PART I. GENERAL

Section 1. Scope of Services 1.1 This contract covers the rehabilitation of existing sanitary and combined sewers by lining using the following

approved process: Cured-in-place pipe (CIPP) and/or grout-in-place lining systems such as Sekisui SPR or Danby Pipe Renovation System. Specific liner products and installers shall be approved by the Metropolitan Sewer District of Greater Cincinnati (MSD) Trenchless Technology Committee. A list of the approved CIPP products is presented in Part I, Section 6.

The primary contract objective is the structural and hydraulic renewal of the existing sewer main. This specification pertains to the rehabilitation of main line sewers and lateral connections where applicable. The project is composed of approximately 69,126 feet of 8” to 108” sanitary and combined sewers. See the Master Location Data Sheet for lining locations, pipe section data and required liner thicknesses. A Project Summary is provided which breaks down the contract footage; number of taps, repairs, and priority segments by pipe diameter and location. This contract includes work pertaining to the Cincinnati Streetcar Project and has been designated so in the Master Location Data Sheet. Work in this area shall be considered a priority and scheduled accordingly. Milestone dates for Streetcar work are as follows:

The contractor shall begin construction within 14 days of issuance of the Notice to Proceed and complete all work no later than December 31st, 2013. The contractor shall provide sufficient resources to work at a steady pace for the duration of this contract to prevent overburdening MSD’s project management and field inspection resources. In conjunction with rehabilitating the sewer sections and related appurtenances specified in this project, the contractor shall excavate and repair sewer mains as necessary or specified, clean and televise sewers, reconnect existing sewer service connections, and provide all submittals required by this specification. Television inspection includes televising immediately before lining, televising after lining, televising after making repairs to correct liner defects, and televising after rehabilitating lateral connections. Requirements pertaining to these activities are presented in greater detail in the upcoming sections. On an as needed basis, the contractor shall rehabilitate lateral connections using a T-Liner design, structural grout, or other approved method to repair broken, recessed, or protruding laterals. A predetermined, lump sum amount of seventy thousand dollars ($70,000.00) is included in the list of bid items to cover associated costs. The quantities and locations cannot be determined prior to bid. The post-lining tape is the source from which the lateral seal locations will be selected. When it is determined that a lateral must be repaired with a lateral seal, MSD will review the entire segment for other lateral seal applications in an attempt to minimize the mobilization/demobilization costs. The MSD Project Manager shall select the locations after the main sewer is lined. MSD reserves the right to perform or not perform work under this item based on the actual costs proposed by the contractor during the course of the contract. No work shall be performed under this bid item without prior written approval from the MSD project manager. A predetermined, lump sum amount of twenty-five thousand dollars ($25,000.00) is included in the list of bid items to cover the cost of street opening/excavation permits that may be required for the contractor to perform excavation work in the public right-of-way (see Part III, Section 1). MSD will reimburse the contractor for actual street opening/excavation permit fees charged by the various municipalities. No markup will be paid for permits. Equipment use permits are incidental to the contract. Award of the contract will be determined through an evaluation of bids and made in light of the best interest of MSD.

1.2 The contractor shall furnish all labor, components, materials, tools, and appurtenances necessary for the

performance and completion of the contract. Copies of all internal pipe inspection videos, reports and project maps are included in the bid documents. This is considered by MSD to be the best available information; however, there are occasional inaccuracies and errors. As such, the contractor shall bear the ultimate responsibility for verifying actual field conditions and reporting any discrepancies to the MSD Project Manager prior to bid and construction. Change orders will not be issued during construction based solely on inaccurate information in the bid documents.

1.3 The contractor shall be held fully liable for any damages incurred during the installation of liners that are

caused by its negligence or the negligence of its subcontractor(s). The contractor shall hold harmless the City of Cincinnati and the Hamilton County Board of County Commissioners and all its representatives from all suits, actions, of claims of any character brought on account of any injuries or damages sustained by any person or persons or property in the performance of this contract.

1.4 Priority List. The Priority List identifies sewer locations that require lining within 60 days of the contractor

receiving notice to proceed. The contractor is permitted to line other segments before the priority lines but must still meet the 60-day deadline. If the priority segments are not lined within the 60-day deadline, then the contractor will not be permitted to continue lining non-priority segments until the priority list is complete. The priority segments can be found in the Master Location Data Sheet. Not applicable to the 2012 Lining Contract.

1.5 Patents, Trade Secrets and Copyrights. The contractor shall pay all license fees and royalties and assume

all costs incidental to the use in the performance of the work or the incorporation in the work of any invention, design, process, product or device which is the subject of patent rights, trade secrets protection rights, or copyrights held by others. The contractor shall indemnify and hold harmless the owner and engineer and anyone directly or indirectly employed by either of them from and against all claims, damages, losses and expenses (including attorney’s fees and court and arbitration costs) arising out of any infringement of patent rights, trade secret protection rights, or copyrights incident to the use in the performance of the work or resulting from the incorporation in the work of any invention, design, process, product or device not specified in the contract documents, and shall defend all such claims in connection with any alleged infringement of such rights.

1.6 The contractor shall procure any steel, iron or manufactured products in compliance with 49 U.S.C. § 5323(j)

and FTA regulations, “Buy America Requirements,” 49 C.F.R. Part 661, and any amendments thereto.

Section 2. Project Contacts All correspondence and questions should be directed to Mr. Donald Cahill, Procurement Supervisor, at [email protected] by the established deadline. The deadline for questions is 1:30 PM local time on December 27, 2012. The contractor shall provide a dedicated local Project Manager to this contract. This person shall be responsible for coordination, scheduling, obtaining permits, site investigation, notifications, etc. It is the intention of this requirement to keep the contract moving efficiently. This person shall act as the point of contact for the MSD Project Engineer and Project Manager. All contact info for this person, including mailing address, email, phone, fax, cell, shall be provided to MSD at the Pre-Construction meeting.

Section 3. Liquidated Damages If the Contractor fails to meet Milestone dates set forth in Part I, Section 1 of the Detailed Provisions, MSD reserves the right to collect liquidated damages based on the table below.

Section 4. Compliance and Acceptance (Sewer Rehabilitation and Lateral Sealing Only) 4.1 Compliance with this contract shall be complete when all conditions set forth in these specifications have

been met, including but not limited to the following:

• The finished liner shall be continuous over the entire length of the manhole-to-manhole section. • The finished liner shall conform to the walls around the circumference of the existing (host) sewer main. • No longitudinal or circumferential shrinkage between the finished liner and the existing (host) sewer main

shall be visible at the manholes, sewer service connections, or other exposed points within the finished lined section.

• The finished liner shall be homogeneous throughout and free of any blemishes, wrinkles, ribs, protrusions, holes, visible cracks, foreign material, blisters, or other deleterious faults or any other defects, which shall affect the liner's structural integrity, strength, hydraulic performance, future maintenance access, and overall performance.

4.2 Completed point repairs shall have no offsets, open joints, bellies, deposits, protrusions, or defects that may

result in the liner failing to meet final acceptance criteria. 4.3 Completed lateral seals shall have no defects that may result in the liner failing to meet final acceptance

criteria as described Part I, Section 4.1. The lateral seal shall yield a surface conformal with the sewer wall and the lateral connection wall.

4.4 Defects in the finished liner, which will affect the liner's structural integrity, strength, hydraulic performance,

future maintenance access, and overall line performance, shall be repaired or the sewer replaced at the contractor's expense. Any lined section or segment (from manhole to manhole) exhibiting these defects shall be held for payment until such time repairs have been made to the defective liner (see Part VII, Section 1). Suggested methods of repair to resolve common defects are presented below in Table A. Note that this list is not all inclusive and the final repair method shall be approved at the MSD Project Engineer’s discretion on a case-by-case basis depending on actual site conditions.

