1.0 INTRODUCTION

1.1 PURPOSE

This Borrow Area Use Plan (BAUP) has been prepared in accordance with the

requirements contained in Title 6 New York Code of Rules and Regulations (6 NYCRR)

Part 360-2.3(l). This BAUP is being submitted in support of a Solid Waste Management

Facility Permit Modification request for construction and operation of a soil borrow area

at the Chaffee facility, Town of Sardinia, Erie County, New York owned and operated by

Waste Management of New York, L.L.C. (WMNY). The sole purpose of the soil borrow

area is to provide soils for the construction and operation of the permitted landfill

operations at the Chaffee facility. The location of the Chaffee facility is shown on Figure 1.

The Chaffee facility property, south and north of Hand Road, consists of approximately 488

acres.

This BAUP and application package address proposed modifications to borrow activities

at the facility. The current soil borrow activities at the Chaffee facility are described in its

Mined Land Use Plan1 and current 6 NYCRR Part 360 (Part 360) landfill permit (9-1462-

00001/00006).

Appendix A of the BAUP includes a completed Part 360 Permit Application for this

modification request. The potential environmental impacts of the proposed soil borrow

operations are discussed in the Full Environmental Assessment Form (see Appendix B) and the

Environmental Assessment Report (see Appendix C).

1.2 SCOPE

This BAUP has been developed in accordance with the requirements of 6 NYCRR Part 422

and includes a Borrow Plan and the Reclamation Plan, each of which include a graphic

portion and a written portion.

The graphic portion of the Borrow Plan consists of Figures 1, 2 and 3 that illustrate the

following features:

• geographic location of the project site;

• location of adjacent topographic, cultural, and land-use features;

• land areas to be impacted during each phase of the project; and

• significant facility elements, including excavation areas, roads and

haulageways, drainage control facilities, and visual and/or noise barriers.

The written portion of the Borrow Plan includes descriptions of the following:

• present use and existing conditions;

• proposed borrow operation;

• proposed borrow methods;

• proposed methods for prevention of pollution and soil erosion; and

• affected soils.

The graphic portion of the Reclamation Plan consists of Figures 4 through 7 that illustrate

the following features:

• borrow area limits for the project;

• final, post-reclamation grading plan; and

• final stage of reclamation, including vegetated areas, drainage features, water

bodies, roads, and other pertinent features.

The written portion of the Reclamation Plan includes descriptions of the following:

• proposed post-borrow land-use plan;

• proposed reclamation methods; and

• proposed reclamation schedule.

2.0 BORROW PLAN

2.1 INTRODUCTION

This BAUP describes development and reclamation of a Proposed Borrow Area at the

WMNY Chaffee facility. Presently, the 6 NYCRR Part 360 Solid Waste Management Facility

Permit (Permit) for this facility provides for a 52.5 acre Western Landfill Expansion. The Final

Environmental Impact Statement2 (FEIS) indicated that a previous borrow area was withdrawn

during the expansion permitting process due to property zoning and that soil material required

for construction and operation would be imported. Development of the Proposed Borrow

Area, which is located in a properly zoned area, will reduce the amount of soil material to be

imported to construct and operate the Western Landfill Expansion.

As shown on Figure 2, the Proposed Borrow Area consists of an East Area and West Area,

totaling approximately 30.9 acres in size, to the south and southeast of the existing landfill.

WMNY is planning to operate the Proposed Borrow Area in two phases, the West Area will

be excavated first followed by the East Area. The West Area is approximately 16.1 acres and

the East Area is approximately 14.8 acres. Approximately 400,000 cubic yards and 600,000

cubic yards of material will be excavated from the West and East Areas respectively. WMNY

is proposing excavation of soils to a depth of up to approximately 50 feet below the existing

surface elevations.

This section describes the existing conditions, the borrow operations and a brief discussion of

the potential environmental impacts. The Proposed Borrow Area will be reclaimed to wetland

habitat, wildlife habitat and upland meadows, as discussed in Section 3.0.

2.2 EXISTING CONDITIONS

2.2.1 Borrow History and Land Use

The facility first obtained a mining permit in June of 1988. This permit addressed

excavating soil in the Clay Borrow Area, the Settling Basin Excavation Area, and the

Gravel Borrow Area. This permit was amended in August 1989 and renewed in May

1991, October 1994 and June 1999. The approximate limits of these borrow areas are

shown on Figure 2. The status of these borrow areas are summarized below:

• “Clay Borrow Area” (17.7 acres) – Located to the west of the existing landfill.

Borrow activities have been completed and the area is now part of the Western

Landfill Expansion footprint;

• “Settling Basin Excavation Area” (4 acres) – Located south of the Clay Borrow

Area. Borrow activities have been completed and the settling basins are

constructed; and

• “Gravel Borrow Area” (7.2 acres) – Located in the southern portion of the site.

Borrow activities partially completed but continue under the current mining

permit.

WMNY maintains a current mining permit to cover operations at the Gravel Borrow Area

(NYS Mining Permit No. 9-02803, MLR File 9043-30-0216).

The current Permit (9-1462-00001/00006) addresses excavation of soil materials from two

areas denoted as Clay Borrow Area A and Clay Borrow Area B. Each of these areas is

also shown on Figure 2. The status of these borrow areas are summarized below:

• “Clay Borrow Area A” (10.6 acres) – Located south of the Clay Borrow Area.

Borrow activities have been completed and the area is now part of the Western

Landfill Expansion footprint; and

• “Clay Borrow Area B” (17.5 acres) – Located in the southwest corner of the

property. Borrow activities have been completed and the area has been reclaimed.

