1. Summary
This report documents findings from the Phase I Environmental Site Assessment (ESA) that
BETA Group, Inc. (BETA) has prepared for the property located at 386 Kilburn Street in Fall
River, Massachusetts (the Site, see Figure 1). The Fall River Assessor’s Office identifies the Site
as subdivided into three parcels of land: parcel B-17-1 which consists of approximately 1.763
acres of land, parcel B-17-9 which consists of approximately 2.765 acres of land, and parcel B-
17-10 which consists of approximately 1.97 acres of land. Records indicate that the Site
buildings on Parcel B-17-1 were constructed circa 1890 and the Site buildings on Parcels B-17-9
and B-17-10 were constructed circa 1883. Ten buildings, some of which are interconnected,
currently exist at the Site.
The purpose of this Phase I ESA was to assess current Site conditions and render an opinion as to
the presence of Recognized Environmental Conditions (RECs) in connection with the property,
within the scope and limitations of the American Society for Testing and Materials (ASTM)
Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment
Process E1527-13. Recognized Environmental Conditions are defined in the American Society
for Testing and Materials (ASTM) Standard E1527-13 as, “...the presence or likely presence of
any hazardous substances or petroleum products on a property under conditions that indicate an
existing release, a past release, or a material threat of a release of any hazardous substances or
petroleum products into structures on the property or into the ground, groundwater, or surface
water of the property. The term includes hazardous substances or petroleum products even under
conditions in compliance with laws. The term is not intended to include de minimus conditions
that generally do not present a material risk of harm to public health or the environment and that
generally would not be the subject of an enforcement action if brought to the attention of
appropriate governmental agencies.” Any exceptions or deletions from the ASTM practice or
Scope of Work are described in Section 2.0 of this Report. Refer to Section 10.0 for a list of
acronyms and their definitions.
Phase I ESA Summary
Based on the activities conducted for this Phase I ESA, BETA has identified the following RECs
at the Site:
Historic industrial use of the Site for auto repair, iron works, textile manufacturing,
millwork, and a laundromat and linen service
Sanborn maps indicate the presence of an oil tank in the courtyard area east of Mill #1. The presence of a closed-in-place 10,000-gallon No. 6 fuel oil UST in the courtyard east
of Mill #1, 20 feet north of the smoke stack.
The documented historic presence of petroleum hydrocarbons in soil at the Site. Although previous investigations have removed impacted soil from the Site, historic data indicates the potential for additional contaminated soil to exist at the Site.

Previous reports indicate the former presence of two 10,000 gallon No. 6 fuel oil USTs east of the boiler house.
RTN 4-25363 associated with the EPA removal action is classified as “Tier 1D” by
MassDEP and is out of compliance.
The presence of debris from the office building that burned down in 2012 can contain
possible OHM.
City of Fall River municipal records indicate the removal of a 3,000 gasoline UST from the area of Mill #4. Sampling information from the removal was not included in the record and location aid of the UST was not given.
The presence of a 20,000-gallon aboveground storage tank (AST) in a building in the
courtyard east of the boiler house
The presence of two closed-in-place vaulted 10,000 gallon No. 6 fuel oil ASTs located
south of the smoke stack in the central portion of the Site.
The presence of vent and fill pipes on the exterior of Mill #4 leading into the building.
The pipes were located on the northwestern portion of the building, however no storage
tank was observed during the site reconnaissance.
Past uses of the Site that include the storage of hazardous material and No. 6 fuel oil.
Although the EPA conducted a removal action within the Site building, solid waste and debris remain throughout the Site buildings

The observation of stressed vegetation and stained pavement in the courtyard area of the
Site adjacent to the boiler house.
The presence of several transformers throughout the Site buildings. Based on the age of
the Site buildings the transformers likely contain PCBs. The presence of a transformer
house built circa 1931 indicates the possible presence of PCBs.
Although the EPA conducted a removal action at the Site, EPA identified the presence of
asbestos containing material (ACM), corrosive and ignitable wastes, and general wastes
at the Site indicating the potential for additional ACM and waste to exist at the Site.
Although the EPA conducted a removal action at the Site, solid waste and debris were
found throughout the Site buildings.
The observation of flaking and peeling paint throughout the Site buildings. Since the buildings were constructed in the late 1800’s, it is likely that LBP is present.
Section 9.0 contains more details on these RECs and discusses recommendations for additional
investigation at the Site.

2. Introduction
2.1 General
At the request of the City of Fall River (the Client), BETA conducted an ASTM Phase I
Environmental Site Assessment (ESA) of the property at 386 Kilburn Street in Fall River,
Massachusetts (the Site, see Figure 1). The Site is subdivided into three parcels of land
consisting of approximately 6.01 acres, these parcels are identified by the Fall River Assessor’s
Office as parcels B-17-1, B-17-9, and B-17-10. Parcel B-17-1 is located in the northeast portion
of the Site and is improved with a 109,930 square-foot two-story mill building. Parcel B-17-9 is
located in the southern portion of the Site and is improved with an approximately 164,878 square
foot five-story mill building, an attached boiler house, an attached three-story mill building, an
attached two-story mill building, an auto house, a 20,000 gallon AST structure, and a vaulted oil
storage structure. Parcel B-17-10 is located west of Parcel B-17-1 and is improved with an
approximately 142,416 square foot five-story mill-warehouse style building, an attached five-
story mill building, and a transformer house. The Site buildings are vacant and the property was
acquired by the City of Fall River through a tax foreclosure on June 13, 2014.
2.2 Purpose and Scope
This report was prepared for the sole and exclusive use of the Client and is subject to and issued
in connection with the Agreement and the provisions thereof. The ESA was conducted to
identify Recognized Environmental Conditions (RECs) based on a review of available
environmental information and observations of the Site and adjacent properties for overt
evidence of a release or threat of release of oil or hazardous materials (OHM). The scope of
services for this ESA included a federal and state environmental database search, local research,
Site reconnaissance, and interviews with people knowledgeable about the Site. This ESA is
subject to the terms of the Agreement between the Client and BETA and the Limitations
included in Appendix A.
The scope of services for this report did not include the assessment of the following “additional
issues” that are outside the scope of the ASTM Phase I ESA: asbestos-containing building
materials, radon, lead-based paint, lead in drinking water, wetlands, regulatory compliance,
cultural and historical resources, industrial hygiene, health and safety, ecological resources,
endangered species, indoor air quality, biological agents, and mold.

3. Project Description
3.1 Site Description
The Site is subdivided into three parcels: B-17-1 consists of approximately 1.763 acres of land,
parcel B-17-9 consists of approximately 2.275 acres of land, and parcel B-17-10 consists of
approximately 1.97 acres of land. The Site is improved by three industrial-style mill buildings
and seven smaller buildings. According to the City of Fall River Assessor’s cards, the buildings
located on parcels B-17-9 and B-17-10 were constructed circa 1883. The building located on
parcel B-17-1 was constructed circa 1890. The Site buildings have been vacant since 2012. The
approximate geographic coordinates of the property are N 41º 40′ 57″ latitude and W 71º 10′ 18″
longitude.
3.2 Current Operations
Other than abandoned equipment, the Site buildings are vacant and are configured for
industrial/warehouse use.
3.3 Building Descriptions
The following summarizes the structures (ten buildings, vaulted ASTs, and a smoke stack)
located at the Site based on the City of Fall River Assessor’s field cards, Sanborn Maps, and
visual observations made by BETA:
Mill #1: A 164,878-square foot five-story mill building, constructed with a granite block
exterior, a wood frame, concrete foundation, and a slightly pitched tar and gravel roof.

Mill #2: A 142,416-square foot five-story mill building constructed of a granite block
exterior, a wood frame, concrete foundation, and a slightly pitched tar and gravel roof.

Mill #4: A 109,930-square foot three-story mill building constructed of a granite block
exterior, a wood frame, concrete foundation, and a slightly pitched tar and gravel roof.

Transformer House: Located east of Mill #2, the transformer house is a single-story
building constructed with a brick exterior. BETA was unable to access the interior of this
building. Refer to Photo 8 in Appendix E
Boiler House: Attached to Mill #1, north of the smoke stack, the boiler house is
constructed with a brick exterior, concrete slab-on-grade foundation, a slightly pitched tar
and gravel roof, and has a 40’ ceiling. Refer to Photo 19 in Appendix E

Cloth Room: Located on the southern portion of the Site and attached to Mill #1, the
cloth room is a two-story building constructed with a granite block exterior and a
concrete foundation. Refer to Photo 22 in Appendix E
Picker Room #1: Located on the southern portion of the Site and attached to Mill #1,
Picker Room #1 is a three-story building, constructed with a granite block exterior,
concrete foundation, and a slightly pitched tar and gravel roof. Refer to Photo 2 in
Appendix E
Picker Room #2: Located in the central portion of the Site and connecting Mill #1 and
Mill #2, Picker Room #2 is a four-story, constructed with a granite block exterior, a wood
frame, concrete foundation, and a slightly pitched tar and gravel roof. Refer to Photo 9 in
Appendix E
Auto House: Located on the southern portion of the Site, east of Picker Room #1, the
auto house is a small single-story building with a granite block exterior and an overhead
door. BETA was unable to access the auto house. Refer to Photo 1 in Appendix E
Oil Storage Vault: Located east of Mill #1, adjacent to the smoke stack, the oil storage
building is vaulted and constructed of a brick exterior. BETA was unable to access the
interior of the building. Refer to Photo 21 in Appendix E
AST Structure: Located east of the boiler house, the AST structure contains a 20,000
gallon No. 6 fuel oil AST. BETA was able to view the interior of the structure, however
could not access the entire structure. Refer to Photo 16 in Appendix E
Smoke Stack: Located east of Mill #1, north of the oil storage vault. Refer to Photo 18 in
Appendix E.
3.4 Building Heating and Cooling System
The buildings were most recently heated by unit heaters fired by natural gas. BETA encountered
records pertaining to the historic use of fuel oil to heat the Site buildings. BETA did not observe
any cooling systems at the Site.
3.5 Plans and Specifications
A copy of the City of Fall River Assessor’s Map is provided as Figure 2.
3.6 Utilities
The City of Fall River provides municipal water and sewer services to the Site and Liberty
Utilities supplies natural gas and electric to the Site.