In situations where a liner defect does not affect structural integrity, reduce capacity, impede flow or create other long-term operational and maintenance issues, the contractor shall not be required to make repairs or incur other penalties if the defect was not caused by the contractor’s negligence or unacceptable work methods. The contractor shall bear full responsibility for providing adequate evidence that the defect was not caused by its own negligence or unacceptable work methods. If any such defects are determined to be caused by the contractor’s negligence, the MSD Project Engineer may assess a deduction to the total payment for the lined section and/or require an increase in the warranty period for the lined pipe section in lieu of requiring a repair. The amount of any deductions incurred on this contract will be determined on a

case-by-case basis by taking into account the quantity and severity of the defect(s). The maximum deduction for any given pipe section shall be limited to 25% of the total liner and service lateral reinstatement cost and shall not include line item amounts for cleaning and excavation point repairs. Defects that are deemed by the MSD Project Engineer to create the potential for long-term operational and maintenance issues shall be repaired by the contractor, regardless of the presence or absence of negligence, at the contractor’s expense.

When the contractor and MSD do not agree that the defect will cause long-term operational and maintenance issues and/or on a repair method, the contractor may request that the issue be sent to an MSD-selected independent engineering firm with experience in CIPP lining and trenchless technologies. If this situation arises, MSD will accept the ruling of the independent engineering firm as final. Any and all fees due to the independent engineering firm for this professional service will be paid by the contractor regardless of the ruling of the independent engineering firm.

NOTES: 1. Grout shall be a structural system that is either robotically-applied or hand-applied as conditions dictate. 2. Point liner must be an approved product by the MSD. 3. This will be determined based on the bid tape and the pre-lining tape. MSD will also research its databases to ensure that no other

private or public entity has been in the sewer from the point of the bid tape to the notice of the defect. 4. Deduct will be in the amount of $500/each bulkheaded tap that is reinstated. 5. Deduct will be in the amount of $100/each hole.

4.5 The contractor shall at no time install a liner that does not meet the required thickness specified in the Master Location Data Sheet. The minimum final cured wall thickness of the liner shall be within 10 percent of the required thickness specified in the Master Location Data Sheet. The thickness of the liner will be determined by samples (see Part VI, Section 1). If the liner thickness exceeds the 10 percent allowance, for every 1 percent decrease in thickness (past the 10 percent allowance) the contractor will be penalized 5 percent of the cost of all work at that specific lining location. If the contractor’s liner thickness is less than 87.5 percent of the specified design thickness, MSD reserves the right to instruct the contractor to remove the liner and replace it at the contractor’s expense. It is the responsibility of the contractor to consider site conditions and their installation process in order to determine the thickness to install. If the contractor determines a particular liner cannot be installed due to the designed thickness, the contractor shall notify the MSD Project Manager prior to attempting installation of the liner. Pipe conditions may change from the time of bid; therefore, the contractor shall notify the MSD Project Manager if the existing pipe has deteriorated from the condition documented on the bid tapes so that the design thickness can be changed. MSD determines changes in pipe condition by comparing the bid tape video or a more recent video if one is available to the video(s) of the segment taken by the contractor prior to lining.

4.6 Prior to lining, the contractor shall verify manhole depths, section lengths, diameters, slopes and other pertinent information in the field. MSD uses recent TV Inspection Reports, ArcView GIS, and old drawings to

provide this information to the contractor. MSD may field verify data that appears questionable; however, the contractor is ultimately responsible for confirming all site information.

Section 5. Referenced Documents All work shall also conform to the latest edition of the following specifications:

• MSD Rules and Regulations and Standard Drawings • City of Cincinnati Supplement (City Supplement) to the State of Ohio Department of Transportation,

Construction and Material Specification • State of Ohio Department of Transportation, Construction and Material Specification • American Society for Testing and Materials (ASTM). These shall pertain to product material, installation,

testing, final acceptance, etc. as applicable. • Rules and Regulations of the Office of the County Engineer

If there are discrepancies in these specifications, the MSD Rules and Regulations shall govern, thence the City Supplement, and then the ODOT Specification.

Section 6. CIPP Installers and Approved Lining Products for Mainline Sewer Rehabilitation All bidders, as defined by Section 321-1-B2 and Section 320-1-B1 of the Cincinnati Municipal Code, before being awarded a contract for this MSDGC capital project, shall affirm to that they possess adequate skill and training to install the following approved cured-in-place pipe (CIPP) products: Insituform®

National Liner®

The above three CIPP products have been approved by the MSD Trenchless Technology Committee. Additionally, there are currently two approved Grout-in-place products: Sekisui SPR®

Danby Pipe Renov®

Grout-in-place installers must be certified and/or approved by the respective manufacturer. Only minor product changes as approved by the MSDGC Trenchless Technology Committee will be considered by the MSDGC Project Engineer for widespread use on this contract. If minor changes are approved, the MSDGC Project Engineer shall have the sole discretion to determine if the revised product can be used on this contract. All such decisions will be made on a case-by-case basis in light of the best interest of MSDGC.

Requests to use entirely new products or processes will only be considered when there is a site-specific limitation that prohibits a specified product from being installed. If this situation arises, the MSDGC Project Engineer may approve the alternate product / process or remove the work item from the contract. All such decisions will be made on a case-by-case basis in light of the best interest of the City. (Return to Part I, Section 1.1) Section 7. Submittals

7.1 All submittals are due to the MSD Project Manager as scheduled. The contractor shall not proceed with its work until all submittals are received and approved. The MSD Project Manager reserves the right to adjust the due dates of the submittals based on contractor performance. All submittals shall be labeled indicating what is represented, file number, lining location, name of firm, and contract number.

7.2 Submittals Required of the Successful Bidder Prior to the Pre-construction Meeting.

A. Name of the competent person(s) and resume(s) as defined in Item 107.07 of the City Supplement. B. Copies of NASSCO Pipeline Assessment and Certification Program (PACP) training certificates for all

CCTV inspectors. C. Site Safety Plan. A complete site safety plan shall be submitted one week prior to the pre-construction

meeting and comply with Item 107.08 of the City Supplement. The site safety plan shall include applicable Material Safety Data Sheets (MSDS) and safety measures to be employed in areas where air pressure/steam curing will be used. Work shall not begin until an approved site safety plan is in place.

D. Materials certification from the manufacturer and contractor. The certificate of compliance shall include

the following information:

• Identify the materials (felt, coating, resin system, end seal) to be used on this contract. • Recommended physical properties for design of liner thickness (flexural modulus, flexural strength,

tensile strength, creep factor). • Statement that the final product shall meet or exceed requirements of this specification once installed

under field conditions. • Statement that the product has not been modified from the original acceptance criteria that were

used for the product acceptance by MSD.

E. Liner Installation and Curing Plan. This plan shall identify the planned installation (pulled-in-place or inversion using hydrostatic head or air pressure) and curing (circulating hot water or controlled steam) methods for the various liner sections.

7.3 Submittals Required for Pre-construction Meeting.

A. Copy of advanced notification to residents (see Part III, Section 6). B. Management Organization. The contractor shall provide an organization chart depicting the essential

organizational elements and senior personnel of its firm and its subcontractor(s) and the functions and interrelationships of the personnel proposed to provide design, engineering, technical support, project management and supervision for this project. The contractor shall provide succinct resumes of the personnel proposed to provide design, engineering, technical support and project management for this project.

C. Pricing schedule showing hourly rates for men and equipment to perform additional work at time and

materials rates that may be specified by the MSD Project Manager after the contract award. 7.4 Submittals Required Prior to Lining (items A, B, and F pertain to main line sewer rehabilitation only).

A. Grout mix, set time, and placement procedure. When grouting is required, this shall be submitted for approval at least 72 hours prior to use (see Part IV, subsection 1.5).

B. Completed cleaning logs.

C. The method of construction. This shall be provided no later than two days prior to the day of the lining to

the MSD Inspector (see Part V, subsection 1.6 for details).

D. One copy of each entry release as required in Part III, Section 6.

E. One copy of each required permit obtained by the contractor (e.g. excavations, tree removal, traffic).

F. One copy of the tube order.

G. Manufacturer’s recommended minimum/maximum pressures for inversion and curing, and resin cure

temperature/schedule. Explanation should be included for planned deviations from manufacturer’s recommendations.