Most of the Town of Sardinia, including the Chaffee facility property, lies within Erie

County Agricultural District #6. Economic activities near the Proposed Borrow Area are

primarily agricultural. Except for the landfill operation, the properties surrounding the

Proposed Borrow Area are wooded, farmland, and residential. The farming activity

consists primarily of dairy farming, with hay, pasture, and corn the most common

agricultural land uses. The Chaffee facility property is currently not used as active

farmland or part of an active agricultural operation. Prior agricultural uses of the property

included pasture and hay land.

The Chaffee facility property has two major land use categories at this time, wildlife

habitat and municipal solid waste landfilling. Landfill operations include the 50.93 acre

Existing Landfill, the 52.5 acre Western Landfill Expansion and approximately 160 acres

of ancillary facilities on the site, including leachate storage tanks, sediment ponds,

office/maintenance buildings, access roads, etc., as shown on Figure 2.

2.2.2 Existing Topography

The Proposed Borrow Area lies within the headwaters of Hosmer Brook, which is part of the

Cattaraugus Creek drainage basin. This area is part of the south slope of the Lake Escarpment

Moraine, with general southward slopes of approximately one percent.

The eastern portion of the Proposed Borrow Area (East Area) can be described as an

elongated ridge that is oriented north to south. This area has elevations ranging from 1500 feet

in the central portion to 1455 feet toward both the southeast and southwest.

The western portion of the Proposed Borrow Area (West Area) is a conical ridge. This area

has elevations ranging from 1490 feet in the north central portion to 1450 feet toward both the

southeast and southwest.

2.2.3 Soils

Subsurface conditions at the site have been investigated as part of the landfill operations

over approximately the past 30 years by drilling test borings and through observations

made during borrow operations. The data available from these test borings were

supplemented with four additional test borings and three additional monitoring wells

within the Proposed Borrow Area limits (see Figure 2). Two cross sections illustrating the

soil conditions observed at the boring locations are included on Figure 3. Test boring logs

are included in Appendix D.

In general, soils at the site occur as a result of glacial deposition at the Lake Escarpment

Moraine. The test borings indicate that the soils consist of a topsoil layer overlying a clay

till deposit, followed by an underlying formation of coarse sand and gravel. These soil

deposits do not vary significantly from those discussed in the Hydrogeologic Report for

the proposed Chaffee Western Landfill Expansion3. The clay till is a brown silty clay that

has interbedded seams of sand and sandy gravel. The clay till is between 20 and 40 feet

thick, and was observed at an approximately elevation (El.) 1438 feet in SB3-08 and at an

approximate El. 1451 feet in SB1-08. As noted in the Hydrogeologic Report, the

underlying formation of coarse sand and gravel has been estimated to depths of 400 feet,

extending down to bedrock.

The interbedded seams of sand and sandy gravel were demonstrated to be laterally

discontinuous as noted in the Hydrogeologic Report. Comparison of the interbeds in

several borings and wells indicates that they are not continuous. Hydraulic conductivity

tests performed in clay till wells within interbeds indicate that the interbeds are

discontinuous.

2.2.4 Groundwater

Two zones of groundwater are present within the Proposed Borrow Area; 1.) the clay till

exhibits a perched water table with a vertical hydraulic gradient; and 2.) the underlying

formation of coarse sand and gravel contains the water table with a horizontal gradient. As

noted in the Hydrogeologic Report, the water table in the clay till confining unit is not

directly hydraulically connected to the underlying formation of coarse sand and gravel.

The water table in the underlying formation of coarse sand and gravel exhibits flow

patterns to both the north and south.

Three groundwater monitoring wells were installed as part of this project. SB6-08 is

screened in the clay till and appears to intercept a sand interbed. The February 2009

groundwater elevation in this well is 1465.29 feet. SB4-08 and SB9-08 are both screened

in the underlying formation of coarse sand and gravel. The February 2009 groundwater

elevations are 1440.08 feet and 1437.90 feet respectively. The groundwater levels in the

underlying formation of coarse sand and gravel appear to correlate with those measured

and recorded as part of the Hydrogeologic Report.

It is improbable that wetlands at the site are recharged by groundwater that is perched

within the clay till formation. The low hydraulic conductivity of the clay till formation

suggests that groundwater flow alone is not capable of sustaining elevated water levels in

the wetlands. Furthermore, because a continuous bed of more permeable material was not

observed in the test borings, a groundwater flow path was not defined.

2.2.5 Surface Water Drainage Earth Dimensions, Inc.4 (EDI) delineated wetlands located within and adjacent to the

Proposed Borrow Area (see Figures 2 and 3). As indicated on the figures, two wetlands,

identified as SD-1 and AR-11, are NYSDEC jurisdictional wetlands. EDI identified the

remaining four wetlands, identified as W1A, W3, W4 and W6 as potential USACE

jurisdictional wetlands. The wetland boundaries have been submitted to the NYSDEC and

USACE for review. EDI has indicated that wetlands designated W3, W4 and W6 may be

non-jurisdictional, which means that the wetlands can be removed without providing

wetland mitigation for these areas. If the USACE finds that any of these wetlands are

jurisdictional, WMNY will submit a plan and permit application for mitigation of the

affected wetlands.

Surface water from the Proposed Borrow Area flows from the north to the south. Surface

water from the north side of the main access road flows into wetlands SD-1 and AR-11

through culverts beneath the road. Surface water is also directed toward the wetlands from

roadside drainage channels along the south side of the main access road. Overland flow

emanating from topographically higher terrain within the proposed borrow areas flows at the

surface of the low permeability clay till formation and provides further recharge to each

wetland. Both wetlands discharge to the south of the site and contribute to Hosmer Brook, a

Class C(T) stream.