3.7 Environmental Land Use Restrictions
BETA did not encounter any evidence of an Activity and Use Limitation (AUL) or other
restriction on the deed for the Site. Additionally, the City is not aware of any AULs or other
institutional controls on the property.
3.8 Purchase Price
The City of Fall River involuntarily acquired the property through a Decree of Foreclosure on
June 13, 2014; therefore there was no purchase price in the most recent property transfer. The
property was previously purchased by Five Kings Associates LLC for $2,025,000 in 2004.
3.9 User Provided Information
Mr. Chris Gallagher, Projects Manager for the City of Fall River, and Mr. Matthew Thomas,
legal counsel for the City of Fall River, provided BETA with information summarized in this
report based on actual knowledge of the Site. The City informed BETA that this Phase I ESA
was being conducted under the City’s U.S. EPA Brownfields Assessment grant. Additional
information provided by Mr. Gallagher and Mr. Thomas is included in various sections of this
report. Appendix B contains a copy of the questionnaire completed by the City.

4. Site Characteristics
4.1 Surface Water
Cook Pond is located immediately east of the Site.
4.2 Site Drainage/Sensitive Receptors
BETA observed a drainage culvert on the eastern portion of the Site. The culvert discharges into
the northwest portion of Cook Pond.
4.3 Topography
The Site is located at an elevation of approximately 190 feet above the 1929 National Geodetic
Vertical Datum. The Site is relatively flat but the vicinity slopes downward to the east and south.
4.4 Soils and Geology
Soils
According to the United States Department of Agriculture Soil Conservation Service (SCS) Soil
Map, soils at the Site consist of Urban land. Soils in this complex consist of excavated and filled
land.
Geology
Bedrock outcrops were not observed at or in the vicinity of the Site. According to the Bedrock
Geologic Map of Massachusetts (1985), bedrock beneath the Site consists of the Fall River
Granite. Soil borings previously advanced at the Site identified silty, fine to medium sand with
gravel throughout the property. Bedrock was not encountered to a depth of twelve feet below
grade.
4.5 Groundwater
According to the MassGIS on-line Priority Resource Map, the Site is not located within a
Surface Water Supply Protection Zone. The Site is not located within a Public Water Supply
Watershed, a Zone II, or an Interim Water Protection Area (IWPA). Therefore, groundwater at
the Site is classified as RCGW-2. Based on local topography, surface water bodies and previous
investigations, groundwater at the Site flows in an easterly and southeasterly direction toward
Cook Pond. Additionally, based on previous subsurface investigations at the Site, groundwater
has been encountered at depths from three to five feet below grade. A groundwater monitoring
well was observed south of the boiler house. Two groundwater monitoring wells were observed
adjacent to the vaulted oil structure, but are damaged and unusable. A monitoring well was

observed east of Mill #4 on the loading dock ramp, however BETA could not find a report with
information regarding the well. Figure 2 depicts these wells and former wells at the Site.
4.6 Wetlands
BETA did not observe any wetlands type vegetation at the Site. BETA observed vegetated areas
on the edge of Cook Pond. According to MassGIS Priority Resource Map, wetlands are depicted
southeast of the Site along Cook Pond.
4.7 Floodplain Information
According to the Federal Emergency Management Association (FEMA) Flood Insurance Rate
Map (FIRM) Number 25005CO341G dated July 16, 2014, the Site is located in Zone X, which
has been determined to be an area outside the 0.2% annual chance floodplain.

6. Site History
6.1 Sanborn Fire Insurance Maps
Sanborn maps identify prior Site uses of real property for many cities and towns in the United
States. The maps were originally created to assist insurance underwriters in understanding the
potential fire risk of structures requiring insurance; however, they are also useful for determining
the previous uses of a property. Sanborn maps often contain information relating to uses of
individual structures, location of certain fuel storage tanks, chemical storage tanks, or both, and
storage of other potentially toxic substances. Sanborn maps begin their coverage in 1867 and
continue through the present. BETA requested copies of Sanborn maps for the Site from
Environmental Data Resources, Inc. (EDR). EDR provided copies of 1893, 1905, 1933, 1950,
and 1976 Sanborn maps. A copy of the Sanborn maps are included in Appendix C. The
following summarizes our review of these maps:
1893: This map depicts the Site as occupied by “King Phillipp’s Mill.” The map depicts a
smaller footprint than the current Site buildings. The map depicts a portion of Mill #2 on the
northern portion of the property, the map does not depict the rest of the property. According
to the Fall River Assessor’s records, all Site buildings were constructed prior to 1893.
1905: This map depicts the Site as occupied by “King Phillip Mills.” The Site consists of
buildings Mill No. 2, Mill No. 4, and the Picker House. Additional notes indicate that the Site
is heated by steam and hot air, the lights operate off electric and gas, and automatic sprinklers
are located throughout the building. A boiler room is depicted in the center of the Site and
labeled “boiler ho. No. 2.”
1933: This map depicts the Site as occupied by “Berkshire Fine Spinning Associates Inc.
King Philip Mills, Plant A.” The building footprints appear to be similar to the current
building footprints. The Site consists of buildings Mill “1,” Mill “2,” and Mill “4,” a
transformer house, Picker Rm “1,” Picker Room “2,” a cloth Room, an auto house, a boiler
house, an oil storage building, and an office building. The boiler room is still present and
south of the boiler room is a building listed as “oil storage”. An “oil tank” is depicted
between the oil storage building and the boiler house. The map also depicts a transformer
house between Mill “1” and Mill “4.”
1950: This map depicts the Site as occupied by “Berkshire Fine Spinning Associates Inc.
King Philip Mills, Plant E.” The map depicts the Site as similar to the 1933 map. Additional
notes indicate the facility is powered by electricity fueled by coal.
1976: This map depicts the Site as similar to the 1950 map; however, the Site is occupied by
Tilly Realty Corp.

6.2 Aerial Photographs
BETA requested copies of historical aerial photographs for the Site from EDR. EDR provided
copies of 1939, 1952, 1962, 1966, 1970, 1977, 1981, 1986, 1991, 1995, 2005, 2006, 2008, 2010,
and 2012 aerial photographs. A copy of the EDR aerial photograph report is included in
Appendix C. The following summarizes our review of these aerial photographs:
1939, 1952. 1962, 1966, 1970, 1977, and 1981: These photographs depict the Site as
improved with buildings similar in footprint to the current Site buildings. Buildings to the
south improve the surrounding area and appear similar in footprint to the present day
buildings. Buildings to the north and west improve the surrounding area and appear similar in
footprint to the present day buildings. Cook Pond appears east of the Site.
1986, 1991, and 1995: These photographs depict the Site and vicinity as similar to the 1981
photograph. Buildings appear east of the Site next to Cook Pond.
2005 and 2006: These photographs depict the Site as similar to the 1995 photograph.
Buildings appear southeast of the Site and appear similar in footprint to the present day
buildings.
2008 and 2010: These photographs depict the Site and vicinity as similar to the 2006
photograph.
2012: This photograph depicts the Site as similar to the 2010 photograph, however the
building located west of Mill #1 on the southern portion of the Site is no longer there.
6.3 Topographic Maps
BETA requested copies of historical United States Geologic Survey (USGS) topographic maps
for the Site from EDR. EDR provided 1888, 1893, 1944, 1950, 1967, 1979, and 1985 USGS
Topographic Maps. A copy of the topographic map report is included in Appendix C. The
following summarizes our review of these maps.
1888 and 1893 – These maps depict the Site as improved with buildings similar in footprint
to the current Site building. Based on the scale of these maps, the surrounding vicinity are too
small to depict structures.