7.5 Submittals Required 24 Hours Following Main Line Lining. (Note: this does not include weekends. Items to

be submitted from lining operations on a Friday are not required to be submitted until Monday.)

A. Samples, ready for testing (see Part VI). On its cook log the contractor shall inform MSD of their sample thickness measurements. The contractor shall subtract the coating liner thickness when providing this result.

B. Pre-lining and post-lining CCTV inspections and logs (see Part V, Section 3).

C. One copy of processing records for each installed liner. The records should include logs of incoming and

outgoing hot water/steam temperatures and host pipe invert-liner interface temperatures at both ends during the curing period. For steam curing, the records should also include a continuous log of pressure during the cure. Should the pressure during cure deviate from the required pressure specified by the tube manufacturer, an explanation shall be provided and MSD shall reserve the right to accept or reject the installed liner.

D. Documentation showing the resin name and liner wet out date.

7.6 Weekly Submittals.

A. Weekly schedule. These shall be emailed to the MSD Project Manager (or his representative) no later than 1:00 P.M. on the Thursday preceding the next week's lining-related activities (see Part V, subsection 1.5).

B. Corrections to punch list items as required by the MSD Project Manager to fulfill the requirements of this

specification. These shall be emailed to the MSD Project Manager (or his representative). 7.7 Final Submittals Prior to Payment.

PART II. SPECIAL PROVISIONS

Section 1. MSD Rights 1.1 MSD reserves the right to stop the work at any time and with no prior notice when in the MSD Project

Engineer's judgment the contractor's work or activities are threatening the health and safety of those directly associated with this work and the public or endangering the environment or the waters of the state. Work shall not proceed until a satisfactory resolution has been achieved, according to the MSD Project Engineer.

1.2 No contractor, or its subcontractor(s), shall perform any work without notifying MSD personnel for

inspection. An MSD inspector or designated representative shall be on-site prior to installing lining materials and backfilling excavations. Notification shall be verbally given to the MSD Inspector preferably on the previous working day or no later than 7:30 A.M. on the day the work is to be performed. Daily notification shall include the location of work, nature of work, the crew, and the time it will be on-site. MSD will confirm receipt of the notification phone call from the contractor. Failure to notify MSD shall result in the contractor being held liable for all damages to the system, restoration of any areas disturbed, and all downstream pollution resulting from the contractor's actions. In addition, MSD may require the contractor to reimburse MSD $250.00 per day for each instance it fails to provide proper notification and/or cancels work for reasons other than those beyond their control, such as main line sewer surcharged. These damages are intended to offset the cost of MSD’s unproductive inspection time. Also, failure to notify MSD could result in no payment for work performed. A list of persons available to be notified shall be given at the pre-construction meeting.

Section 2. Emergency Response Emergency situations as they pertain to lining operations include, but are not limited to, sewer backups due to missed connections causing sewer backups into homes/businesses, liner failure causing sewer overflows, styrene odors in a building, etc. The contractor may be responsible for costs incurred by MSD to investigate the emergency. These costs include, but are not limited to rodding, cleanup costs, and restoration. If MSD fails to notify the contractor of the emergency, the contractor shall NOT be responsible for any costs associated with investigating or remedying the emergency. If a contractor mobilizes to a location and it is determined that the MSD crew was mistaken and the contractor is not responsible for the emergency, MSD will reimburse the contractor for all costs associated with the mobilization, on-site costs, and demobilization according to the schedule of hourly rates provided by the contractor at the pre-construction meeting. Work Week: The contractor shall provide a 24 hour-per-day, 7 day-a-week cell phone number for its emergency designee to the MSD Project Manager. This emergency designee shall be responsible for contacting MSD within one hour after the first voice mail message. MSD shall give the contractor the first opportunity to remedy the emergency situation. If the contractor's crew has not responded to the site of the emergency within two hours of the first voice mail message and/or summons on the pager, MSD reserves the right to make all necessary repairs and bill the contractor for all work performed. Costs related to the emergency response shall be incidental to the contract and not measured for payment. Weekend: The contractor shall provide a 24 hour-per-day, 7 day-a-week cell phone number for its emergency designee to the MSD Project Manager. This emergency designee shall be responsible for contacting MSD within one hour after the first voice mail message. MSD shall give the contractor the first opportunity to remedy the emergency situation. In the case of a sewage backup into a home or a sewer overflow, if MSD is able to pump the sewage back into its sewer, the contractor shall have 24 hours from the first voice mail message to respond to the site. If MSD cannot pump the sewage back into the sewer, the contractor shall respond to the site within 4 hours of the first voice mail message. (Note: The contractor may be required to reimburse MSD for all expenses associated with the pumping.) In all other emergencies, if the contractor crew has not responded to the site of the emergency within four hours of the first voice mail message and/or summons on the pager, MSD reserves the right to take the necessary

action(s) and bill the contractor for all work performed. Costs related to the emergency response shall be incidental to the contract and not measured for payment. Section 3. Working Hours 3.1 The contractor shall complete all main line sewer lining and remote tap re-opening operations within

a section such that no homeowner is without sewer service for more than 24 hours, unless otherwise directed by the MSD Project Manager. Local noise ordinances or agencies having control over roadway closures may control starting or stopping operations.

3.2 No linings shall be allowed on weekends, days before holidays, or holidays except at the discretion

of the MSD Project Manager. The contractor shall follow MSD’s holiday schedule.

3.3 The contractor shall notify MSD a minimum of seven business days in advance regarding any night work to be performed. Night work shall be reserved for special circumstances only, and permission shall be determined by the MSD Project Manager. It is the intent of this contract that lining, and lining operations, be completed during normal MSD working hours M-F 7AM-5PM.

Section 4. Pre-construction Meeting Following award of the contract and before starting any work, the contractor and its subcontractor(s), Superintendent or Field Contract Manager shall meet with the MSD Project Engineer and Project Manager. The contractor shall be notified of the date, time, and place of the meeting. Section 5. Close-out Procedures 5.1 Progress Meetings. Project close-out shall be completed in phases, depending on the size of the

project. On multiple location projects, the project closeout shall be completed each week, or as required by the MSD Project Manager. The MSD Project Manager shall hold progress meetings, as determined necessary by him. Items covered in the meeting are detailed below.

A. Punch List. The contractor shall assist the MSD Project Manager in preparation and updating of

the punch list. This list is a Microsoft Excel document and details all items requiring correction, repair, or improvements in order to be accepted and shall be emailed to the contractor on a weekly basis. Failure to show progress on the punch list may result in a reduction in the number of days per week the contractor may schedule new liner installations and delay of payment until completed to the satisfaction of the MSD Project Manager.

B. Reports and Submittals. Final reports, CCTV inspections and other submittals previously

described shall be finalized and submitted (see Part I, subsections 7.5 through 7.7).

C. Review of the status of pay estimates. 5.2 Post-Construction Meeting. A post-construction meeting may be held at the MSD Project Engineer's

discretion to review the project. Any items not previously addressed shall be reviewed at this time. 5.3 Post-Construction Services. The contractor may be required to provide post-construction services to

correct deficiencies in any items that may be identified after substantial completion of the project.

PART III. GENERAL PROVISIONS Section 1. Obtaining Permits 1.1 The contractor shall be responsible for obtaining ALL permits associated with the performance of the

work including but not limited to traffic, excavation, tree removal, etc. This includes work within the jurisdiction of the Ohio Department of Transportation. The contractor should note that it might take several months for ODOT to approve the permit upon notification of intent to excavate/occupy the Right of Way.

It should be noted that if the contractor works at a location and did not acquire the proper permits, MSD may choose to not compensate him/her for any work associated with that specific lining location.

The contractor shall conform to all City of Cincinnati Department of Transportation & Engineering Rules & Regulations. All fees or penalties incurred regarding permits, due to negligence of the contractor, shall be paid by the contractor.

(return to Part I, Section 1) Section 2. Maintenance of Traffic 2.1 This is considered incidental to the contract and not measured separately for payment. The

contractor shall be responsible for maintaining “local” traffic at all times and for notifying the proper authorities regarding the closing of the roads.

