up to now, I have always advised that the right of disposition be set forth in priority fashion, starting with the surviving spouse, then the children, then the parents, etc.

Now comes along a proposed statute to create a hierarchy of individuals who have the right to dispose of the decedent's remains if those instructions are not in the deceased person's will—if such will can be timely produced and verified. Now first in line are those individuals who are designated on a written document such as an "appointment of agent to control disposition of remains" created

'1114 }clocument, then the decision-making hierarchy would be as I have recommended. The model form for the Appointment of Agent is included on the preceding two pages of this issue of The Bulletin.

One of the prime justifications for this legislation, according to the Bar Association, is the fact that New York's existing law lacks a formal mechanism that allows an individual to designate an agent (including a domestic partner) to carry out his or her burial wishes. In the absence of a will, this has resulted in disputes over who has the right to dispose of a loved one's remains.

The proposed legislation creates a process that allows an individual, before he dies, to name a person or persons who would make the decision about burial after the individual dies.

While this matter does not affect you directly, it is my opinion and recommendation that you make yourself aware of this issue and the suggested solutions. I believe it is incumbent on you, as a participant within the death industry, to be knowledgeable about these issues so that you can express yourself to your customers when asked whether you are aware of such trend, and that you can also voice your opinions concerning the solutions.

Please make copies of the two-page form that we have included for your convenience. I would not recommend sending copies to your customer list, but rather be prepared to provide a copy to a funeral home when the subject is discussed.

Babylon Vault Company, Inc. was first established in 1930 by Guy W. Babylon under the name of "Guy W. Babylon and Sons." Years later, the name was changed to Babylon Vault Company. In 1979, the business was incorporated.

The first vault, which Graham helped to pour and deliver at age 12, was manufactured in the basement of the Babylon home in Wakefield Valley. Graham's grandmother was an invalid, but from a wheelchair in the front lawn, she observed the unveiling of the first vault and got to see it painted white. She died shortly after that and, ironically, was actually buried in the original "Babylon Vault."

The original form used for the vaults was called "The Perfect Seal Vault Form." It became obsolete when the "Automatic Seal Vault form" was designed. This form was adjustable. Up to seven different-size

vaults could be made with one form. (Currently, the "Capitol Forms" from Wilbert are used for the standard concrete vault.)

In the spring, the forms were moved from the basement to the machine shed, which was soon outgrown. Manufacturing operations then moved into the newly constructed chicken house.

Company expansion highlights: After renting a delivery truck for the first 10 years of business, Guy Babylon bought a Ford truck in 1941. In 1942, the company purchased a tent, grass and a lowering device to assist them at graveside. In 1945, the company became a distributor of Wilbert Vaults.

Guy Babylon died in 1948, leaving his only surviving son (one son was killed in the war), G. Graham Babylon, as the sole owner of the business.

In 1980, Babylon Vault became a sub-licensee of Wilbert Vaults. Graham, age 12, stands by the first

vaults that he helped pour in 1930.

Tradition and Respect Carry Company Through the Years By Sylvia Heidemann NCBVA Staff Writer

G raham Babylon of Babylon Vault Co. in New Windsor, MD, has been in the concrete burial vault business since he was 12 years old. He began by working for his father, who started the business in 1930, then assumed leadership of the business in 1948 after his father died. Early this year, the

company celebrated its 75th anniversary, which was commemorated by an open house for its customers on August 10.

Graham expanded the family business by taking on a second manufacturing line—septic tanks. In 1954, the facility that is still in use today was built, even though it has since been enlarged three times. Modern production methods have been incorporated, such as an overhead bin system and a computerized mixing system. "In the old days," says Graham, "we had to lift 94-lb bags of cement and shovel every bit of stone and concrete mix."

Babylon Vault now manufactures approximately 10 vaults and eight septic tanks a day (900 - 1,000 vaults/year), quite a far cry from 1930, when production capacity was one vault a day. In addition, Graham bought the property and building of Koontz Concrete, which is located adjacent to the original plant. That building was expanded in 2004. The septic tanks are poured in this location, and the vaults are stored there. The truck fleet has been expanded to six vault trucks and four septic tank trucks in order to provide good service to the company's customers.

The company now employs 12 full-time people to manufacture the products and drive L-1/ the trucks. A full-time secretary staffs the office, and there are no salesmen on the road. Graham comes into the office on a regular basis, and often watches when the lids are placed on the vaults.

Growth is No Accident A'N, A thriving, growing business doesn't just happen.

It's the result of careful planning and attention to good business relationships. Tradition is valuable, and a good relationship with area funeral directors has always been important to the management of Babylon Vault. Since 1941, the company has been showing its appreciation for its friends in business by hosting a dinner for area funeral directors, their wives and employees. Approximately 125 - 150 people attend the yearly dinners, which are always held on the first Tuesday in June.

Respected By Employees Graham says he's always believed in treating his employees just like he'd like to be treated, and that philosophy has served the company well. "Why, we've had six or seven men who have retired from working for us," he says. "One man worked for more than 45 years before he retired. His job at Babylon Vault was the only job he ever had."

That the Babylon's leadership is greatly respected by the Babylon Vault employees is illustrated by this example. Earlier this year, when Trigard held its Dealer Convention in Indianapolis, Plant Manager Steve Koontz worked secretly with Trigard to coordinate a special tribute to Graham and Mary Babylon. He flew in for the convention and surprised them by helping present the BabyIons with a bronze plaque dedicated to their landmark 75 years in business.

NCBVA's Role Speaking of the NCBVA, Graham became a member about 1940.

He has attended every convention since 1941 until recently. He even spent the first leg of his honeymoon at the 1953 convention. Married on a Saturday, Graham took his new bride (Mary) to the convention, then they later went on to a dude ranch and Niagara Falls. That convention stands out in Graham's memory for other reasons, too. The guest speaker was Maryland Governor Theodore

McKeldin, one of the top political speakers in the country at that time, and Graham had been the person who had invited him to speak at the NCBVA convention. Governor McKeldin later gave the speech at the Republican National Convention that nominated Dwight Eisenhower for president.

Graham and Mary have a daughter, Donna, who has her own business in Westminster, MD, and a son, Guy, in California who plays keyboard for Elton John.

Graham has always loved sports. It's a little hard to see in the old photo of Graham on the preceding page that there is an "A" on his hat. That stands for the "Philadelphia Athletics." Graham says he always went to the World Series before he got married. In 1958 he witnessed the famous Baltimore Colts/New York Giants football game—the first championship game in NFL history to be decided in "sudden death" overtime. The Colts had trained in Graham's hometown for 28 years. Today at 87 years old, still a sports enthusiast, Graham enjoys watching all kinds of sports events.

NFDA Relocates Convention The National Funeral Directors Association (NFDA) has decided e— o relocate the 2006 Convention & Expo from New Orleans, LA., to I

hiladelphia, PA. The decision was made to safeguard the needs and safety of convention attendees and exhibitors coming to the city still in crisis following Hurricane Katrina.

"As funeral directors and caregivers, our focus is to help families and communities rebuild after tragedy," said NFDA President Bob Biggins, CFSP, CPC. "Our concern for our members, suppliers and convention staff and their potential risks weighed heavily on this decision.

NFDA says it plans to return to New Orleans in the future and the staff is currently working with New Orleans convention officials to negotiate when such a date might be feasible.

The 2006 NFDA Convention & Expo, NFDA's 125th annual gathering, will be held October 15-18 at the Pennsylvania Convention Center (PCC) in Philadelphia.