6.5 Interviews
BETA interviewed Mr. Chris Gallagher, a representative of the City of Fall River. Mr. Gallagher
stated than an EPA removal action took place in October 2014 and that 100 barrels of
miscellaneous containers were removed from Mill #1. He further stated that the EPA removal
action occurred along the western portion of Mill #1, but drums remained in various locations
throughout the basement of Mill #1. Mr. Gallagher stated that the concrete floor was on soil, but
might have an underdrain system. He stated that Mill #4 has a dirt basement that might be
connected to the other buildings. He further stated that two transformers were located on the roof
of Mill #1 and are still connected.
6.6 Previous Reports
BETA identified previous assessments covering the Site during the research for this Phase I
ESA. The following is a summary, listed by MassDEP Release Tracking Number (RTN), of
reports BETA encountered from the MassDEP and US EPA websites. Appendix D contains
copies of pertinent sections of these reports.
BETA Records
April 3, 2000, UST Closure-in-Place Letter, BETA Group, Inc.
BETA issued a letter to the Fall River Fire Department requesting permission to fill a 10,000-
gallon No.6 fuel oil UST with “tank slurry.” The letter indicated structural integrity concerns
associated with its removal because it was located 20 feet north of the smoke stack. BETA
also stated the removal of the tank would jeopardize two fuel oil lines located above the
UST, running from two 20,000-gallon No. 6 fuel oil tanks to the boiler room. BETA also
stated that the removal of the UST would jeopardize the structural integrity of the smoke
stack, boiler room, and pump house.
May 14, 2000, #6 Fuel Oil Release, BETA Group, Inc.
BETA issued a letter to Mr. Andrew Strasmich of Tilly Realty Associates regarding a release
of No. 6 fuel oil in the boiler room at the Site. The quantity of fuel oil released was not
provided. The release occurred on May 14, 2000 due to a failed valve fitting. BETA
conducted an inspection of the release on May 17, 2000 and observed that all released oil
was contained within concrete utility trenches and the concrete floor of the boiler room.
Based on observations by BETA, it was determined that the release wasn’t reportable to the
MassDEP. The letter states that clean-up was underway at the time and BETA would conduct
a re-inspection after clean-up. No further documentation was found.
May 16, 2000, Underground Storage Tank Closure, BETA Group, Inc.
BETA issued a Closure Assessment Report to Tilly Realty Associates regarding the in-place
closure of the 10,000 gallon No. 6 fuel oil UST. The letter states the City Fire Marshall

approved the abandonment of the UST on April 5, 2000. On April 21, 2000, the UST was
inspected and cleaned. No holes or release pathways were noted. The letter indicates that no
holes were bored into the UST to retrieve soil samples because the UST was mostly below
the water table. After the tank inspection, AAV Services, Inc. filled the UST with tank slurry.
RTN 4-15725
September 20, 2000, Notice of Responsibility, MassDEP
MassDEP issued a notice of responsibility to Tilly Realty Associates (Tilly) on September
20, 2000 and assigned RTN 4-15725 to the release. On September 5, 2000, MassDEP
conducted an inspection of the Site after receiving notification of a possible release at the
Site. During the inspection, MassDEP estimated 200 steel and fiber drums were stacked
improperly and fell over. MassDEP noted that several containers were ruptured, releasing
paint and wax to the surrounding soil. At the time of notification, removal of contaminated
media, deployment of absorbent material, removal of drums/containers, and installation of a
temporary cap/cover was approved by MassDEP.
January 2001, Immediate Response Action (IRA) Plan & Completion
Statement/Response Action Outcome (RAO), BETA Group, Inc.
The courtyard area east of Mill #1 adjacent to the smoke stack was impacted by a release of
paint and wax compounds from ruptured drums. The paint compounds released were non-
hazardous and wax compounds released were limited to less than one gallon. As part of the
IRA the following actions were conducted:
Deployment of absorbent/containment materials
Removal and disposal of all damaged drums and their contents
Transfer of all drums in good condition into the building
The proper storage of reusable commodity and;
Disposal of remediation wastes (non-hazardous waste to municipal solid waste
(MSW) dumpster on-site).
The report concluded that the release was limited to the asphalt surface and did not affect soil
or groundwater at the Site. BETA concluded that a condition of No Significant Risk was
achieved for the release area. A copy of the IRA Plan & Completion Statement/Response
Action Outcome is included in Appendix D.
RTNs 4-15730 and 15731
September 20, 2000, Notice of Responsibility, Massachusetts Department of
Environmental Protection (MassDEP), RTN 4-15730
MassDEP issued a notice of responsibility to Tilly on September 20, 2000 and assigned RTN
4-15730 to the release. On September 6, 2000, MassDEP conducted an inspection of the Site
after receiving notification of a possible release at the Site. During the inspection activities,

MassDEP found No. 6 fuel oil in an exploratory excavation. MassDEP approved the
following response actions as part of an Immediate Response Action (IRA):
Excavation and disposal of up to 100 cubic yards of petroleum impacted soil
Vacuum removal of 1,500 gallons of contaminated water
September 26, 2000, Notice of Responsibility, Massachusetts Department of
Environmental Protection (MassDEP), RTN 4-15731
MassDEP issued a notice of responsibility to Tilly on September 26, 2000 and assigned RTN
4-15731 to the release. On September 6, 2000, MassDEP conducted an investigation of the
AST vault adjacent to the smoke stack east of Mill #1. The AST vault contains two 10,000
gallon tanks containing No. 6 fuel oil. MassDEP observed fuel oil in the AST vault and
staining from overfilling. Groundwater was noted in the vault. At the time of notification, no
response actions were approved as part of an IRA.
IRA Completion Report, BETA Group, Inc., February 2001, RTN: 4-15730
On September 6, 2000, BETA oversaw the excavation of approximately 52.5 yd3 of soil.
BETA also oversaw the removal of 1,050 gallons of contaminated water from the excavation
area. BETA concluded that the reportable condition had not been controlled and eliminated
and future response actions would be necessary.
September 2001, Phase I-Initial Site Investigation and Tier Classification, Coneco
Engineers and Scientists (Coneco), RTN 4-15730 and RTN 4-15731
Coneco conducted an initial site investigation in July 2001. The site investigation was
conducted in the courtyard area east of Mill #1 to the southern end of Mill #4. Coneco
oversaw the advancement of fourteen soil borings, twelve of which were completed as
monitoring wells. Soil and groundwater samples were collected for analysis of extractable
petroleum hydrocarbons (EPH) and polycyclic aromatic hydrocarbons (PAHs). Non-aqueous
phase liquid (NAPL) was detected in monitoring well CMW-7. The remaining eleven
groundwater samples were below the applicable Method 1 Risk Characterization standard.
Field screening of soil samples detected total volatile organic compounds (TVOCs) from
below the instrument detection limit to 89 parts per million (ppm). Soil samples from borings
GP-1, GP-8, GP-10, and GP-12 exceeded the applicable Method 1 S-2 and S-3 standards.
Due to the NAPL in the groundwater at the Site, Coneco recommended a Phase II
Comprehensive Site Assessment and Phase III Remedial Action Plan within two years.
Coneco also recommended a Release Abatement Measure (RAM) be completed for the
removal of the two 10,000 gallon No. 6 fuel oil tanks, removal of petroleum-impacted soil,
and the removal of groundwater and NAPL in the vicinity of monitoring well CMW-7.

February 2007, Class A-2 Response Action Outcome and Release Abatement Measure,
Lightship Engineering (Lightship), RTN 4-15730 and RTN 4-15731
Lightship conducted RAM activities in the courtyard area south of the boiler house in
October 2006 including removal of impacted soil in the vicinity of monitoring well CMW-7.
After removing the impacted soil, monitoring well CMW-7 was replaced with monitoring
well CMW-7R. Impacted soil was excavated and removed to a depth of six feet below grade
due to shallow groundwater. Six confirmatory samples (W-1, W-2, W-3, W-4, and W-5 and
B-1) were taken from the sidewalls and depth of the excavation and submitted for analysis of
EPH and PAHs. The concentration of C11-C22 aromatics in the samples from W-3 and W-4
were above Method 1 S-1 GW-2/3 standards. Concentrations of C9-C18 aliphatics, C11-C22
aliphatics, and C11-C22 aromatics in the sample from B-1 exceeded the Method 1 S-1 GW-2/3
standards. Three test pits were excavated in the area south and east of monitoring well
CMW-7 to determine the extent of impacted soil at the Site. Test pits were excavated to a
depth of three feet below grade and no visual or olfactory evidence of contamination was
encountered.
In December 2006, Lightship advanced five borings in the area of the excavation and one
boring east of the excavation. Soil samples were submitted for analysis of EPH and PAHs,
concentrations of C11-C22 aromatics were above Method 1 S-1 GW-2/GW-3 standards and
Method 1 S-2 GW-2/GW-3 standards in one sample. Analytical results for all other samples
were below Method 1 standards. Contaminated soil was stockpiled and a sample was taken
for waste characterization and TCLP lead analysis. Stockpiled soil was approved for disposal
at Aggregate Industries (Aggregate) in Stoughton, Massachusetts. Approximately 33.39 tons
of excavated material was transported under a Bill of Lading (BOL) to Aggregate for asphalt
batch recycling on December 20, 2006.
Lightship advanced a soil gas sample probe in the vicinity of well CMW-7R to assess
potential for indoor air impacts. The sample concentration was below the soil gas screening
threshold. After removal of impacted soil, a groundwater sample was taken from well CMW-
7R and submitted for analysis of EPH. The concentration of C9-C18 aliphatics in the sample
from CMW-7R exceeded the Method 1 GW-2 standard. Lightship concluded that no
remedial waste was left on-site and considered the RAM complete. Lightship determined that
Cooks Pond, located 65 feet from the Site had not been impacted by the release of No. 6 fuel
oil. Lightship did not observe NAPL in monitoring well CMW-7R after completion of RAM
activities. Lightship concluded that a level of No Significant Risk was achieved for the
release area following RAM activities.