2.2 The contractor shall not begin work until standard barricades and warning signs are in an acceptable

position and the markers and signs conform to the “Ohio Manual of Uniform Traffic Control Devices for Streets and Highways” (Ohio Manual). The cost of all traffic control devices shall be included in the various sewer items.

The contractor assumes all responsibilities and liabilities regarding strict adherence to applicable sections for the maintenance of traffic and public safety as set forth in the Ohio Manual. All traffic control devices shall be in place prior to starting construction.

2.3 The contractor shall maintain local traffic at all times during this project in a manner causing the least

amount of inconvenience to the abutting property owners. Temporary driveways, temporary roadways, or run-arounds as may be necessary to provide vehicular access to and from the abutting properties shall be constructed, maintained, and subsequently removed by the contractor as directed by the MSD Project Manager.

2.4 If at any time a street must be closed or traffic has to be blocked (emergencies only), the contractor

shall notify the nearest fire and police departments. 2.5 The portion of the pavement not affected by the sewer reconstruction shall be kept clear of all

material and equipment. 2.6 All pavement excavations within the public right-of-way shall conform to the current edition of the

State of Ohio Department of Highway Construction and Material Specification, with supplements or changes thereto.

Section 3. Existing Utilities 3.1 The contractor shall take the necessary precautions for the protection of any utility encountered on

the project or the restoration of any utility damaged during the work.

3.2 The contractor shall notify, at least 48 hours before breaking ground, all public or private service corporations having wire, poles, pipes, conduit, manholes, or other structures that may be affected by this operation, including all structures, which are affected and not shown on these plans. Owners of underground utilities, which are members of the Ohio Utilities Protection Service, can be notified by calling 1-800-362-2764. Non-member underground utility owners shall be called directly.

3.3 Supporting and protecting existing water lines, gas mains, telephone conduit, etc., shall be included

in payment for the various contract items of work. 3.4 All work required for the maintenance of service of existing utilities shall be done by, and at the

expense of the contractor. 3.5 All maintenance, repair, and replacement of existing utilities shall be in accordance with the rules

and regulations of the various utility companies having jurisdiction. 3.6 All existing storm sewers, driveway drains, and other surface drain pipes, removed or damaged

during construction shall be repaired and reconnected by the contractor as directed by the MSD Project Manager at no cost to MSD. All utilities other than water and sewer lines are to be relocated as directed by the MSD Project Manager at no cost to MSD.

3.7 It is assumed there are water, gas lines, etc. serving each residence. The contractor shall repair or

replace these and any other utilities if damaged at no cost to MSD. Section 4. Construction Procedure It shall be the contractor's responsibility to work equipment around poles, trees, or other obstructions and to do so at its own expense. Section 5. Request for Supplementary Information It shall be the responsibility of the contractor to make timely requests of MSD for supplemental information, which should be furnished by MSD under the terms of this contract, and as required in the planning and execution of the work. Such requests may be submitted from time to time as the need approaches, but each shall be filed in ample time to permit appropriate action to be taken by all parties involved to avoid delay. Each request shall be in writing (hard copy or email), and list the various items and the latest day by which each shall be required by the contractor. The first list shall be submitted within two (2) weeks after contract award and shall be as complete as possible at that time. The contractor shall, if required, furnish promptly any assistance and information the MSD Project Manager may require in responding to these requests of the contractor. The contractor shall be fully responsible for all delays arising from failure to comply with this section. Section 6. Use of Private Property 6.1 The contractor shall not trespass upon or in any way disturb private property without first attempting

on three separate occasions to obtain an entry release from the property owner. A copy of the entry release shall be given to the MSD Inspector for each particular segment(s) on the day of lining.

6.2 If the contractor finds it necessary to obtain additional working areas, it shall be the contractor's

responsibility for the acquisition of further entry releases. This includes the construction of temporary access roads and their subsequent removal.

6.3 The contractor shall, at no additional expense, restore such property to the full satisfaction of the

owner. The MSD Inspector may choose to verify with the homeowner that the site was restored to his/her satisfaction.

6.4 The contractor shall not waste any excess earth, stone, or other excavated material on any property without first obtaining written permission of the owner of the property, securing any required cut and/or fill permits and securing the approval of the MSD Project Manager.

6.5 All items within the street right-of-way or sewer easement shall be removed, or removed and

replaced, or restored as directed by the MSD Project Manager. 6.6 The contractor shall ensure all employees have a badge or visible identification during any time that

they are on the project site or private property. This identification shall be worn so that it is readily recognized and readable to the public.

6.7 The contractor shall immediately investigate any and all reports of sewage backing up into fixtures or

styrene odors in the area that is being cleaned or lined. Section 7. Protection of Trees The contractor shall avoid any unnecessary damage to trees. Branches which overhang the construction limits and which interfere with the operation of equipment shall be tied back to avoid damage, if possible. Where injury to branches is unavoidable, the branches shall be sawed off neatly at the trunk or main branch, and the cut area shall be painted with approved tree paint immediately. The contractor, at no additional expense, shall remove any trees damaged beyond saving, and make restitution to the owner (public or private). The contractor should be aware that the City of Cincinnati, Division of Urban Forestry Specifications is stringent regarding the removal and replacement of trees; its rules apply only within the limits of the City of Cincinnati. The contractor is responsible for the acquisition of any permits associated with removing a tree. Section 8. Fencing Any fences, including hedge and shrubs, that need to be removed to facilitate sewer construction operations shall be replaced, in kind or with repairs satisfactory to the owner, at the contractor's expense. Replacement of fences, hedges, and shrubs shall be considered incidental to the contract and not measured separately for payment. Section 9. Non-Landscaping Restoration 9.1 All roadway berms and drainage ditches disturbed by the contractor’s work shall be restored,

reshaped, and graded to drain. 9.2 Pavement restoration shall conform to: “Hamilton County Engineer's Rules and Regulations

Governing Driveway Regulations and Pavement and Right-of-Way Opening Provisions” plates 13 through 26 inclusive as directed by the MSD Project Manager, the municipality's regulations, or the City of Cincinnati's Specifications depending upon who has jurisdiction for the street. Trench backfill and compaction shall be in conformance with the City Supplement or local street restoration jurisdiction, whichever is stricter.

9.3 The remediation of sunken trenches shall be the contractor's responsibility. Sunken areas shall be

backfilled and compacted to meet adjoining grades; the surface shall be re-seeded or resurfaced with asphalt or concrete matching the existing surfacing. The contractor's responsibility for this item shall be under the terms of, and for the duration of the guarantee defined in Item 109.11 of the City Supplement.

9.4 The contractor shall restore unpaved areas by seeding and mulching in accordance with Item 659 of

the Ohio Department of Transportation Construction and Material Specifications. No direct payment shall be made for seeding and mulching.

9.5 Driveways shall be restored with 2 inches of Asphalt Surface Course on a 6 inch Aggregate Base or with 7 inch thick Plain Portland Cement Concrete Pavement in accordance with Items 404, 304, and 452 of the Ohio Department of Transportation Construction Materials Specifications. Concrete walks shall be restored with a 5-inch thick plain Portland cement Concrete Walk in accordance with Item 608 of the Ohio Department of Transportation Construction Materials Specifications.

9.6 All disturbed areas shall be restored as nearly as possible to their pre-construction condition. 9.7 All restoration shall be completed in strict accordance with the appropriate items of the specifications

as directed by the MSD Project Manager. 9.8 The cost of all restoration of streets, drives, walks, sod, etc., shall be incidental to the contract and

not measured for payment. 9.9 The restoration of sod areas and driveways shall be kept current with the installation of the liner.

Restoration will be completed within six months of the liner installation. This shall be considered a part of the installation and failure to keep restoration of these items completed reasonably close may result in a stop work notice and delay of payment until such restoration is completed to the satisfaction of the MSD Project Manager.