The potentially jurisdictional wetland W1A and non-jurisdictional wetlands W3, W4 and W6

within the Proposed Borrow Area occur in aerially small isolated depressions within the well-

vegetated upland area and are recharged by overland surface water flow.

Approximately one-half of the surface water runoff from the West Area flows into the

existing sedimentation basins and the other half flows into NYSDEC jurisdictional wetland

SD-1. As indicated on Figure 2, water flowing toward or into the existing sedimentation

basins will eventually enter SD-1. Approximately two thirds of the surface water from the

East Area flows into SD-1 while the remaining one third flows into NYSDEC

jurisdictional wetland AR-11.

The wetlands are composed of forested swamps, shrub wetlands, and emergent marshes

with very little open water. SD-1 meets the criteria for New York State Wetland Class II,

and is a significant wildlife habitat because of its heterogeneous cover types in the adjacent

upland.

2.2.6 Man Made Features

The Proposed Borrow Area lies on the south side of the existing landfill and main access

road. The area is forested and does not currently contain man made structures or features.

2.3 DESCRIPTION OF MINERAL AND BORROW OPERATIONS Excavation in the Proposed Borrow Area will consist of removing a majority of the clay

till deposit. In general, 2 to 4 feet of clay till will remain in the areas, therefore no borrow

activities will occur within the underlying formation of coarse sand and gravel.

2.3.1 Mineral Types

As discussed in Section 2.2.3, the borrow operation will be in the deposit of clay till. The

clay till material will be used for landfill construction and operations.

2.3.2 Borrow Sequence and Method

The Proposed Borrow Area includes two areas as described above. The West Area is

approximately 16.1 acres in area, and will be excavated from east to west between El.

1450 feet to El. 1440 feet. The East Area is approximately 14.8 acres in area, and will be

excavated from east to west between El. 1455 feet to El. 1445 feet. WMNY is planning to

operate the Proposed Borrow Area in two phases, the West Area will be excavated first

followed by the East Area.

Excavation in each area will start at the lowest elevation by first creating a sedimentation

basin that complies with the New York State Standards for Erosion and Sediment

Control. These basins will be constructed with outlet devices and will be vegetated prior

to continuing the borrow area excavation (see Figures 5 through 7). The West Area Basin

should be developed approximately three months prior to beginning the borrow area

operation. The East Area Basin will be developed one year prior to completion of the

West Area, this will allow for the basin to be well established before borrow area

operation. Each area will then be excavated following the proposed floor slope.

Excavations will be developed and maintained so that runoff from disturbed areas flows

through drainage swales and silt traps into the constructed basins. Upon completion, the

Proposed Borrow Area will contain permanent basins and gentle to steep sloping upland

areas.

As shown in the cross-sections on Figure 4, the Proposed Borrow Area is designed to

maintain the excavation within the clay till deposit. The base grades were developed using

the bottom of clay till observed in the test borings. If the bottom of the clay till is

encountered during excavation, the base grades will be either revised to maintain at least 2

feet of clay till above the underlying formation of coarse sand and gravel or over

excavations will be replaced with a minimum of 2 feet of compacted clay till.

The work sequence at the Proposed Borrow Area is described below.

1. The West Area will be excavated first, beginning with the sedimentation basin.

2. Silt fence or other temporary erosion and sediment control structures will be

placed along the boundary between the proposed borrow area and the NYSDEC

wetlands to prevent sediment discharge.

3. Clear, grub and strip topsoil from the sedimentation basin area and haulageway and

store the material for future reclamation (stockpiles will be treated as described in

Section 2.3.6).

4. Grade the haulageway to direct surface water runoff to the existing and proposed

sedimentation basins.

5. Excavate material to construct the sedimentation basin and transport it to the work

area at the landfill.

6. When construction of the sedimentation basin is complete, clear, grub and strip

topsoil from the borrow area as required for each year’s construction/operation.

7. Maintain drainage swales and silt traps to direct surface water from the current

excavation area to the sedimentation basin.

8. Excavate slopes to the required reclamation grades so that backfill is not required

at a later time.

9. Apply temporary seeding and mulch to completed areas to create a buffer between

the excavation area and sedimentation basin. Reclamation will not occur until the

entire area is excavated and graded.

10. The East Area will be excavated upon completion of the West Area. The sequence

of work will follow the same steps as described above.

Excavation within the proposed borrow area, as shown on the figures, will not remove any

portion of the NYSDEC jurisdictional wetlands, USACE jurisdictional wetland W1A or

any associated buffers. In addition, no vegetation removal, equipment access, or other

disturbances to these regulated wetlands and buffers will occur during borrow activities.

Additionally, silt fences, stormwater basins and other erosion and sediment control

measures will be utilized to protect the wetlands during soil borrow operations.

Potentially non-jurisdictional wetlands W-3 and W-4 in the East Area and W-6 in the West

Area will be removed during operations in the Proposed Borrow Area. If the USACE finds

that any of these wetlands are jurisdictional, WMNY will submit a plan and permit

application for mitigation of the affected wetlands.

An inoperable natural gas well may be present in the Proposed Borrow Area. The gas well was

not encountered during development of this BAUP, however, if it is encountered during the

proposed borrow operations, excavation activities will be suspended in the immediate area and

the NYSDEC will be notified. WMNY will then proceed with decommissioning the well as

directed by the NYSDEC.

