Augsburg Fortress Liturgies License LICENSE TYPE: AFP.LIT 2006-2007 (for use beginning October 1, 2006) Augsburg Fortress (the Publisher), the publishing house of the Evangelical Lutheran Church in America, as owner and/or administrator of certain rights to the works covered by the terms of this license, grants to the congregation or other qualifying organization identified as the registered owner of this license (the Registered License Owner), the nonexclusive right to reproduce and use the material described below (the Licensed Works) solely in the life and work of the Registered License Owner throughout the terms of this license and subject to the conditions described below. ASSIGNMENT OF THIS LICENSE The rights granted by this license are not transferable to any individual, congregation, or other organization without permission. EFFECTIVE DATE AND DURATION OF THIS LICENSE To activate this license, an authorized representative of the applicant must agree to these license terms, sign the order form, and return the signed form with appropriate payment to Augsburg Fortress. If the order is placed on the Augsburg Fortress on-line store, then the authorized representative must check the “I accept these terms” box when placing the license order. Upon receiving the signed form and payment, Augsburg Fortress will issue a license number. This license is in effect from the invoice date and remains in effect for one year from that date, unless terminated by Augsburg Fortress, which may terminate the license at its sole discretion if the Registered License Owner: • Does not use the specified copyright acknowledgment and license number • Assigns the license to any individual, congregation, or organization without permission • Does not otherwise comply with the terms of the license. RENEWAL OF THIS LICENSE At the end of the one-year license term, this license shall automatically renew at the annual rate in effect at the time of the renewal, unless upon receiving the invoice for the next one-year license term, the Registered License Owner terminates the license using the process described on the invoice. USAGE REPORTS At the conclusion of each year in which this license is in effect, the Registered License Owner shall be required to submit a report that fairly and accurately records the use of the Licensed Works. Such report shall be submitted using a form provided by Augsburg Fortress. Failure to submit a timely report of such usage shall be deemed a material breach of this agreement, and Augsburg Fortress reserves the right to pursue appropriate remedies and/or damages, including but not limited to cancellation of this license.