EPA “Action Memorandum,” July 8, 2014
According to the EPA memorandum, on March 5, 2003, the Fall River Fire Department,
Massachusetts State Fire Marshall’s office, EPA, and MassDEP conducted an inspection of
the Site. The inspection was conducted due to a report of improper OHM storage. The memo

states that approximately 200 drums containing paint and wax compounds were stacked on
pallets. Small containers contained alcohol-based cleaning products, pesticides, and wood
treatment oil. This memorandum states “an environmental consultant characterized and
disposed of the material.” Some non-hazardous materials were left at the Site. Site
investigations conducted in 2013 and 2014 identified that the materials left in 2003 were
improperly stored. The memo states that MassDEP intends to address the 10,000 gallon AST
with bunker C oil located at the Site.
On December 12, 2013, MassDEP, EPA, and the Fall River Fire Department conducted a site
walk noting numerous 55-gallon containers throughout the Site.
On March 13, 2014, EPA and the START contractors collected drum samples, soil samples,
and tank and small container samples. Results from the laboratory analysis indicated
hazardous substances with a pH of 13 and flashpoint of 26 °C. A small amount of friable
asbestos was noted on the floor of the mill.
Proposed removal actions are listed as part of the memorandum and include but are not
limited to:
Conducting sampling as needed to identify potential hazards Conduct air monitoring to determine levels of respiratory protection and to determine
exclusion zone Removing drums, containers, product, pollutants, or contaminants, and hazardous
substances from within or outside the buildings Disposing of hazardous substances at EPA-approved facility
EPA Removal Action
On December 12, 2013, a site walk conducted by EPA and MassDEP representatives noted
the presence of 55 gallon drums containing potentially hazardous material on site. On March
12, 2014 samples were collected and sent to Alpha Analytical (Alpha) and New England
Regional Laboratory. Laboratory results indicated the 55 gallon drums contained potentially
hazardous material, including concentrations of volatile organic compounds (VOCs) 1,2,4-
trimethylbenzene (7,100 µg/kg) and para-isopropyltoluene (13,000 µg/kg) in the sample from
DR-03. Chrysotile asbestos was also detected in one of the drum samples at a maximum
concentration of 20%.
The following summarizes the EPA Removal at the Site:
September 17, 2014: Fall River Department of Community Maintenance (DCM)
removed 10 cubic yards of boxes containing paint cans, sprays, cleaning products,
adhesives, sealants, and paint thinners. Seven propane tanks, 22 fire extinguishers, and
five garbage bags of empty paint cans and various containers were also removed from the
Site.

November 12, 2014: Tradebe Environmental Services, LLC began HazCat operations and
removed 19 small containers of corrosives and other wastes from the Site.
November 12, 2014: ENPRO removed 11 drums of sludge and 63 drums of corrosives
and general waste
November 13, 2014: ENPRO packed and removed 16 cubic yard boxes of various
containers and 5 drums of asbestos containing material (ACM).
November 14, 2014: Activities were completed, and all equipment and personnel were
demobilized.
MassDEP Release Amendment Forms
The following summarizes MassDEP release amendment forms regarding the Site:
December 12, 2013: During an initial site walk conducted by the City, MassDEP, and US
EPA, the threat of a sudden release was noted at the Site and RTN 4-25363 was assigned
to the release. During the site walk the presence of 55 gallon drums were noted at the
Site. The initial site walk was done to establish the responsibility of the EPA to conduct a
removal action.
March 24, 2014: City of Fall River, U.S. EPA, and MassDEP representatives met at the
mayor’s office. The concern of the neighborhood and the fire risk of the Site were
discussed. EPA was distributing flyers associated with the sampling event for March 16,
2014. Sampling is summarized in the EPA “Action Memorandum” listed above.
August 12, 2014: MassDEP conducted a site walk with the EPA, the START contractor,
and a structural engineer at the Site. During the site walk, it was determined that the EPA
timeline for the removal action was not feasible. This was determined due to the number
of containers and layout of the building. Concern over the failing integrity of the smoke
stack was discussed. Product removal from an AST was discussed during the site walk
and would not be completed at the time. A new timeline would be proposed by START
to the EPA.
September 11, 2014: MassDEP conducted a site inspection to determine the progress the
EPA had made removing drums and containers from the Site. The form states that
sampling will be completed to determine whether the waste would be handled by EPA or
MassDEP.
October 2, 2014: MassDEP and U.S. EPA attended the southend neighborhood monthly
meeting. EPA and MassDEP reported the status of the Removal Action and what had
been removed to date. The fire risk associated with the mill building was discussed. The
City of Fall River Building Department discussed the need to demolish the smoke stack
at the Site.

October 21, 2014: MassDEP sent a request for access letter to the City of Fall River
mayor’s office. MassDEP summarized the scope of work to be conducted by the EPA as
well as a timeline. A list of frequently asked question regarding access was attached to
the letter.
November 3, 2014: MassDEP requested access to the Site.
November 13. 2014: MassDEP was on site to observe materials being loaded onto tractor
trailer. Stated that EPA Removal Action was to be completed by end of the day and the
loading dock area was empty. Julie Hutcheson of MassDEP would be in touch with the
City about demolishing the smoke stack. The EPA/contractor removed the following:
Two tractor trailer loads of drums, containers and 16-1 yd3 boxes with smaller
items
One box truck of lab packed drums, a total of seven drums were removed
One box truck containing eleven drums of sludge waste
BETA did not encounter any filings or reports for RTN 4-25363. MassDEP’s website
lists this RTN as “Tier 1D” indicating that this RTN is not in compliance with MassDEP
regulations.
6.7 Ownership History
According to the City of Fall River Assessor’s records, the Site was acquired by the City of Fall
River on June 14, 2014 due to a Decree of Foreclosure. The following table summarizes a chain
of title card for Site ownership back to 1927.

6.8 Adjacent Properties
The Site is located at 386 Kilburn Street in Fall River. According to the Fall River Tax
Assessor’s card, the Site is zoned industrial. However, buildings to the north, south, and west are
zoned residential and commercial. BETA did not observe any evidence of past spills or releases
related to any of the commercial properties nearby.

6.9 Historical Summary
According to the historical resources reviewed for this Phase I ESA, the Site was developed from
as early as 1888. King Philip Mills occupied the Site buildings from construction circa 1883 until
circa 1986 for use as a cotton textile mill. In 1986, the Site was purchased by Tilly Realty
Associates and was leased to several businesses. King Philip Mills purchased the Site in 1999
from Tilly Realty Associates. Five King Associates LLC purchased the Site in 2004 from King
Philip Mills and occupied the Site from 2004 until June 2014, when the City of Fall River
acquired the property due to tax foreclosure. Former operations at the Site include use as a cotton
mill, a laundromat and linen service, a woodworking shop, a learning center, and small engine
repair shop.
An AST is located in the central portion of the Site, east of the boiler house. Records
indicate that a 20,000 gallon No. 6 fuel oil tank was installed at the Site in October 2000.
BETA observed a vaulted oil storage structure south of the smoke stack. Records indicate that the oil storage structure contains two 10,000 gallon ASTs containing No.6 fuel oil.
Previous reports indicate two 10,000 gallon No. 6 fuel oil USTs were removed from the
area east of the boiler house.
Fall River records indicate that a 3,000 gallon gasoline UST was removed in the area of Mill #4 in February 1996, no location aid was given.
BETA records indicate the closure-in-place of a 10,000 gallon No. 6 fuel oil UST in April 2000, the UST was located east of Mill #1, 20 feet north of the smoke stack.
Sanborn maps indicate the presence of an oil tank south of the boiler house in the courtyard area.
BETA observed vent and fill pipes on the northwest exterior of Mill #4, however BETA
could not access the interior portion of the building to identify the existence of a tank in that area.
Report Discrepancies
According to BETA records and the initial site investigation by Coneco, the vaulted oil storage
structure contains two 20,000 gallon No. 6 fuel oil ASTs. The Lightship report from 2007
indicates two 10,000 gallon No. 6 fuel oil ASTs are located in the structure and are closed-in-
place. No records indicate the closure-in-place of the vaulted oil storage tanks. Based on the site
plan and report, it was not possible to determine location of paint and wax release.

7. Site Reconnaissance
7.1 Nature of Operations & Current Tenants
At the time of our inspection, the Site was improved with ten vacant industrial-type buildings, a
vaulted oil storage structure, and a smoke stack. BETA observed building debris west of Mill #1,
an office building formerly occupied the area. Appendix E contains photographic documentation
of our Site inspection. BETA observed unauthorized residential use of the property throughout
Mill #1 and Mill #2. Additionally, several areas of trash (empty containers, furniture, and
miscellaneous debris) are located throughout the Site buildings.
7.2 Oil and Hazardous Materials (OHM) Storage and Usage
BETA observed an aboveground storage tank in an enclosure adjacent to the smoke stack in the
central portion of the Site. A vaulted oil storage structure is located south of the smoke stack.
Records indicate a permit was issued for No. 6 fuel oil storage in 2000. Records indicate a 3,000
gallon gasoline UST was removed near Mill #4.
7.3 Petroleum and Chemical Storage Tanks
BETA observed evidence of several aboveground storage tanks at the Site. The following
summarizes petroleum storage observed at the Site:
A 20,000 gallon No. 6 fuel oil AST is located in the central portion of the Site, east of the
boiler house. A vaulted oil storage structure containing two 10,000 gallon No. 6 fuel oil ASTs south of
the smoke stack.
Several unit heaters were observed throughout the Site buildings
The boiler house located in the central portion of the Site contains four inactive boilers of varying size that were formerly used to heat the Site buildings. Boilers are also located on the first floor of Mill #4
BETA observed vent and fill pipes on the northwest exterior of Mill #4, however BETA
could not access the interior portion of the building to identify the existence of a tank in that area.
7.4 Environmental Permits
BETA did not encounter current environmental permits during the research for this Phase I ESA.