The three monitoring wells that were installed during development of this BAUP will be

decommissioned as they are encountered during excavation.

2.3.3 Grading and Setbacks

The grading plan for the Proposed Borrow Area is depicted in plan view on the

Reclamation Plan, and on the cross sections shown on Figure 4. Grading and borrow area

perimeter setbacks will be as follows.

• The perimeter slope of the basins from water's edge to undisturbed adjacent land

will be on a slope no greater than 1 vertical on 3 horizontal;

• A set back of 25 feet from the top of slope of the borrow area to the property lines

will be maintained; and

• A 100 foot buffer will be maintained on areas bordering the NYSDEC designated

wetlands. The wetland buffer will be demarcated with temporary construction

fencing that will be maintained throughout the life of borrow activities.

Care will be taken during excavation operations to prevent the need for backfilling slopes

at a later time. Excavations shall be made to the reclamation grades shown on Figure 4.

2.3.4 Processing Material processing will not occur as part of this project.

2.3.5 Haulageways and Site Access Haulageways will be used for employee access, equipment access, and for transporting soil

material. The haulageways will be graded, stabilized, and maintained as necessary to

provide safe, efficient operations and to minimize erosion and off-site sedimentation.

2.3.6 Storage of Materials and Disposal of Wastes

Topsoil from the Proposed Borrow Area will be stockpiled at the facility. Temporary

erosion and sediment controls will be placed around the topsoil pile. The topsoil pile will

be seeded as described in Section 2.4.4. Brush will be stored temporarily within each area.

Prior to accessing the material beneath the pile, the brush will be chipped for placement

either on temporary roads in the Proposed Borrow Area or in operation of the landfill.

Topsoil will be stripped from portions of the borrow areas as they are developed. The

topsoil from each area will be placed in the stockpile. A silt fence will be placed

downgradient of the topsoil stockpile. Material will be added to the stockpile as additional

portions of the borrow areas are developed. Therefore, the topsoil stockpiles will have a

working face where additional material will be placed in the future.

Seeding will be placed on areas of the stockpile that will not receive additional material.

The stockpiles will be seeded within 30 days of material placement. Additionally, seeding

will be placed on the working face of stockpiles that are not planned to receive additional

material within the remainder of the current construction season.

The following seed mixture will be used as temporary revegetation on stockpiles.

Common white clover 8 lbs/acre

Tall fescue 20 lbs/acre

Perennial Ryegrass 10 lbs/acre

Any non-hazardous solid waste that is produced during Proposed Borrow Area operations will

be disposed of at the landfill.

2.4 POTENTIAL ENVIRONMENTAL IMPACTS

A complete discussion of the potential environmental impacts due to the creation of the

Proposed Borrow Area is included in Appendix C, the Environmental Assessment Report. A

brief discussion of air, noise and water pollution is included below.

2.4.1 Control of Air Emissions

As needed, roads, loading areas, and working faces will be sprayed with water to minimize

airborne dust.

The same equipment that is involved in the current borrow operations and on the adjacent

landfill, where it meets the Part 360 noise regulations, will continue to be used at the

facility. The potential changes in noise levels will be due to the operation of excavation

equipment at locations adjacent to facility property lines. Based on an estimate included in

Appendix C, sound level increases at the closest receptors would be considered unnoticed to

tolerable.

2.4.3 Control of Water Quality and Quantity

Surface water will be controlled within the Proposed Borrow Area as described in Section

2.3.2. The erosion and sediment control systems were developed in accordance with the

New York State Stormwater Management Design Manual (NYSDEC, October 2001).

The New York State Stormwater Management Design Manual contains guidance on the

sizing of sedimentation control basins. Additionally, the facility maintains a Stormwater

Pollution Prevention Plan (SWPPP) and Spill Prevention Control and Countermeasure

Plan (SPCC), these documents provide details for training, record keeping, potential

sources of pollution, best management practices and cleanup procedures.

2.4.4 Silt Control

As described above, both the West and East Areas will contain sedimentation basins

consisting of a forebay and permanent pool. These sedimentation basins will be used to

remove sediments from water that collects as the remaining portion of the borrow area is

developed. Water will flow by gravity into the forebay and then into the permanent pool

for eventual discharge into the NYSDEC regulated wetland. Accumulated sediments will

be removed when 50 percent of the forebay storage capacity is filled.

Surface water runoff from the Proposed Borrow Area will be contained within the

excavation area. Temporary erosion and sediment control structures will be placed

between the excavation areas and the demarcated wetlands.

Drainage along the main access road will continue to convey stormwater to the designated

outflow points. If drainage patterns are altered as a result of excavation activities, all flow

will be directed into the borrow area and subsequently into the sedimentation basins.

Temporary stockpiles will be graded, stabilized, and maintained as necessary to minimize

sediment transport. A silt fence will be placed downgradient of stockpiles. Stockpiles will

be seeded within 30 days of material placement.

Erosion and sediment control measures will be inspected periodically and repaired as

necessary, as indicated in the SWPPP.

2.4.5 Water Table

The Proposed Borrow Area is separated into a West and East Area; each area will be

graded to drain to a sedimentation basin. The deepest portion of each area will be within

the sedimentation basin; neither is expected to penetrate the underlying formation of sand

and gravel.

Monitoring wells SB4-08 and SB9-08 are screened in the underlying formation of coarse

sand and gravel. These wells indicate that the water table is several feet below the top of

the coarse sand and gravel formation. The borrow operation will be in the clay till deposit

above the underlying formation of coarse sand and gravel, therefore the excavation will

occur above the water table.