Section 10. Cleanup The contractor shall keep the work area in an uncluttered condition by the frequent removal of debris. The contractor shall remove all debris and unused material and leave the area in a condition similar to the condition of the area before any work was performed. Section 11. Property Damage The contractor shall make repairs immediately if it causes any damage to private or public property. Failure to complete the restoration in a timely manner shall result in the delay of payment for work performed. Section 12. Access To Municipal Water Supplies 12.1 The contractor shall obtain all the necessary permits and pay all fees required to use the various

municipal water works supply systems. All costs for water usage shall be included in the various contract items. Water services to residents or other users of the municipal water works system shall not be shut off.

12.2 Some municipalities may restrict water usage due to outside temperature or other issues. It is the

contractor’s responsibility to obtain the necessary permits and be aware of any restrictions prior to lining. Failure to comply with the rules for usage of the water works systems may result in denial of any use of the water works system facility. It is recommended that the contractor have other methods of getting water to the jobsite. Time extensions to the contract will not be written solely because of municipal water restrictions.

Section 13. Notification of Residents/Businesses It is the responsibility of the contractor to notify all residents and businesses that could be affected by the sewer reconstruction. Notification shall be given at least 36 hours prior to the start of the lining operation. This notification shall consist of written information that outlines the process, explains all chemicals that shall be used and their effects and odors, and timing of the project. Residents and businesses that are connected to pipe sections identified on the “Blowout List” shall receive additional notification from the contractor that identifies preventative measures to be taken to

prevent property damage that may be caused by inadvertent blow-backs during the pipe cleaning operation. The segments that are susceptible to blowouts are identified in the contract location map file as yellow sewer segments with the words “Caution Blowout Potential”. (return to Part I, Section 1)

Section 14. Erosion Protection 14.1 Soil erosion and sedimentation controls shall be installed and maintained over the duration of the

project as needed. Erosion protection shall conform to: Item 670 of the Ohio Department of Transportation Construction Materials Specifications. This work shall consist of furnishing, placing, and maintaining slope erosion protection, and ditch erosion protection by seeding, matting, paper blanket, mulching, or erosion control netting. These controls shall be located within or along the edge of construction between the proposed sewer lining operations and the watercourse or its tributaries.

14.2 The contractor shall give special attention to proper sewer construction, protection of the stream and

riparian areas so that the stream can be restored to “before construction” condition. 14.3 If stated in the bid package, the MSD Project Manager shall require the contractor to submit an

Erosion Control Plan for certain off-road locations prior to starting any construction work. The Plan shall include sound creek-crossing techniques, location of access, type and location of erosion control devices. The Plan shall be included with the method of construction (see Part V, subsection 1.6). The Plan may be legibly hand-drawn on an 8 ½” x 11” paper.

PART IV. MATERIALS AND EXECUTION Section 1. General 1.1 Material and Equipment Acceptance. At the time of manufacture, each lot of pipe, liner, and fittings

shall be inspected for defects by the installer.

At the time of delivery, the liner shall be homogeneous throughout, uniform in color, and free of cracks, holes, foreign materials, blisters, kinks, or deleterious faults. Pipes with the aforementioned defects shall be rejected. The contractor shall furnish and maintain, in good condition, all equipment necessary for proper execution and inspection of the work. The contractor shall protect, store, and handle the lining material during transportation while on-site and during installation in accordance with manufacturer's recommendations to ensure that the liner material is not damaged. If any part of the lining material becomes damaged before or during installation, it shall be repaired or replaced at the contractor's expense before proceeding further.

1.2 Marking. Liner shall be marked at an interval not to exceed 5 feet with a coded number, which

identifies the manufacturer, date, nominal pipe diameter, and average liner thickness. Marking requirements shall also meet or exceed applicable ASTM standards governing the use of the product.

1.3 Changes to Liner. Any changes to the chemical composition, process or installation of liners during

the course of the contract shall be approved in accordance with the procedures established by the MSD Trenchless Technology Committee. If changes are approved by the committee, the MSD Project Engineer shall have the sole discretion to determine if the revised product can be used on this contract. The determination of the MSD Project Engineer will be made in light of the best interest of MSD and shall be final.

1.4 Installation Forces. Installation forces and pressures shall be limited so as not to stretch the material

longitudinally by more than 5% of the original length. These forces shall also be limited so as not to damage the existing pipe, laterals, or manholes. When pulling in the liner, the contractor shall provide a gauge to measure these forces on each installation.

1.5 Pipe Invert Deterioration. If the invert of the sewer pipe is missing or deteriorated due to contractor

cleaning operations, the contractor shall: 1) grout the voided area prior to insertion of the liner, 2) thicken the liner, or 3) point repair the main line (see Part I, Table A). Any depression in the pipe or trough in the invert shall not be acceptable.

End Seal. Liner terminations at manholes shall be trimmed flush with the manhole walls. If the contractor improperly cuts the liner termination point or causes a defect that may impede the flow or prevent proper maintenance of the pipe, the contractor shall remedy that situation at his/her expense. The defect shall be repaired with an epoxy-based resin that is compatible with the liner.

1.6 When lining consecutive sections, the liner may be continuous through the manholes. The liner

shall be cut and trimmed flush with the manhole walls and the bench walls, unless otherwise directed by the MSD inspector.

1.7 Service Connections. The contractor shall not damage or cause further deterioration to existing

service connections during the cleaning and lining operation.

Existing sewer service connections shall be reinstated using a closed circuit television camera and a remote controlled cutting device. All service connections shall be reinstated unless they are bulkheaded. The contractor shall make a reasonable effort to confirm the status of questionable

connections during the cleaning operation; however, it is not the intent of this specification to require excessive effort to perform this task (i.e.; additional mobilizations during odd hours for the sole purpose of dye testing). In cases where a service connection’s status is in question, the MSD inspector will make a determination on the day of lining to reinstate or not to reinstate the connection. The contractor shall be responsible for bringing questionable service connections to the MSD inspector’s attention during the pre-lining inspection. When the service connection is re-established, the invert of the service connection shall match the bottom of the reinstated service opening. The service shall be reinstated to a minimum of 95% of the original service connection unless otherwise directed by the MSD Project Manager. In the case where the host lateral material is PVC or is a break-in tap, the lateral openings shall be reinstated to a minimum of 85% of the original opening. The sewer service connection cuts shall be uniform and free of burrs and sharp edges. All sewer service connections shall be “brushed” after reinstatement. Any remedial work to repair a deficient cut shall be at the contractor’s expense. There is a potential of incorrect tap identification or deficient tap re-opening resulting in a sewer service connection back-up. During the terms of the contract, the contractor shall maintain an emergency crew capable of cutting taps and responding to customer problems after normal working hours (see Part II, Section 2). In the event that the MSD inspector directs the contractor not to reinstate a service connection that is later found to be live, the contractor will not be responsible for damages to the attached property, and the contractor will be reimbursed at the hourly rate specified in the preconstruction meeting submittal for actual work performed (see Part I, subsection 7.3D).. However, if the contractor fails to reinstate a lateral that is later found to be live, and if the same connection was not brought to the MSD inspector’s attention to determine its status, the contractor will be responsible for all damages to the affected property and the contractor will be reimbursed at the unit price for reinstating a service connection to remobilize and reinstate the connection. After laterals have been cut, the sewer main shall be flushed and all the coupons from the cut laterals shall be retrieved and properly disposed of by the contractor. Whenever possible, MSD would like to see the collection of the coupons on the post-lining CCTV inspection.

Section 2. Materials and Installation Procedures 2.1 The contractor shall provide the following materials for the performance of work under this contract:

A. Cured-in-place Pipe (CIPP)

1. Material Composition. The resin and tube shall meet or exceed all the requirements as approved by the City of Cincinnati Metropolitan Sewer District (MSD) Trenchless Technology Committee and/or the MSD Director (if approved prior to 1998).