7.5 Hazardous Waste
BETA observed the active storage of hazardous waste at the Site and was not able to inspect the
entire Site due to safety concerns. During the EPA Removal Action, drums of sludge and
corrosive materials were removed from Mill #1. Small containers containing corrosive waste
were also removed from Mill #1. Although the EPA conducted a removal action in Mill #1,
drums, drum covers, and small containers were observed throughout the Site buildings.
7.6 Solid Waste and Wastewater
Solid Waste
Solid waste is not currently generated at the Site. However, BETA observed trash and debris
throughout the Site buildings. Additionally, we observed computer monitors, furniture,
televisions, and miscellaneous waste throughout the Site buildings.
Sanitary Sewage
Sanitary sewage is not currently generated at the Site; however, the building is connected to the
municipal sewer system
Liquid Discharges
BETA did not observe liquid discharges at the Site.
7.7 Site Housekeeping
The Site buildings are currently vacant. Interior observations of Site buildings revealed piles of
miscellaneous debris and solid waste. Drums and drum covers were observed throughout the Site
buildings.
7.8 Stained Soil, Stained Pavement or Stressed Vegetation
BETA observed stained pavement in the asphalt parking area east of Mill #1, refer to Photo 42 in
Appendix E. Staining appeared to be from a paint substance. BETA noted apparently stressed
vegetation along the central portion of the Site in the area south of the boiler house, refer to
Photo 41 in Appendix E. Based on previous reports, this area is where fuel oil contaminated soil
was removed.
7.9 Interior and Exterior Drainage Structures
BETA did not observe any evidence of interior drainage structures at the Site. Mr. Gallagher
stated there could be an interior undrain system in the buildings, but was unsure. We observed a

drainage channel along the eastern exterior portion of the Site flowing in a southeast direction
toward Cook Pond. BETA observed one catch basin in the paved area northeast of Mill #2.
7.10 Pools, Ponds, Pits or Lagoons
BETA did not observe any man-made pools, ponds, pits or lagoons at the Site.
7.11 On-Site Water Supply and Observation Wells
Fall River municipal water serves the Site and vicinity. BETA observed four monitoring wells at
the Site. Based on previous reports, it is believed that monitoring wells CMW-1 and CMW-2
were observed adjacent to the vaulted oil storage structure. Based on previous reports, it is
believed these wells were installed by Coneco Engineers and Scientists. The monitoring well
south of the boiler house is believed to be CMW-7R installed by Lightship Engineering. A fourth
well was observed east of Mill #4 on the loading dock ramp and could not be identified.
Additionally, based on the condition of these wells, two appear to be serviceable. Please refer to
Figure 2 for the location of these wells.
7.12 Fill Material
BETA observed evidence of urban fill at the Site such as brick fragments and glass on the
ground surface in the courtyard area east of Mill #1.
7.13 Air Emissions
BETA did not observe indications of significant air emissions at the Site.
7.14 Indoor Air
BETA did not observe any potential impacts to indoor air.
7.15 Odors
BETA did not notice any odors during the Site reconnaissance. BETA detected a wood burning
odor in the basement of Mill #1. The odor appeared to be from unauthorized residential use of
the property.
7.16 Polychlorinated Biphenyls (PCBs)
BETA observed transformers on the first floor of Mill #1 near the connection to Mill #2.
Transformers were noted in Mill #2 on the first and second floors. BETA observed eleven
transformers throughout Mill #1 and Mill #2, refer to Photo 26 and Photo 30 in Appendix E.
Sanborn maps indicate a transformer building between Mill #2 and Mill #4, however BETA
could not access this building. Transformers are located behind the transformer house in a fenced

area and could not be accessed, refer to Photo 43 in Appendix E. Fluorescent light fixtures were
found throughout the Site buildings. Based on the age of the Site buildings, these transformers
and light fixtures likely contain PCBs.
7.17 Asbestos Containing Materials (ACM)
Since the Site buildings were constructed circa 1883, it is likely that building materials would be
classified as ACM. During the EPA removal action, ACM was removed from the Site. A
comprehensive ACM inspection was beyond the scope of this ESA. Mr. Chris Gallagher voiced
concern of ACM on boiler equipment located on the first floor of Mill #4, formerly occupied by
Crown Linen.
7.18 Lead Based Paint (LBP)
Since the Site buildings were built in the late 1800’s, it is likely that LBP is present. A
comprehensive LBP inspection was beyond the scope of this ESA. BETA observed
flaking/peeling paint inside the Site buildings.
7.19 Lead in Drinking Water
Testing for lead in drinking water was beyond the scope of this ESA.
7.20 Radon
Measurement of potential radon contamination was beyond the scope of this ESA. The U.S. EPA
publishes a map of the United States on which each of the 3,141 counties in the U.S. is assigned
to one of three zones based on radon potential. Each zone designation reflects the average short-
term radon measurement that can be expected to be measured in a building without the
implementation of radon control methods. According to the EPA map, the Radon Zone for
Bristol County is 2. Zone 2 is defined as having indoor average radon levels of 2 to 4 picocuries
per liter (pCi/L). EPA recommends action at concentrations of 4 pCi/L or higher in indoor air.
Additional information on radon in indoor air can be found on the US EPA website at

7.21 Areas Not Inspected
BETA inspected accessible interior and exterior portions of the Site buildings. BETA inspected
accessible interior areas of the Site; however, our inspection was limited by the poor condition of
the buildings and the presence of debris throughout the interior of the Site buildings. Due to a
water main break and flooding in the basement of Mill #4, only the first floor of Mill #4 could be
entered during our Site inspection due to safety concerns. Figure 3 shows areas not inspected
during the Site reconnaissance.

8.0 Records Review
The EDR report gives a listing of sites identified on select federal and state standard source
environmental databases within the approximate search radii specified by ASTM Standard
Practice for Environmental Site Assessments E1527-13. BETA reviewed each environmental
database on a record-by-record basis to determine if certain sites identified in the EDR report
represent environmental liability to the Site. A copy of EDR regulatory database report is
included in Appendix E. The following table lists the number of sites identified by the EDR

The EDR report also identified 8 non-geocoded sites. These are sites that could not be mapped or
“geocoded” due inadequate address information. Refer to the EDR report for a list of these sites.
BETA attempted to locate these sites via vehicular reconnaissance and interviews with personnel
familiar with the area. Based on this research, BETA did not identify any sites within the
specified radii.
The search of Federal and State databases identified the Site as a:
Comprehensive Environmental Response, Compensation, and Liability Information
System (CERCLIS) No Further Remediation Action Planned (NFRAP) facility;
State Hazardous Waste Site (SHWS)/Release Site;
Federal Historic Auto Station Site; and,
Historic Federal FIFRA/TSCA Tracking System (FTTS) Site.
The database search identified the Site as King Phillip Mill, at 386 Kilburn Street, Tilly Realty
Bldg 2, at 358 Kilburn Street, and Crown Service Systems, at 909 Dwelly Street. The following
is a summary of the Site’s Federal and State database listings.
King Phillip Mill is identified as a CERCLIS NFRAP facility and potentially responsible
party. The status is identified as Removal Only Site (No Site Assessment Work Needed).
The Removal Assessment was completed on March 5, 2003. On-line records include an
action memorandum that is summarized in Section 6.6 of this report.
King Philip Mill is identified as a state recovered government archives hazardous waste site
(MA RGA HWS) as of 2003.
King Phillip Mill is identified as a FINDS site based on its listing on the CERCLIS listing,
National Compliance Database (NCDB), state Environmental Protection Integrated
Computer System (MA EPICS), and Aerometric Information Retrieval System (AIRS)
listing.
King Philip Mill is identified as a SHWS/Release site. According to the search, the Site was
listed as a known release site on December 12, 2013. The release was reported to MassDEP
and triggered a two hour reporting limit. MassDEP issued Release Tracking Number (RTN)
4-25363. On-line records include several reports that are summarized in section 6.6 of this
report.
King Philip Mill is listed as a US AIRS facility. According to the search, the tenant was a
nonresidential building operator. Air pollutants were not identified in the search.
King Phillip Mill is identified as a state SPILLS site. According to the search, 200 gallons of
an unknown chemical was released in March 2003. According to the search the current
status of the spill is listed as “retracted.”
386 Kilburn Street is identified as a Historical Auto Station facility. According to the search,
Arco Enterprises and Industries Inc. operated at the Site in 2002 and 2003.