Monitoring well SB6-08 is screened in the clay till formation and groundwater has been

observed in this well. Based on the discussion in Section 2.2.4, this groundwater is likely

representative of a perched groundwater table and may fluctuate seasonally. During

excavation of the clay till deposit, groundwater may be present in isolated areas and during

the wet seasons of the year. In general, this groundwater will not generate large flows and

can be directed to the sedimentation basins.

3.0 RECLAMATION PLAN

Proposed reclamation plans for the areas of the Chaffee facility that were previously permitted

are not modified by this application. These areas have been reclaimed as described in their

respective Mined Land Use Plans. The following sections discuss the reclamation of the

Proposed Borrow Area.

3.1 LAND USE OBJECTIVE

The land use objective for the Proposed Borrow Area will be two permanent basins for

wetland habitat, wildlife habitat, and upland meadows. The final base grades and basins are

shown on Figures 4 through 7.

3.1.1 Disposition of Materials Material borrowed from the site will be used for landfill construction and operations on a

daily basis with little stockpiling, residue, or refuse. Topsoil will be replaced to a depth of

4 to 6 inches on all areas of the excavation. Prior to topsoil placement, all areas should be

scarified.

Oversized material, if encountered, will be buried to a compacted depth no less than 2

feet. Some boulders may be placed on the floor of the permanent pool to serve as habitat.

Any brush that remains will be chipped and used during reclamation or in the operation of

the landfill. The Proposed Borrow Area will contain no permanent equipment or refuse

and will be operated in a clean and orderly fashion on a daily basis.

Spoil and unused aggregate will be placed against the borrow area face or will be used to

create irregular topography during reclamation. Spoil piles will not remain on the site after

borrow operations are terminated.

3.1.2 Haulageways & Access Locations

Access roads or haulageways will be constructed from the main site access road into each

area. Temporary haul roads within each area will be constructed as necessary to allow for

the excavation to proceed. The temporary haul roads will be removed during reclamation,

the main haulageways will remain for site access to the newly formed basins. Gravel will

be placed on the access road surfaces to aid in erosion control and provide a stable

surface.

3.1.3 Drainage and Grading

The side slopes of the proposed borrow area will be graded to a maximum slope of 3

horizontal on 1 vertical. The slopes will be created by excavating to the lines and grades

indicated on Figure 4.

Two basins will be created as a result of operations within the Proposed Borrow Area.

Drainage patterns outside the footprint of the Proposed Borrow Area will not be altered and

the Proposed Borrow Area floor in each area will be graded to drain into the created basins.

Both basins will discharge into NYSDEC wetland SD-1, therefore all areas will continue to

contribute to Hosmer Brook.

Discharge during operations from both basins will be through the drainage pipes and surface

spillways. During reclamation, the drainage pipe will be decommissioned, which will allow

each basin area to form into permanent ponds with outflow through the surface spillways at an

elevation of approximately 1446 feet for the West Area and approximately 1451 feet for the

East Area. The spillways, in conjunction with basin grades, will create deep water and aquatic

shelf habitat within the basins. The spillways will be graded and stabilized as indicated on

Figures 5 through 7.

3.1.4 Re-vegetation

Topsoil will be placed on the reclaimed ground surface and slopes above the basin level as

shown on Figures 4 through 7. The topsoil will be seeded using the following mixture.

Common white clover 8 lbs/acre

Tall fescue 20 lbs/acre

Perennial Ryegrass 10 lbs/acre

Re-vegetation will restore the shores of the basins to a natural state. With prolonged

exposure to saturation and inundation, the soils that are placed in and around the basins

will become hydric in nature, which will promote the expansion of hydrophytic vegetation

from the existing wetland into the newly created basin.

Woody species plantings will be made in the meadow portion of the borrow area and will

include some species that would occur naturally in unplanted farm fields and others that

are considered to provide good elements of wildlife habitat. Species such as Aspen, Pine,

Hawthorn, and Wild Pear will be planted in arbitrary locations, in clumps, and in rows.

Natural succession of vegetation will follow. The reclaimed area will result in a diversity

of upland and wetland cover types.

Additional tree plantings will occur along the southern boundaries of each borrow area.

Native species of trees will be planted along these boundaries both within the 25 foot

setback area and within the first 25 foot area of each borrow area. This will create a 50

foot wide forested strip along the property line upon completing the reclamation.

Animal species will not be introduced to the site, however a natural progression of animal

habitation will occur due to the plant selections, the hydrogeology, the terrain/topography,

and the proximity of the site to NYSDEC jurisdictional wetlands SD-1 and AR-11.

3.1.5 Wetland Mitigation

No work will occur in the jurisdictional wetlands or buffer zones. As such, wetland

mitigation is not required.

3.2 RECLAMATION SCHEDULE

The Proposed Borrow Area is separated into two areas, West and East. The West Area

will be excavated first, starting from the southeast and working toward the northwest. The

East Area Basin will be excavated one year prior to completion of the West Area. Borrow

operations in the East Area will commence upon completion of the West Area and will be

excavated starting in the southwest corner and working toward the northeast. Temporary

grading and seeding will occur after each construction season and final reclamation will

occur within one year after completing each excavation area.

All equipment and stockpiles will be removed from the site as part of reclamation.

CHAFFEE FACILITY -SECTIONS AND DETAILS

CONSTRUCTION SPECIFICATIONS

GENERAL:1. Contractor to verify all dimensions and conditions prior to construction.

2. Any questions regarding these drawings shall be directed to McMahon & Mann Consulting Engineers, P.C.(MMCE) (716 - 834-8932). Modifications will only be made in writing.