2. Installation Procedure. The contractor shall follow applicable processing parameters in

accordance with the manufacturer’s specific specifications, instructions, and design. The general procedure to install CIPP shall be in general accordance with the appropriate current ASTM Standards and as follows:

a) The outside diameter (OD) of the tube shall be sized correctly allowing stretch to fill the

existing pipe completely. The existing pipe shall be cleaned of any obstructions or debris and televised prior to tube insertion.

b) The wet-out tube shall be inserted through an existing manhole or approved access point

by inversion using the application of a hydrostatic head or air pressure, or pulled-in-place and secondarily inflated through the inversion of a calibration hose by the use of a hydrostatic head or air pressure. The hydrostatic head or air pressure shall be sufficient to fully extend the wet-out tube to the next designated manhole or termination point. Appropriate gauges shall be used to monitor and record the installation forces and

pressures. The placement procedure shall be required to produce dimples at the service connections.

c) Curing. After placement is completed, a suitable heat or steam generating source and

distribution equipment shall be required to distribute and re-circulate hot water or steam throughout the entire pipe. Temperature and pressure shall be maintained during the curing period as recommended by the resin manufacturer. The heat or steam generating equipment shall be fitted with suitable gauges to monitor the temperature of the incoming and outgoing hot water or steam. Temperature sensors shall also be placed between the liner and host-pipe invert at both ends to monitor cure temperature.

d) After adequate cooling and careful release of the water or air pressure, both ends of the

liner shall be cut off in the manholes, and live services reinstated.

B. Standard Sewer Construction Materials.

1. All proposed manholes shall be type “S” manholes, Acc. No. 49037. 2. All manholes on public sanitary and combined sewers shall have standard lids and frames,

Acc. No. 49005. The frame shall be securely fastened to the top manhole section by four ¾” stainless steel cinch anchors. The manhole lid and casting shall be East Jordan Iron Works EonLock 1665APT and 1665ZPT or equal.

3. All sanitary and combined sewer pipe shall be PVC, SDR-35, ASTM D-3034 or approved

equal.

C. Lateral Seals. The MSD Project Engineer shall approve the materials and installation procedures prior to lining. MSD will consider the following products for use on this contract: T-Liner (Performance Liner), Saddle Liner (Easy Liner), or structural grout. Other products shall require additional review and MSD approval prior to its use. This determination shall be final and at the sole discretion of the MSD Project Engineer.

1. Material Composition. The material shall be compatible with the liner coating. 2. Installation Procedure. The contractor shall follow applicable processing parameters in

accordance with the manufacturer’s specifications, instructions, and design; otherwise, the general procedure shall be as follows:

a) When infiltration exists at the repair area, the contractor shall attempt to stop it before

installing the lateral seal.

b) Preparation of the repair area. The objective is to provide a permanent structural repair; and ensure a watertight seal between the lateral seal, the main line liner, and the lateral opening. The main line shall be cleared of any debris or protrusions. If necessary, the lateral shall be reinstated to a maximum of 100% of the original opening. The liner coating shall be lightly scarified around the lateral connection area.

c) Cylindrical sleeve or wrap around section. Shall be designed for the pipe diameter and

known conditions. This includes any pressures created by a jetting nozzle during cleaning of the main line. The wrap around section shall adhere to the main line interior.

PART V. CONSTRUCTION REQUIREMENTS Section 1. General

1.1 Access to Sewer. Access to sewer to be lined shall be through existing manholes or through access

pit excavations prepared at locations approved by the MSD Project Manager. 1.2 Bypassing Sewage Flow. Bypassing sewage flow around the section(s) of sewer to be lined shall be

performed by plugging the existing upstream manhole or adjacent sewer system and pumping the sewage to the next unaffected downstream manhole. Pump and bypass lines shall be of adequate capacity and size to handle the flow without sewer backup. Hoses and fittings shall be in good condition, without holes, so as not to cause sewage spills. Sewer service connections within the section to be lined shall be maintained by the contractor as required or temporarily taken out of service to permit lining. The contractor shall be responsible for the continuity of sewage flows and sewer service to each facility connected to the sewer section being lined during the execution of the work. If sewage overflows or backup occurs and enters buildings, the contractor shall notify the MSD Project Manager immediately. The contractor shall be responsible for cleanup, repair, and property damage costs and claims. A copy of a written release shall be furnished to the MSD Project Manager. The contractor and its subcontractor(s) shall coordinate setup to minimize duplicating bypassing efforts.

1.3 Maintaining Flow. It shall be the responsibility of the contractor, throughout the tenure of this

contract, to provide and maintain sufficient flow at all times to pass any flash of storm flow of drainage ditches and prevent any backwater flooding due to obstruction caused by construction equipment or materials. The contractor shall be responsible for prohibiting storm or subsurface water from entering the sanitary sewer during lining operations as may be caused by flash floods, high creek waters, heavy rains, etc.

1.4 Retrieval of Materials and Equipment. It shall be the contractor's responsibility to remove materials

and equipment that have been lodged in the sewer from cleaning, television inspection, excavations, or rehabilitation operations. If excavation is required, the contractor is responsible for excavation and subsequent repair to prepare the sewer for the liner. Point repairs shall not be measured for payment and are considered incidental to the contract.

1.5 Weekly Schedule. This schedule shall be emailed to the MSD Project Manager (or his

representative) by 1:00 p.m. every Thursday. MSD cannot guarantee that inspection will be available for the next weeks work if the schedule is not submitted on time. This schedule shall outline the sequence in which the contractor proposes to conduct his/her operations the following workweek and shall be approved by the MSD Project Manager before work is started. The contractor shall use a Microsoft Word table or a Microsoft Excel spreadsheet that is in a format approved by the MSD Project Manager. The schedule shall include lining, cleaning and televising, point repairs, restoration, etc. for the upcoming week. The schedule shall also indicate which segments will be lined in the evening after standard working hours. Requests by the contractor to change the schedule are subject to approval of the MSD Project Manager.

The contractor may have contingency lines on his/her schedule and line those segments if inclement weather or an act of God prevents the lining of one of the primary segments.

1.6 Method of Construction. The contractor shall describe method of placement, including a drawing for

each location to be lined. The drawing shall show access manholes; sewage bypass; traffic control; site specific hazards; and excavation locations, if required, with dimensions, interfering utilities, detailing the width and length of working area, access pit, limits of sheeting required, and the portion of existing sewer which shall be removed to conduct the work; and applicable erosion control plan(s). The drawing can be legibly hand-drawn onto the 8 ½” x 11” site map provided by MSD.

Section 2. Sewer Cleaning (Main Line Sewer Rehabilitation Only) 2.1 The contractor shall clean every segment of sewer main that is to be lined. Compliance with this

section requires substantial effort towards cleaning, chipping, cutting, grinding, etc. to remove hardened deposits, protruding laterals, roots, solids, and other matter. The contractor shall clear the sewer of protruding service connections, crushed or collapsed pipe, and other obstructions that shall prevent installation and cause damage to the liner, and shall not provide a final lined pipe product as described in Part I, subsection 4.1, of this specification until such cleaning has been completed. The contractor shall provide sewer cleaning equipment that is specifically designed and constructed for sewer cleaning.

2.2 The upstream and downstream manhole inverts of each sewer section lined must be clean prior to leaving the jobsite. It is the MSD’s intention to rid the invert of any debris (rocks, bricks, gravel, asphalt, concrete, etc.) that can impede flow or catch additional debris. The rehabilitation process shall not be considered completed until the inverts of the manholes have been cleaned to the satisfaction of the project manager or his representative. Cleaning of the inverts shall be included in the rehabilitation unit price. Disposal of the debris removed is the contractor’s responsibility. The contractor shall have a CCTV camera in the sewer during all cleaning operations that involve cutting protruding break-in services, deposit removal and/or any other types of cleaning that may cause additional damage to the sewer. The video generated shall be used as the contractor's verification that the cleaning equipment is not damaging the sewer. No submittal is required for this item and the cost for monitoring the cleaning operation shall be included in the associated unit cost for the cleaning item. This in no way waives the contractor's responsibilities for preventing further damage to the sewer. The intent is to make the contractor aware of potentially destructive cleaning operations in order to stop any such operations before additional damage is caused to the sewer. The contractor will be held fully liable for any damages that are caused by his or her negligence. Solids and debris resulting from the cleaning operation shall be collected and removed from the downstream manhole. The contractor shall be held responsible for any debris that washes into other sections of sewer. The contractor shall remove lost debris and provide documentation to the MSD Project Manager. The contractor shall assume all and complete responsibility for the legal and proper disposal of the debris. Under no circumstances shall sewage solids be dumped onto the surface, street, or into ditches, inlets, or storm drains. Any cleaning required following a point repair would be incidental to the contract and not measured for payment. The contractor is permitted to dispose of the removed debris at the MSD Wastewater Collection (WWC) Facility, 225 W. Galbraith Road.