King Philip Mill Complex is identified as a federal insecticide, fungicide, and rodenticide
act/toxic substance control act (FIFRA/TSCA) Tracking System (FTTS) facility. According
to the search, a Section 6 PCB investigation was conducted in April 1997 under TSCA. A
historic inspection was also identified in the search, no violations were reported. BETA
could not find a report associated with the investigation.
Tilly Realty Bldg 2 is identified as a SHWS/Release Site. According to the search, the Site
was listed as a known release facility on September 5, 2000. The release was reported to
MassDEP and triggered a two hour reporting limit. MassDEP assigned RTN 4-15725 to the
release. On-line records include several reports that are summarized in Section 6.6 of this
report. A second release was reported on September 6, 2000. The release was reported to
MassDEP and triggered a two hour reporting limit. MassDEP assigned RTN 4-15730 to the
release. On-line records include several reports that are summarized in Section 6.6 of this
report. A release was also reported on September 7, 2000 to MassDEP and triggered a two
hour reporting limit. MassDEP assigned RTN 4-15731 to the release. Previous reports are
summarized in Section 6.6 of this report.
Crown Service Systems is identified as a UST facility. According to the search, a 2500
gallon gasoline UST was removed from the facility in February 1996.
A description of the databases reviewed by BETA and an analysis of sites identified within the
prescribed search distances are presented in the following sections.
8.1 United States Environmental Protection Agency (USEPA) Databases
NPL Facilities
This is a list of the most serious uncontrolled or abandoned hazardous waste sites identified for
possible long-term remedial action under the Comprehensive Environmental Response,
Compensation and Liability Act (CERCLA or “Superfund”). A site must be on the NPL to
receive money from the Trust Fund for Remedial Action. The database search did not identify
NPL facilities within one mile of the Site.
Delisted NPL Facilities
Facilities that the EPA determined may be deleted from the NPL because no further response is
appropriate. The database search did not identify Delisted NPL facilities within ½-mile of the
Site.
CERCLIS Facilities
CERCLIS is the USEPA system for tracking potential hazardous waste sites within the
Superfund program. A site's presence in CERCLIS does not imply a level of federal activity or
progress at a site, nor does it indicate that hazardous conditions necessarily exist at the location.
Within one year of being entered into CERCLIS, the USEPA performs a preliminary assessment

of a site. Based upon the results of the preliminary assessment, the USEPA may conduct
additional investigations which could lead to a site being listed on the NPL. The search did not
identify CERCLIS facilities within ½-mile of the Site.
CERCLIS NFRAP Facilities
CERCLIS sites identified as NFRAP facilities have been removed from the CERCLIS because
these sites may be identified as where no contamination was found, contamination was removed
without the need for the site to be placed on the NPL, or the contamination was not considered
significant enough to be placed on the NPL. The database search identified the Site as a
CERCLIS NFRAP facility. According to the search, the Site was identified as a Removal Only
Site (no assessment work needed). The removal assessment was completed in March 2003.
RCRA CORRACTS Facilities
RCRA CORRACTS is a list of facilities that are found to have had hazardous waste releases and
require RCRA corrective action activity, which can range from site investigations to remediation.
The database search did not identify RCRA CORRACTS facilities within one mile of the Site.
RCRA TSD Facilities
The RCRA TSD Facilities List contains information pertaining to those facilities that either treat,
store, or dispose of hazardous waste. While these facilities represent some form of hazardous
waste activity, they are most significant if determined to be out of compliance or to have
violations. The database search did not identify RCRA TSD facilities within ½-mile of the Site.
RCRA Generator Facilities
BETA reviewed the list of sites which have filed notification with the USEPA in accordance
with RCRA requirements. These sites include generators of hazardous waste regulated under
RCRA. Under RCRA, hazardous waste generators are classified by the mass of hazardous waste
generated in a calendar month into the following categories: Large Quantity Generator, greater
than 1,000 kilograms/month (Kg/month); Small Quantity Generator, 100 to 1,000 Kg/month; and
Conditionally-Exempt Small Quantity Generator, less than 100 Kg/month. RCRA Generators,
while they represent some form of hazardous waste activity, are most significant if they are
determined to have Class I Violations or to be non-compliant. The database search identified
seven RCRA generators within a ¼-mile radius of the Site.
According to the search, American Dryer Corp. at 394 Kilburn Street is located approximately
22 feet southwest of the Site. The search indicates that the facility is a Conditionally-Exempt
Small Quantity Generator (CESQG). The search indicates that the facility received three
violations in October 1990. The search indicates that the facility achieved compliance in January
and February 1991. Based on its distance, this facility could pose a threat of release of OHM to
the Site.
According to the search, the Massachusetts National Guard Armory is located at 1089 Dwelly
Street, approximately 692 feet northeast of the Site. The search indicates that the National Guard

has been a Small Quantity Generator (SQG) since January 1959 and no violations have been
reported. The search indicates that the facility generates spent halogenated solvents and non-
halogenated solvents, waste oil, polychlorinated biphenyl (PCB) waste, and reactive, corrosive,
and ignitable wastes. Based on its distance, this facility could pose a threat of release of OHM to
the Site.
According to the search, Rite Aid at 1533 South Main Street is located approximately 875 feet
northwest of the Site. The search indicates that the facility has been a SQG since August 2007.
The search indicates that hazardous wastes generated at the facility include chromium, mercury,
salts, m-cresol, and selenium. Based on its distance, this facility does not likely pose a threat of
release of OHM to the Site.
According to the search, Ken’s Auto Repair at 1144R Dwelly Street is located approximately
963 feet east of the Site. The search indicates that the facility is a CESQG and no violations have
been reported since August 1988. Based on its distance, this facility does not likely pose a threat
of release of OHM to the Site.
According to the search, Nu Way Auto Body at 67 Kay Street is located approximately 1,172
feet southwest of the Site. The search indicates that the facility is a CESQG and no violations
have been reported. According to the search, Skyward Automotive is listed as a historical
generator at this address. The search indicates the facility was a CESQG and no violations were
reported. Based on its distance, this facility does not pose a threat of release of OHM to the Site.
RCRA NonGen/NLR Facilities
The RCRA NonGen/NLR is a list of facilities that do not presently generate hazardous waste
under RCRA. According to the search, Fall River Fireplace Co Inc. at 915 Dwelly Street is
located approximately 30 feet north-northeast of the Site. The search indicates that the facility
does not presently generate hazardous waste. Former hazardous waste generated at the facility
included spent halogenated solvents used in degreasing and non-halogenated solvents. The
facility received a written informal violation in 1985 and a follow up inspection was conducted
in 1986, no further information was provided. Based on its distance and regulatory status, this
facility could pose a threat of release of OHM to the Site.
IC/EC Registries
The database search did not identify the Site or surrounding properties on the IC/EC registries.
Brownfield Facilities
The database search did not identify Brownfields facilities within ½-mile of the Site.
ERNS Facility
The ERNS is a database of notifications of oil discharges and hazardous substance releases. The
primary purpose of ERNS is to standardize and collect notifications made to the Federal
government of releases of oil and hazardous substances. These notifications are used by “On-

Scene Coordinators” to determine an emergency response and release prevention. When a call is
made to the National Response Center or one (1) of the ten USEPA Regions, a report is created
containing all of the release information that the caller provided. This report is transferred to an
appropriate agency to evaluate the need for a response and the records are electronically
transferred to the ERNS database. As such, if a reported release of oil or a hazardous substance is
deemed to require a response, it should also be listed in the appropriate federal or state level
environmental database such as CERCLIS, state equivalent CERCLIS, or state leaking
underground storage tank or spills. The database search did not identify the Site on the ERNS
database.

8.2 Massachusetts Department of Environmental Protection (MassDEP) Databases
State SHWS Facilities
The SHWS list is an inventory of hazardous waste release sites maintained by the MassDEP. The
search identified the Site as a SHWS facility. Information on the site listing has been
summarized in Section 6.6 of this report. Other than the Site, the database search identified three
SHWS facilities within a ¼-mile of the Site. Based on their distances and regulatory status, these
facilities do not likely pose a threat of release of OHM to the Site.
SWL Facilities
The database search did not identify SWL facilities within ½-mile of the Site.
Registered UST Facilities
The database search identified ten UST facilities within ¼-mile of the Site. According to the
search, Roger Lauzon Contractor at 969 Charles Street is located approximately 293 feet
southwest of the Site. The search indicates that two UST’s have been removed from the facility.
According to the search, Swansea Concrete Corp. at 245 Tripp Street is located approximately
355 feet southwest of the Site. The search indicates that the facility has removed four USTs.
According to the search, Field Maintenance Shop at 1089 Dwelly Street is located approximately
692 feet northeast of the Site. The search indicates that the facility has removed two USTs.
Registered AST Facilities
The database search identified one AST facility within ¼-mile of the Site. According to the
search, Field Maintenance Shop at 1089 Dwelly Street is located approximately 692 feet
northeast of the Site. The search indicates that a 5,000 gallon JP-8 jet fuel AST and 396 gallon
waste oil AST are currently in use at the facility.
Registered Hazardous Waste Generator Facilities
The database search identified 14 hazardous waste generator facilities within ¼-mile of the Site.
Based on the distances and regulatory status of these facilities, three facilities pose a threat of
release of OHM to the Site. According to the search, Korber Hats at 394 Kilburn Street is located
approximately 22 feet southwest of the Site. The search indicates that the facility is a small
quantity generator and no further information is provided. Based on its distance and regulatory
status, this facility could pose a threat of release of OHM to the Site.