3. The Contractor will be responsible for construction layout.

4. The Contractor will be required to comply with all of the applicable Chaffee Facility Permits.

EXCAVATION AND BACKFILL:1. All excavations shall be performed in accordance with OSHA regulations.

2. Excess excavated material shall be disposed of in locations designated by Waste Management of New York(WMNY).

3. Unsuitable materials shall be legally disposed of, coordinate with WMNY for disposal locations.

4. Existing underground utility locations are unknown and must be confirmed with WMNY and utility Companies priorto any excavation.

5. Excavation grades shall be inspected and proof rolled to detect unsuitable materials.

6. Embankment material shall be obtained from the excavation and shall be recompacted to 90% of the ModifiedProctor (ASTM D1557) maximum dry density. Embankment material shall not contain material greater than 10inches in size, organics or other deletrious materials. Embankment material shall be placed in compacted lifts notexceeding 12 inches in thickness.

7. Pipe bedding shall meet the requirements for subbase Type 4 stated in Section 3.04 of the NYSDOT StandardSpecifications. Material shall be compacted to 90% of the Modified Proctor (ASTM D1557) maximum dry density.

STORMWATER DRAINAGE:1. Outlet pipes and standpipes shall be 12 inch and 36 inch diameter as shown on the drawings. Pipe shall be

corrugated exterior polyethylene pipe with a smooth interior wall. Pipe shall meet the requirements stated inAASHTO M294 for type 5 pipe.

2. Light stone rip-rap shall meet the requirements for light stone filling stated in Section 620-2 of NYSDOT StandardSpecifications. Installation shall be in accordance with Section 620-3 of the NYSDOT Standard Specifications.

3. All disturbed areas shall be seeded and mulched, using the following seed mix:Common White Clover 8 lbs. / acreTall Fescue 20 lbs. / acrePerennial Ryegrass 10 lbs. / acre

4. Separation Geotextile shall be a non-woven geotextile with a minimum mass per unit area of 6 oz. meeting therequirements of Geotex 701 or approved equivalent. Installation shall be in accordance with the Manufacturer'srecommendations.

5. Erosion Protection Mat shall consist of a polypropylene fiber mat specially designed for erosion control applicationson steep slopes and vegetated waterways such as C350 permanent turf reinforcement manufactured by NorthAmerican Green (NAG) or Engineer approved. Installation shall be in accordance with the Manufacturer'srecommendation.

AQUATIC PLANTINGS:1. Aquatic bench will be planted with a combination of some or all of the following submerged or floating stemmed aquatics:

Submerged Aquatics: Coontail, Pond Weed, Water Weed, Lond-Leaved Pond Weed and Wild Celery.

Floating Stemmed Aquatics: Spatterdock, Duckweed, Watershield, Water Cress, Rice Cutgrass, Bay Forget Me Not, Swamp Smartweed, Water Smartweed, White Water Lily and Pale Mannagrass.

Other plantings may be allowed if the plants are capable of withstanding constant inundation of water to depths of 1 foot.

No one individual species of submerged or floating aquatics may exceed 10 percent of the total proposed for the project.

Spacing of plantings shall be based on Manufacturer's recommendations. The plantings shall have a two year warranty.

1.0 INTRODUCTION

1.1 OBJECTIVE

This report provides an assessment of the potential environmental impacts associated with

development of a Proposed Borrow Area at the Waste Management of New York, L.L.C.

(WMNY) Chaffee facility. Presently, the 6 NYCRR Part 360 Solid Waste Management Facility

Permit (Permit) for this facility provides for a 52.5 acre Western Landfill Expansion. This landfill

expansion will require large quantities of soil for liner and cap construction. This report has been

prepared to support a proposed modification to the Permit to allow for development of a Proposed

Borrow Area consisting of an East Area and West Area, totaling approximately 30.9 acres in size,

to the south and southeast of the existing landfill. Figure 2 in the Borrow Area Use Plan (BAUP)

shows the locations and lateral extents of the Proposed Borrow Area. WMNY (the

owner/operator of the Chaffee facility) is proposing excavation of soils to a depth of up to

approximately 50 feet below the existing surface elevations.

Discussion and justification for the requested Permit modification is provided in Section 3, below.

No other changes to the design or operation of the facility are proposed for this modification

request.

1.2 REASON FOR PROPOSED MODIFICATION

The primary reason for the requested modification to the Permit is to provide an on-site source of

soil for construction of the landfill expansion liner system. Without this modification, off-site soils

will need to be obtained and trucked to the site for construction purposes.

1.3 SCOPE

The proposed development of the 14.8-acre East Area and 16.1-acre West Area borrow areas, has

the potential to impact the environment by:

• causing noise impacts at nearby receptor locations;

• eliminating some upland forest habitat;

• reducing the visual screening of the landfill operations and

construction;

• causing some localized dust and vehicle emissions; and

• altering surface water runoff flow patterns and surface water quality

due to potential sediment transport.

All of these potential impact areas have been addressed in the Draft Environmental Impact

Statement (DEIS) for the proposed Chaffee Western Landfill Expansion (Reference 1). To the

extent that the impact evaluations included in the DEIS also apply to the Proposed Borrow

Area, they will be referenced in the discussions included in Section 3.

2.0 PROJECT DESCRIPTION

2.1 EXISTING LANDFILL

The Chaffee facility has 103.4 acres of permitted landfill cell area, with an approved design capacity

of 150,000 tons per quarter. Landfill cells are being constructed in accordance with the 6 NYCRR

Part 360 requirements. There will also be approximately 160 acres of ancillary facilities on the site,

including leachate storage tanks, sediment ponds, office/maintenance buildings, access roads, etc,

once construction of the Western Landfill Expansion is complete.