2.2 MSD recognizes the potential for equipment being used in the sewer during normal operations to become stuck and require excavation for removal. The responsibility for the cost to excavate and retrieve lodged equipment shall be as follows: A. If equipment becomes lodged for reasons not due to negligence on the part of the contractor,

MSD will bear all costs to excavate and remove the contractor’s equipment and repair the sewer as a normal maintenance function.

If a joint decision is made by MSD and the contractor not to excavate, but to instead attempt a forceful removal of the lodged equipment from the sewer, any costs to repair or replace damaged equipment shall be paid by MSD to the contractor at a depreciated value that reflects the condition of the equipment prior to becoming lodged taking into consideration usage, age, and wear to date. The joint decision to extricate by force would be based upon economic conditions and interruption to service.

B. If equipment becomes lodged due to negligence on the part of the contractor, such as but not

limited to using the wrong size cleaning tool or attempting to clean too much debris and causing the debris to pack tightly behind and around the tool, the contractor shall bear the entire cost to

excavate, replace the sewer as required, backfill and restore the area. All permits and fees needed to excavate will be the contractor’s responsibility.

C. MSD has the right to inspect/televise the location of lodged equipment in the sewer prior to any

excavation work to determine the financial responsibility.

2.3 During the cleaning operation the contractor shall use the following criteria only after the efforts as described above in subsection 2.1 have been made or it has been determined that the level of cleaning may cause a sewer collapse do to the existing deterioration of the host pipe:

• Deposits protruding greater than 5% of the host pipe diameter shall be removed. • Protrusions (roots, break-in taps, etc.) extending greater than 5% of the host pipe diameter shall

be removed.

The contractor shall provide detailed documentation of cleaning efforts made to remove deposits and protrusions (see Part I, subsection 7.4.B). The contractor shall notify the MSD Project Manager of any protrusions remaining greater than 5%. The contractor shall not line over any of these protrusions without direction by the MSD Project Manager. The contractor shall immediately notify the MSD Project Manager if he/she believes that this level of cleaning shall cause a sewer collapse due to the existing deterioration of the host pipe. The MSD Project Manager's review and determination is final. Meeting these tolerances shall not waive the contractor from ensuring that the lining also meets the requirements of Part I, subsection 4.1.

2.4 When lining consecutive sections, the contractor shall clear the manhole channel of any debris or

protrusions as described above. Section 3. Television Inspection 3.1 The contractor shall use a color pan and tilt, rotating head camera specifically designed and

constructed for performing sewer inspection work. All submitted video shall be of high quality and in focus. Lighting for the camera shall provide a clear picture of the entire periphery of the existing sewer. The camera shall pause at service connections and pipe ends to evaluate the water tightness of the openings. Each sewer to be televised shall be suitably isolated to eliminate or control flow during video inspection to allow for the entire circumference of the pipe to be viewed. Any flow control to remove standing water and debris shall be incidental to the contract. This may require the contractor to delay any video work after major rain events until the system can return to low dry weather flow levels. The final footage for all CCTV inspection work shall be within +/- 4 (four) feet of the measured lineal footage between manholes along the existing sewer centerline between the center of each manhole. Work not following these specifications may be rejected for payment and the contractor may be required to re-do the work. The documentation of all CCTV work shall consist of PACP CCTV reports, unmodified PACP databases, logs, electronic reports, etc. noting important features encountered during the inspection. The speed of travel shall be slow enough to inspect each pipe joint, service lateral connection, structural deterioration, infiltration and inflow sources, and deposits, but should not, at any time, be faster than 30 feet per minute. The camera must be centered in the pipe to provide accurate distance measurements to provide exact locations of important features in the sewer, and these footage measurements shall be displayed and documented on the video. The completed DVD will become the property of MSD. Current PACP certification shall be required for all personnel performing CCTV inspection work .

3.2 All software used to perform and log CCTV inspection work shall be PACP certified by NASSCO.

3.3 All CCTV Work to be performed via this contract shall conform to all current PACP and LACP

standards, as appropriate, except where specifically instructed otherwise by the MSD PM. These standards include, but are not limited to: speed of camera travel, coding of defects/structural features/observations, panning of defects/structural features, camera lighting, header information, flow control, and reversal inspections. MSD CAGIS standards and designations shall apply for header information including, but not limited to, manhole numbers, pipe segment IDs, lateral names and identification, and previously undocumented manholes.

Additionally, all CCTV Work to be performed via this contract shall be carried out utilizing a color pan and tilt rotating head camera specifically designed and constructed for sewer inspection. All CCTV work shall be recorded entirely in digital MPEG-1 format with an appropriate PACP/LACP database file (NASSCO PACP/LACP V6.0 Certified Access Database), and all video must be continuously metered.

3.4 All submittals and documentation of PACP and LACP inspections, as well as any Sewer Cleaning, shall conform to the following specifications:

• Each PACP database file and its corresponding video files shall contain Work from only 1 (one) inspector and only 1 (one) Work Category (e.g., Mainline PACP, LACP, Storm PACP).

• Each PACP database shall include inspections from only one calendar month • Each PACP Video File must be in standard *.mpg format and named as described below:

o [month]_[day]_[year]-[hour]_[minute]_[AM/PM]-[Inspector Name].mpg o e.g., “1 03 2012-11 23 AM-M LONGMIRE.mpg”

• Each LACP Video File must be in standard *.mpg format and named as described below: o [month]_[day]_[year]-[hour]_[minute]_[AM/PM]-[Inspector Name]-[address]_[street].mpg o e.g., “1 02 2012-07 51 PM-E SCHNEIDER-842 SUNDERLAND DR.mpg”

• All PACP and LACP inspections must be submitted within 10 (ten) calendar days of the date of Work.

o MSDGC shall have the right to deduct 10% of the price of any such submittals for those submittals that are submitted later than ten (10) days of the date of Work.

• Each individual submittal shall contain an electronic Summary Document, a template of which shall be provided by MSDGC, sorted by Work Category (e.g., mainline PACP and lateral LACP) and then by Inspector, detailing all the performed Work included in said submittal.

• In the case of rejection of a whole or any part of a submittal, Contractor shall have an additional 10 (ten) calendar days from the date of notification of said rejection to address, correct, and/or re-perform and then re-submit said Work to MSDGC.

3.5 Pre-television Inspection Immediately Prior to Lining (in-house). After the sewer section to be lined

is cleaned, the host pipe shall be internally inspected. The MSD Inspector will view this video with the contractor. The MSD Inspector has the authority while on-site to inform the contractor of non-compliance with the specifications and not allow the contractor to line the segment. The contractor shall be given the ability to remedy the situation while on-site to the satisfaction of the MSD Inspector rather than cancel the shot. The contractor shall provide the MSD Project Manager a copy of the pre-lining CCTV inspection and associated paperwork within 24 hours after lining a pipe section.

3.6 Post-television Inspection. After the new liner pipe is in place and service connections re-opened,

the liner shall be internally inspected. The post-lining inspection shall show all reinstated service laterals and the end seals at each manhole entrance and exit. The contractor shall provide the MSD Project Manager a copy of the post-lining inspection and associated paperwork within 24 hours after lining a pipe section.

3.7 Televising After Making Repairs to Correct Liner Defects. After the main line is lined the contractor

shall follow the current requirements of the specifications (i.e., flow control, panning each tap, etc.).

