Alternatives Considered and Rejected: An alternative option is to undertake tender processes as set out in the Council’s Contract Procedure Rules. This option would delay completion of the project and contribution to delivery of the Corporate Plan’s Five Promises and strategic objectives which are:

APPEAL NOTIFICATION LAND AT: Mountain Ash London Road Billericay PROPOSED DEVELOPMENT: Extend existing detached garage and convert
into habitable accommodation APPLICATION REFERENCE: 14/00407/FULL PINS NO.: D/14/2222092 APPELLANT'S NAME: Mrs A Hill An appeal has been made to the Secretary of State in respect of the above site. The appeal follows the refusal of planning permission by the Council, for the following reasons: The application site is in the Green Belt. At national level planning guidance for local planning authorities is comprised in the National Planning Policy Framework which states that planning law requires that applications for planning permission must be determined in accordance with the development plan, unless material considerations indicate otherwise. The National Planning Policy Framework is a material consideration in planning decisions. The NPPF states that the Government attaches great importance Green Belts. The fundamental aim of Green Belt policy is to prevent urban sprawl by keeping land permanently open. The essential characteristics of Green Belts are their openness and their permanence. As with previous Green Belt policy, inappropriate development is, by definition, harmful to the Green Belt and should not be approved except in very special circumstances. When considering any planning application, local planning authorities should ensure that substantial weight is given to any harm to the Green Belt and 'very special circumstances' will not exist unless the potential harm to the Green Belt by reason of inappropriateness, and any other harm, is clearly outweighed by other considerations. Paragraph 89 of the National Planning Policy Framework states that a Local Planning Authority shall regard the construction of new buildings as inappropriate in the Green Belt. Exceptions to this are buildings for agriculture and forestry, outdoor sports and recreation facilities and cemeteries as long as they preserve

the openness of the Green Belt, extensions and alterations to existing buildings, replacement of existing buildings, limited infilling in villages and limited infilling or redevelopment of previously developed sites. The current proposal does not fall within one of these exceptions. The boundaries of the Green Belt within the Borough are set out on the Proposals Map accompanying the Basildon District Local Plan saved policies document. In this case the proposed development would constitute inappropriate development within the Green Belt, and would result in harm to the open, spacious and rural character of the area. The 'very special circumstances' have been demonstrated but does not clearly outweigh the harm to the Green Belt, and the proposal would be contrary to the objectives of the National Planning Policy Framework.