The facility is on Route 16, approximately 1 mile north of the Hamlet of Chaffee, in the Town of

Sardinia.

2.2 PROPOSED MODIFICATION - SOIL BORROW AREAS

WMNY is proposing to develop a Proposed Borrow Area (see Figure 2 in the BAUP) located to

the south and southeast of the existing landfill cell area. The soil borrow areas are approximately

16.1 acres to the west of New York State Department of Environmental Conservation (NYSDEC)

Wetland SD-1, and approximately 14.8 acres to the east of the wetland. A total of approximately 1

million cubic yards of material will be excavated. The majority of soil from this Proposed Borrow

Area will be used for landfill construction with a lesser amount used for daily and intermediate

cover. The soil borrow operations are described in the BAUP.

3.0 POTENTIAL ENVIRONMENTAL IMPACTS

The discussion of potential environmental impacts in this section follows the general sequence and

approach used in the Full Environmental Assessment Form (FEAF) found in 6 NYCRR Part 617.

That document is used by NYSDEC to determine if an action may have a significant effect on the

environment. Although each of the impact areas included in the FEAF are considered in the

following sections, the specific impact areas listed in Section 1.3 (above) will be evaluated in more

detail, because they have been identified as the areas most likely to be adversely affected by the

proposed modification.

3.1 ZONING AND LAND USE

The Town of Sardinia has zoned the existing landfill site (including the proposed soil borrow area)

Business – Light Industrial. WMNY will work with the Town to obtain a Special Use Permit, in

order to proceed with development of the Proposed Borrow Area.

With the exception of the landfill itself, most of the land area within one mile of the Proposed Borrow Area is agricultural land, forested, or wetland.

3.2 WATER RESOURCES

Surface water flow patterns will be impacted by the development of the Proposed Borrow Area. As areas are cleared and excavated, storm water runoff will collect in the excavated areas. Excavation will begin in the southeast portion of the West Area, and the southwest

portion of the East Area. Sedimentation basins will be constructed in these two areas to collect and treat storm water before it is released to NYSDEC Wetland SD-1.

Storm water control facilities and procedures, as described in the facility’s “Stormwater Pollution Prevention Plan for Stormwater Discharges Associated with Industrial Activities, August 2007” (Reference 2), will be implemented in and around the soil borrow areas to control the quality and quantity of storm water discharges.

Quantities of fuels and lubricants in the borrow area will be limited to the amounts contained in the mobile equipment, and the existing “Spill Prevention Control & Countermeasures Plan” will still be effective in reducing the risk associated with release of these materials. Two zones of groundwater are present within the Proposed Borrow Area, the clay till exhibits a perched water table and the underlying formation of coarse sand and gravel contain the permanent water table. The Proposed Borrow Area excavations are not planned to penetrate the underlying formation of sand and gravel, therefore no impact on the sand and gravel groundwater quantity or quality is expected. During excavation of the clay till deposit, groundwater may be present in certain areas and during the wet seasons of the year. In general this groundwater will not generate large flows and can be directed to the sedimentation basins for discharge. Implementation of these facilities and procedures will prevent significant adverse impacts to water resources due to the development of the Proposed Borrow Area.

3.3 AIR RESOURCES

Development of the Proposed Borrow Area could result in dust generation by excavation

activities and soil transport vehicles. These excavation and material transport activities would

not be materially different from those currently occurring at the facility, and similar mitigation

methods will be used to control impacts, as described below:

• Stockpiles of topsoil and subsoil expected to be in place for more than 30 days will

be vegetated or otherwise stabilized to control dust generation;

• Temporary re-vegetation of borrow areas will be completed after each construction

season upon reaching final grades;

• Entrances to the borrow areas will be stabilized to limit the amount of silt and mud

leaving the area on the tires of trucks and equipment;

• On-site unpaved roadways connecting the borrow areas to the cell construction

areas will be constructed of gravel, reducing the amount of fines potentially

disturbed by truck traffic, and these roadways will be watered during dry weather

periods; and

• The nearest residential dwellings are along Route 16, either near the intersection of

Hand Road and Route 16 or adjacent to the Chaffee facilities main entrance,

approximately 2400 feet from the East Area. This buffer distance will reduce

potential dust impacts on sensitive receptors.

The second potential air resource impact is related to exhaust fumes generated by the trucks and

excavation equipment. Although these impacts will occur, trucking soils from off-site locations

would result in more truck emissions due to the longer haul distance, and excavation of soils would

be required at any borrow location. The fact that this facility has considerable buffer distances

between the soil borrow areas and off-site sensitive receptors (at least 2400 feet in all directions)

will mitigate potential air quality impacts due to vehicle exhaust.

The Chaffee facility is required to comply with applicable landfill air emissions permitting

requirements established by NYSDEC.

Air resources on and in the vicinity of the Chaffee facility will therefore not be significantly affected by development of the Proposed Borrow Area.

3.4 ECOLOGICAL RESOURCES

Evaluations of terrestrial and wetlands ecology were prepared as part of the DEIS (Reference

1), which confirmed the lack of significant impacts from the Western Landfill Expansion, and

the absence of threatened or endangered species on the Chaffee facility site.

Some woodland habitat will be lost either permanently or temporarily in the Proposed Borrow

Area, but this type of habitat is abundant in the region, and the borrow areas will eventually be

reclaimed as described in the BAUP. Nearby protected wetland areas (NYSDEC Wetland

SD-1 and AR-11) have been specifically avoided in the layout of the soil borrow areas.