The database search did not identify VCP facilities within ½-mile of the Site.
Brownfields Facilities
The database search did not identify Brownfield facilities within ½-mile of the Site.
8.3 Local Regulatory Agency Interviews
Fire Department - Fire Prevention Office BETA submitted a written request to the Fall River Fire Department to inquire about current and
historical Site conditions, including current or former USTs, ASTs, hazardous materials spills or
hazardous materials or wastes used or stored on a property. The following summarizes the
provided information:
February 15, 1996, a 3,000 gallon gasoline UST was removed from the Site by Frank
Corporation. The tank was disposed at MID-CITY Scrap Iron and Salvage Co. The tank
was located at Mill #4. Records did not provide location aid for the tank and did not
indicate whether sampling occurred.
September 26, 2000, an application to install and construct a 20,000 gallon AST for No. 6
fuel oil storage was accepted by the State Fire Marshal’s office.
October 27, 2000, the City Council granted a license to store 20,000 gallons of No. 6 fuel
oil to Tilly Realty Associates.

Building Department
BETA visited the Fall River Building Department to inquire about permits or licenses for the
Site. The Fall River Building Department did not have environmental records for the Site.
However, records indicate the building of an electrical substation in 1931.
Board of Health Department
Persons at the Board of Health stated they did not have records pertaining to the Site and did not
maintain UST or OHM permits. Additionally, persons at the Board of Health told BETA to
contact the Fall River Fire Department regarding UST and OHM permits.
Assessor’s Office
A review of the Assessor’s field card did not identify any environmental liens with respect to the
Site.
City Clerk’s Office
The Fall River City Clerk’s office stated that they maintain current OHM permits. A permit for
the storage of 20,000 gallons of No.6 fuel oil was issued to the City of Fall River (custodian of
the Site) and dated October 27, 2000.
Conservation Commission
BETA visited the Fall River Conservation Commission to inquire about regulated wetlands at the
Site. Persons at the Conservation Commission stated they did not have records pertaining to
regulated wetlands at the Site.
Engineering Department
Mr. Byron Holmes of the Fall River Engineering Department was the Site contact and provided
BETA access to the Site.

9. Evaluation
BETA performed a Phase I ESA in conformance with the scope and limitations of ASTM
Practice E1527-13 for the property at 386 Kilburn Street in Fall River, Massachusetts. Any
exceptions to, or deletions from, this practice are described in Section 2.2 of this report and
Appendix A.
9.1 Findings
The following summarizes the findings of this Phase I ESA:
Site History
According to the historical resources reviewed for this Phase I ESA, the Site was developed from
as early as 1883. The Site buildings were constructed circa 1883 and 1890. King Philip Mills
occupied the Site buildings from construction in 1883 until circa 1974. Former operations at
King Philip Mills include use as a cotton textile mill. Various tenants occupied the Site circa
1974 until circa 2012, the Site was leased to several businesses during this period. Uses of the
Site included operation as a textile mill, woodworking shop, a learning center, and a small body
engine repair shop. The Site was acquired by the City of Fall River in June 2014 due to a decree
of foreclosure.
Site Reconnaissance
Ten buildings, an oil storage vault, and a smoke stack improve the Site. The buildings are
constructed of concrete slab foundations, wooden frames with granite block exterior walls, and
slightly pitched tar and gravel roof. The remainder of the Site includes paved areas surrounding
the buildings and minimal grassed areas in the central portion of the Site. The perimeter of the
Site is fenced off and padlocked at the access points.
BETA observed eleven transformers throughout the Site buildings and numerous light fixtures.
Transformers were located south of the transformer house in a fenced area and could not be
accessed. Mr. Gallagher stated that two transformers were located on the Mill #1 roof and
connected. Interior observations of the Site buildings revealed solid waste and debris throughout
the buildings. Computer monitors, printers, televisions, and furniture were noticed throughout
the Site buildings. Evidence of the EPA removal action was observed in the basement of Mill #1.
BETA also observed empty drums and drum covers throughout the interior of Mill #1.
Stained pavement was observed at the Site, east of Mill #1. Staining appeared to be from a paint
spill. BETA did not observe any significant cracks in the paved areas of the Site. Building debris
from a former office building that burned down in 2012 is located west of Mill #1.
Apparent stressed vegetation was observed in the central portion of the Site west of Mill #1 and
south of the boiler house. These areas are close to the building foundations. According to
previous reports, this area is where contaminated soil was removed from the Site.

During the site reconnaissance, Mr. Gallagher stated there could be an interior underdrain system
in the buildings, but was unsure. A drainage channel was observed along the eastern exterior
portion of the Site flowing in a southeast direction toward Cook Pond.
BETA observed flaking and peeling paint throughout the Site buildings. Since the buildings were
constructed in the late 1800’s, it is likely that LBP is present.
During the site reconnaissance, Mr. Gallagher voiced concern of ACM on tanks located on the
first floor of Mill #4, formerly occupied by Crown Linen. Since the Site buildings were
constructed circa 1883, it is likely that building materials would be classified as ACM.
Interviews
Mr. Chris Gallagher, the Site contact, stated that 100 barrels were removed from the Site
buildings during the EPA removal action. Mr. Gallagher stated that two transformers were
located on the roof of the Site building and were still connected with telephone capabilities. He
stated that floors one and two of the Site buildings were safe, but to proceed with caution. He
stated that floors three and four of the Site buildings were unsafe. Mr. Gallagher also stated that
the loading dock on the third floor between Mill #1 and Mill #2 contained a lot of miscellaneous
items, but was unsafe.
Adjacent and Surrounding Properties
The Site is located at 386 Kilburn Street, a mixed use area of Fall River. From as early as 1939,
surrounding properties appear to be similar in footprint to the current surrounding properties.
Properties to the south are zoned commercial. Dwelly Street and residential properties are
located to the north. Cook Pond is located immediately east of the Site. Properties west of the
Site are zoned commercial/residential.

conditions found at the Site during these investigations:

In 2000, a release of paint and wax compounds impacted the Site. The release was
limited to the asphalt surface and the paint and wax compounds were non-hazardous.
In April 2000, the closure-in-place of a 10,000 gallon No. 6 fuel oil UST occurred at the
Site. The UST was located in the courtyard east of Mill #1, 20 feet north of the smoke
stack.
In May 2000, a release of No. 6 fuel oil occurred in the boiler room. The release was
limited to the utility trenches and concrete floor of the building, therefore a reportable
condition was not present.
In November 2000, a release of oil and/or other hazardous material was released at the
Site. During the excavation of an exploratory test pit No. 6 fuel oil was found. BETA
oversaw the excavation of approximately 52.5 yd3 of soil and 1,050 gallons of
contaminated water from the excavation.
In September 2001, a subsurface investigation at the Site identified NAPL in a
groundwater monitoring well. Soil samples from four borings exceeded the Method 1
Risk Characterization standard.
In 2006, impacted soil was excavated in the vicinity of the well where the NAPL was
encountered. Approximately 33.39 tons of impacted soil was removed from the Site.
In April 2000, BETA oversaw the closure-in-place of the 10,000 gallon No. 6 fuel oil
UST east of Mill #1, 20 feet north of the smoke stack.
In May 2000, a release of No. 6 fuel oil was released in the boiler room. The release was
not reportable and contained within concrete utility trenches and the concrete floor.
BETA records indicated the closure-in–place of a 10,000 gallon No. 6 fuel oil UST east
of Mill #1, 20 feet north of the smoke stack.
EPA Removal Action
BETA reviewed the following documents related to the U.S. Environmental Protection Agency’s
(EPA’s) removal action taken at the Site in 2014.
December 14, 2014 “Pollution/Situation Report” by EPA
Online summary by EPA
EPA initiated the removal action due to the presence of potentially hazardous substances and
several 55 gallon drums in the buildings. Samples submitted to Alpha and New England
Regional Laboratory indicated ignitable and corrosive substances in the 55 gallon drums.
Sampling for asbestos containing material indicated chrysotile asbestos in one of the samples at
the maximum concentration. EPA on-line information indicates that from August 2014 to
November 2014, remedial actions included removal of drums and household hazardous waste
from the Site. In November 2014 Tradebe Environmental Services removed small containers of
corrosive wastes from the Site. The removal action was completed on November 14, 2014.
MassDEP assigned RTN 4-25363 to the release. MassDEP’s website lists this RTN as “Tier 1D”
indicating that this RTN is not incompliance with MassDEP regulations.