Additionally a 100-foot buffer will be maintained around each NYSDEC wetland to protect

the ecological environment of the area.

Ecological resources on and in the vicinity of the Chaffee facility would therefore not be

significantly affected by development of the Proposed Borrow Area.

3.5 AGRICULTURAL LAND RESOURCES

The area of the Proposed Borrow Area is within Erie County Agricultural District #6, but none of

the property owned by WMNY at this location is active farmland or part of an active agricultural

operation. Obtaining a special use permit for the Proposed Borrow Area will require notification of

active farms within 500 feet of the operation.

3.6 AESTHETIC RESOURCES

A “Visual Impact Analysis” was prepared as part of the DEIS (Reference 1). This study

determined that the view of the Chaffee Landfill is most significant in an area around the

landfill bounded by Hand Road to the north, Savage Road to the west, Allen Road to the

south and Route 16 to the east. Within this area there is some screening of the lower portions

of the landfill at viewpoints to the south and southeast by trees growing in the Proposed

Borrow Area. Removal of these trees will reduce the lower level screening, but the upper

portions of the landfill (which are 150 feet or more above the existing ground surface

elevations in the soil borrow areas) would be visible regardless of the existence of the trees.

Although lower level screening will be reduced, the incremental increase in visual impact

should not be severe.

3.7 HISTORIC AND ARCHEOLOGICAL RESOURCES

As indicated in the DEIS, the Chaffee facility site is not within an archeologically sensitive area,

based on New York State Historic Preservation Act records. An archeological site (UB Site

#1231) is located about 1 mile southeast of the Proposed Borrow Area. The presence of artifacts

at the site has not been verified, based on discussions with the University at Buffalo Archeological

Survey. There are no standing structures within the Proposed Borrow Area, and there is no

evidence of residual foundations from early structures.

Historic and archeological resources on and in the vicinity of the Chaffee facility would not be

affected by development of the Proposed Borrow Area.

3.8 OPEN SPACE AND RECREATION

Open space and recreation on and in the vicinity of the Chaffee facility would not be affected

by development of the Proposed Borrow Area. Chaffee owns all land impacted by the

Proposed Borrow Area. Post closure plans for the soil borrow areas are to create an open

wildlife habitat area.

3.9 CRITICAL ENVIRONMENTAL AREAS

There are no critical environmental areas on or in the vicinity of the Chaffee facility.

3.10 TRANSPORTATION AND TRAFFIC

Traffic is one area of potential environmental impact where the Proposed Borrow Area will have

a beneficial effect. If on-site soils were not available for cell construction, soils would need to

be trucked in from off-site locations, using Route 16 and other local roads. Assuming the 1

million cubic yards of soil available from the Proposed Borrow Area were instead trucked to

the facility from off-site locations in 10 cubic yard loads, 100,000 truck trips would be

required.

Given these factors, when compared to the off-site alternative, it can be reasonably concluded

that the number of vehicles hauling soil to the Chaffee facility would be reduced by

development of the Proposed Borrow Area.

3.11 ENERGY

The effect of the Proposed Borrow Area on energy consumption would be to increase the on-

site consumption of fuels (primarily diesel fuel) for excavation and transport of soils to the

construction area. This increase in energy use would be more than compensated by the

reduced energy consumption associated with the excavation and hauling of soils from off-site

locations.

Consumption of energy resources would be reduced by development of the Proposed Borrow

Area, compared to the off-site alternative.

3.12 NOISE AND ODOR

The change in noise impact related to the development of the Proposed Borrow Area, would relate

to the operation of excavation and transport equipment. Although the specific equipment to be

used and associated noise levels have not been determined, typical levels for excavators and off-

road haul trucks can be estimated from literature sources (e.g. see Reference 3). A very

conservative estimate of noise impacts at nearby receptors has been prepared and is summarized in

Table 1. For this conservative noise estimate, it was assumed that an excavator would be operating

under load, generating a noise level at 50 feet of 85 dBA, while an off-road haul truck would also

be operating under load, generating a noise level at 50 feet of 90 dBA. Attenuation was calculated

due to distance alone (no additional attenuation was included due to topography, vegetation, wind,

etc.), and maximum noise increases at the closest publicly accessible locations were estimated to be

from 6 to 4 dBA. Sound level increases of less than 5 dBA are considered to be "unnoticed to

tolerable" in NYSDEC Noise Guidance Document (Reference 4).

Though there is an increase in noise due to the development of the Proposed Borrow Area, it

should be noted that the reduction in truck traffic stated in Section 3.10 will reduce noise levels

along Route 16.

The potential odor impact associated with the Proposed Borrow Area would be nominal. Exhaust

fumes from mobile equipment would be the main odor source, and buffer distances to sensitive

receptors (approximately 2400 feet to the nearest locations) would be more than sufficient to

mitigate this impact.

Noise and odor impacts would not be significantly affected by the Proposed Borrow Area.

3.13 PUBLIC HEALTH

No change in the primary operation of the facility is being proposed. Quantities of fuels and

lubricants stored on-site will not increase significantly, and the existing “Spill Prevention

Control & Countermeasures Plan” will still be effective in reducing the risk associated with

release of these materials. Public health in the vicinity of the Chaffee facility would therefore

not be affected by development of the Proposed Borrow Area.

3.14 GROWTH AND CHARACTER OF COMMUNITY

Growth and character of the community in the vicinity of the Chaffee facility would not be affected

by development of the Proposed Borrow Area.