Petroleum Storage Tanks
The following summarizes petroleum storage at the Site based on the site reconnaissance,
database search, municipal records, and previous reports:
An AST is located in the central portion of the Site, east of the boiler house. Records indicate that a 20,000 gallon No. 6 fuel oil tank was installed at the Site in October 2000.
BETA observed a vaulted oil storage structure south of the smoke stack. Records indicate
that the oil storage structure contains two 10,000 gallon ASTs containing No.6 fuel oil.
Previous reports indicate two 10,000 gallon No. 6 fuel oil USTs were removed from the area east of the boiler house.
Fall River records indicate that a 3,000 gallon gasoline UST was removed in the area of Mill #4 in February 1996, no location aid was given
BETA records indicate the closure-in-place of a 10,000 gallon No. 6 fuel oil UST in April 2000, the UST was located east of Mill #1, 20 feet north of the smoke stack.
Sanborn maps indicate the presence of an oil tank south of the boiler house in the courtyard area
BETA observed vent and fill pipes on the northwest exterior of Mill #4, however BETA
could not access the interior portion of the building to identify the existence of a tank in that area.
Database Search
The search of environmental databases identified the Site as a Comprehensive Environmental
Response, Compensation, and Liability Information System (CERCLIS) No Further
Remediation Action Planned (NFRAP) facility, State Hazardous Waste Site (SHWS)/Release
Site, a Historic Federal FIFRA/TSCA Tracking System (FTTS) Site, US AIRS site, state SPILLS
site, federal insecticide, fungicide, and rodenticide act/toxic substance control act
(FIFRA/TSCA) Tracking System (FTTS) facility, and a Federal Historic Auto Station Site. The
search identified the Site in different listings: King Philip Mills, King Philip Mills Complex, and
386 Kilburn Street. All were located at 386 Kilburn Street. Section 8.0 contains detailed
information on these listings which include the EPA removal actions and MassDEP release.
The database search did not identify any properties in the Site vicinity that pose a threat of
release to the Site.
Municipal Information
The City of Fall River Fire Department provided UST records for the Site.
9.2 Data Gaps
The following summarizes data gaps pursuant to ASTM E1527-13 in this Phase I ESA:

The inability to interview a former Site owner or representative of the former Site tenant
(Five Kings Associates) with respect to the past operations of the Site;
Although BETA was able to access the first floor of Mill #4, the basement was flooded due
to a water main break, and Mr. Gallagher informed us that the second and third floors were
structurally unsafe and were not accessed;
The fourth and fifth floors of Mill #1 and Mill #2 were accessible and photographs were
taken, however, Mr. Gallagher informed us that they were structurally unstable, therefore
the entire area could not be observed;
The inability to access the vaulted oil storage building south of the smoke stack;
The inability to access the auto house on the southern portion of the Site, east of Mill #1;
The inability to access the 20,000 gallon No. 6 fuel oil storage east of the boiler house;
The inability to access the transformer house located between Mill #2 and Mill #4;
The inability to access the fenced area south of the transformer house;
The inability to find a report related to the Section 6 PCB investigation under TSCA in
1996. The Section 6 PCB investigation was listed in the database search;
A monitoring well was observed on the loading dock ramp east of Mill #4. BETA was
unable to find a report related to the monitoring well; and,
BETA observed vent and fill pipes for a possible petroleum storage tank at Mill #4. The
pipes were located on the northwest part of the building and located on the exterior of the
building, however, BETA could not access the interior of the building where the pipes were
located;
These data gaps have affected our ability to assess the Site; however, the assessment has identified
RECs that may include some of these gaps. BETA did not identify other data gaps that would affect
our ability to identify RECs at the Site.

9.3 Conclusions
BETA performed a Phase I ESA in conformance with the scope and limitations of ASTM
Practice E1527-13 for the property at 386 Kilburn Street in Fall River, Massachusetts. Any
exceptions to, or deletions from, this practice are described in Section 2.2 of this report and
Appendix A. This assessment has identified the following recognized environmental conditions
in connection to the property:
Historic industrial use of the Site by tenants that conducted auto repair, iron works,
textiles, millwork, and laundry and linen services.
Sanborn maps indicate the presence of an oil tank in the courtyard area east of Mill #1.
The closure-in-place of a 10,000 gallon No. 6 fuel oil UST east of Mill #1, 20 feet north
of the smoke stack.
The documented historic presence of petroleum hydrocarbons in soil at the Site.
Although previous investigations have removed impacted soil from the Site, historic data
indicates the potential for additional contaminated soil to exist at the Site.
Previous reports indicate the former presence of two 10,000 gallon No. 6 fuel oil USTs
east of the boiler house.
RTN 4-25363 associated with the EPA removal action is classified as “Tier 1D” by
MassDEP and is out of compliance.
Debris from the office building that burned down in 2012 can contain possible OHM.
City of Fall River municipal records indicate the removal of a 3,000 gasoline UST from
the area of Mill #4. Sampling information from the removal was not included in the
record and location aid of the UST was not given.
The presence of a 20,000 gallon AST located east of the boiler house.
The two vaulted 10,000 gallon No. 6 fuel oil ASTs located south of the smoke stack in
the central portion of the Site.
The presence of vent and fill pipes on the exterior of Mill #4 leading into the building.
The pipes were located on the northwestern portion of the building, however no storage
tank was observed during the site reconnaissance.
Past uses of the Site that include the storage of hazardous material and No. 6 fuel oil.
Although the EPA conducted a removal action within the Site building, solid waste and
debris remain throughout the Site buildings

The observation of stressed vegetation and stained asphalt at the Site.
The presence of several transformers throughout the Site buildings. Based on the age of
the Site buildings the transformers likely contain PCBs. The presence of a transformer
house built circa 1931 indicates the possible presence of PCBs.
Although the EPA conducted a removal action at the Site, EPA identified the presence of
asbestos containing material (ACM), corrosive and ignitable wastes, and general wastes
at the Site indicating the potential for additional ACM and waste to exist at the Site.
The observation of flaking and peeling paint throughout the Site buildings. Since the
buildings were constructed in the late 1800’s, it is likely that LBP is present.

9.4 Recommendations
The RTN associated with the EPA Removal Action is still open. Actions should be taken to
bring the Site back into compliance with MassDEP regulations.
Based on the identified RECs, BETA recommends conducting a subsurface investigation at the
Site. This investigation should include:
Advancement of soil borings. The borings should be advanced at areas of concern based
on the RECs
Installation of monitoring wells in similar locations as the former monitoring wells and in
other suspect areas
Soil and groundwater samples should be submitted for laboratory analysis of volatile
organic compounds (VOCs), semi-volatile organic compounds, extractable petroleum
hydrocarbons (EPH), volatile petroleum hydrocarbons (VPH), polychlorinated biphenyls,
and metals.
BETA also recommends a hazardous building material investigation (HBMI) to identify building
materials (equipment, building components, residue, dust, etc.) that may contain hazardous
materials. The HBMI should include an assessment of building surfaces and the existing concrete
floor to determine if hazardous materials and/or wastes are remaining on the building surfaces.
BETA recommends further site inspection, if possible, to reduce data gaps due to access
restrictions to the Site.
9.5 Environmental Professional Certification
The following provides the certifications required by the ASTM 1527-13 standard. “I declare
that, to the best of my professional knowledge and belief, I meet the definition of Environmental
professional as defined in §312.10 of 40 CFR 312”. “I have the specific qualifications based on
educations, training, and experience to assess a property of the nature, history, and setting of the
subject property. I have developed and performed all appropriate inquiries in conformance with
the standards and practices set forth in 40 CFR Part 312”. Appendix F contains a resume of my
qualifications.

This report has been prepared for the sole and exclusive use of the Client and is subject to and issued in connection with the Agreement and the provisions thereof. Any use or reliance upon information provided in this report, without the specific written authorization of Client and BETA, shall be at the User’s sole risk.
In conducting this assessment and investigation, BETA has obtained and relied upon information from multiple sources to form certain conclusions regarding potential environmental issues at and in the vicinity of the subject property. Except as otherwise noted, no attempt has been made to verify the accuracy or completeness of such information.
The objectives of the assessment and investigation described in this report were to assess the physical characteristics of the subject property with respect to overt evidence of past or present use, storage, and/or disposal of oil or hazardous materials, as defined in applicable state and federal environmental laws and regulations, and to gather information regarding current and past operations and environmental conditions at and in the vicinity of the subject property.
The scope of this report does not include an assessment of the suitability of Site soil for development/construction. Please note that certain soils, particularly in urban areas, may include low levels of contaminants such as lead, metals, or ash constituents. The presence of such contaminants in soil, while not representing a “release,” may result in the need for special handling at increased costs to allow for off Site soil reuse during Site development.
No attempt has been made to assess the compliance status of any past or present Owner or Operator of the Site with any federal, state, or local laws or regulations.
The findings, observations, and conclusions presented in this report are limited by the scope of services outlined in our Agreement, which reflects schedule and budgetary constraints imposed by Client for the current phase of environmental assessment. Furthermore, the assessment has been performed in accordance with generally accepted engineering practices and standards set forth in ASTM E 1527-13. No other warranty, expressed or implied, is made.
The assessment presented in this report is based solely upon: readily-available data, visible portions of the Site, and information gathered to date. Should further environmental or other relevant information be developed at a later date, Client should bring the information to the attention of BETA as soon as possible. Based upon an evaluation, BETA may modify the report and its conclusions.
It should be noted that the Executive Summary does not contain all the information that is found in the full report. The report should be read in its entirety to obtain a more complete understanding of the information provided and to aid in any decisions made or actions taken based on this information. This report documents the recognized environmental conditions as defined in ASTM and where appropriate other suspect environmental conditions noted on the Site and associated risks to the environment. Although the survey may not disclose all potential liabilities, a reasonable attempt has been made to do so within the scope of work.
BETA cannot and does not warrant or guarantee that the information provided by these sources is accurate or complete. The methodologies of this assessment are not intended to produce all inclusive or comprehensive results, but rather to provide the client with information regarding overt evidence of past use storage, and/or release or threat of release of OHM the Site.