During the review of the post-lining video MSD (and the contractor) will, on occasion, observe a defect(s) that must go on the punch list (i.e., wrinkles, bumps, pilot holes, etc.). After the punch list item is identified the contractor shall make the repair and re-televise the entire main line per PACP standards. When televising the repaired defect(s), the contractor shall provide MSD with a clear view of the repaired defect(s) on the CCTV inspection that enables the MSD video reviewer to easily determine if the defect has been adequately addressed.

3.8 Televising After Rehabilitating Lateral Connection(s). After the lateral connection(s) is rehabilitated

the contractor shall wait at least two weeks to perform the post-rehabilitation inspection. The contractor may perform the televising as described in the above subsection 3.7.

Section 4. Excavation Point Repairs (Main Line Sewer Rehabilitation Only) 4.1 MSD has identified some point repairs on this contract. The repair locations to be completed by the

bidder are specified in Master Location Data Sheet. At a minimum, any excavation that is as deep as it is far away from a building edge shall be tight-sheet shored and backfilled with CDF or flash fill. The contractor may want to consult with a geotechnical and/or structural engineer as site specific conditions warrant. All excavation trenches within the public right-of-way and all trenches in a parking lot or driveway shall be backfilled with CDF or flash fill unless otherwise directed by the MSD Project Manager. If during on-site pre-lining repair efforts the contractor believes additional repairs are necessary the on-site MSD Inspector has the authority to approve the additional repair(s). All work done on sanitary and combined sewers within the jurisdiction of MSD shall be done by a contractor who is an approved sewer tapper properly licensed and bonded by MSD.

4.2 If, due to the nature of the product, the contractor determines additional point repairs are needed to install the product to meet this specification; the contractor SHALL identify locations for repair on the attached form entitled “Additional Bidder Repairs”. After written approval from the MSD Project Manager, it is the contractor’s responsibility to perform any excavation and repairs to prepare the sewer section for liner installation. This includes repairing significant segments of missing pipe, offset joints, protruding taps, and any other sewer defect that would impede the insertion of the liner or cause any deformation of the liner section. If sewer service connections are involved, it is the contractor’s responsibility to complete the re-connection to the new sewer main. These point repairs shall not be measured for payment and are considered incidental to the contract.

4.3 At all points where the liner has been exposed as in access pits, sewer service connections, and

other locations, the contractor shall cover the pipe with a minimum of three inches of concrete or other suitable material to protect the liner during backfill and to accept load of backfill without damage or deflection. Laterals may be re-connected to the liner with a universal saddle, Inserta Tee, or other saddle as approved by the MSD Project Manager. The contractor is NOT permitted to encase the flexible coupling. Excavations to complete temporary and permanent paving repairs shall be backfilled in accordance with Part III, Section 9 of this specification.

4.4 The contractor shall assume all and complete responsibility for the legal and proper disposal of all

materials and spoils.

PART VI. QUALITY ASSURANCE Section 1. Liner Sampling and Testing 1.1 The contractor shall make pipe samples according to the specifications below. All samples shall be

inspected onsite by the MSD Inspector immediately after lining for thickness measurements and quality assurance. These samples shall be made according to ASTM Specifications and as directed by the MSD Project Manager. These samples may be sent to an independent third party laboratory approved by the MSD Project Engineer. MSD shall pay for the cost of shipping and testing. The MSD Inspector shall provide direction as to which type of sample can be collected.

1.2 Main Line Sewers Less Than or Equal to 15”. In main line sewers of diameters less than or equal to

15”, a restrained sample shall be collected at the downstream manhole. The restrained sample shall be obtained as follows:

• Place the pipe sample horizontally in the downstream manhole channel. • Pipe samples shall be initiated through a like diameter pipe. • The downstream pipe sample shall be held in place by a suitable heat sink, such as sand bags.

The samples shall be large enough to provide a minimum of three specimens and a recommended five specimens for flexural testing, or a minimum of 12”x12”. If a plate is used for sampling, spacers shall be used and properly adjusted to match the inside diameter of the host pipe being lined. If spacers are not used, or adjusted properly, to the satisfaction of the MSD Inspector, the contractor shall reimburse MSD per Part IV, Section 1.33.

1.2.1 Priority of Samples. Collection of a downstream restrained sample is the first priority (see

Section 1.2). If the contractor is unable to obtain a downstream restrained sample, the contractor shall obtain an upstream restrained sample. The upstream restrained sample shall be collected by placing one pipe sample on the downtube through like diameter pipe. If the contractor is unable to obtain either a downstream or an upstream restrained sample, then the contractor shall obtain an upstream and a downstream unrestrained sample at that location.

1.2.2 Thickness Transitions. When a thickness transition occurs in a segment, the contractor shall obtain an upstream and a downstream restrained sample.

1.2.3 Lining Through a Middle Manhole. When lining through a middle manhole, the contractor

shall obtain restrained samples at the upstream and downstream manholes and an unrestrained sample in the middle manhole. However, if the liner is of a uniform thickness throughout the sections, then only the downstream restrained sample is required.

1.2.4 Failure to Collect Samples. If the contractor is unable to obtain pipe samples in the prioritized

order due to errors including, but not limited to: a) short liner; b) no PVC pipe on-site; the contractor shall reimburse MSD $300 per shot. Unrestrained samples are not an acceptable substitute for the restrained samples.

1.3 Main Line Sewers Greater than 15”. The contractor shall not be required to collect samples except

at the direction of the Project Manager or MSD representative. If samples are required they should conform to the following guidelines: 1.3.1 Collect a plate sample and an upstream and a downstream unrestrained sample.

Plate samples shall be fabricated on-site and cured in a clamp mold placed in the downtube. The liner material shall be cut from the bag being installed on the day of lining. The MSD

Inspector shall confirm that the proper equipment (i.e., spacers) is used to construct the plate sample. Spacers shall be used, and properly adjusted to match the inside diameter of the host pipe being lined. If spacers are not used, or adjusted properly, to the satisfaction of the MSD Inspector, the contractor shall reimburse MSD per Part IV, Section 1.33.

The samples shall be large enough to provide a minimum of three specimens and a recommended five specimens for flexural testing, or a minimum of 12”x12”.

1.3.2 Lining Through a Middle Manhole. When lining through a middle manhole, the contractor

shall obtain unrestrained samples at all manholes, along with the plate sample.

1.3.3 Failure to Collect Samples. If the contractor is unable to obtain pipe samples due to errors including, but not limited to: a) short liner; b) no plate on-site with spacers; the contractor shall reimburse MSD $300 per shot.

1.4 Thickness Measurements. Verification of the installed tube thickness shall be determined by

measuring the thickness of the available samples using a calibrated measuring device. A minimum of four (4) readings shall be taken from each sample (minus the coating thickness provided by the bidder) and the mean value of all readings shall be used. The sample thickness shall be acceptable if it meets or exceeds 90% of the design minimum wall thickness specified. Penalties assessed to the contractor for failing to obtain 90% of the design thickness are described in Part I, subsection 4.5.

1.5 Physical Testing. Flexural strength and modulus of elasticity shall be determined in accordance with

test method ASTM D790.

1.6 Samples shall be measured in the field by the MSD Inspector at the time of lining. If a sample is required but not provided, the contractor shall incur a deduct as specified in Part VI, Section 1.3.3.

(return to Part I, Section 4) Section 2. Contractor Rating System 2.1 A performance evaluation rating system is applicable to the services to be provided under this contract.

PART VII. PAYMENT FOR WORK

Section 1. Measurement and Payment 1.1 Payment for cleaning, televising and rehabilitating sewer sections shall be per the contract linear

footage given in the Master Location Data Sheet at the unit price submitted for each pipe diameter. The MSD construction inspector shall verify footages by measuring from the center of the upstream manhole to the center of the downstream manhole on each pipe section, rounded to the nearest foot. Note that all submitted CCTV sewer inspections shall conform to the NASSCO PACP standard that measures pipe sections from lip to lip versus center to center (see Part V, Section 3).

Verification of footages are typically determined by performing an aboveground walk wheel measurement prior to liner installation and compared to information in the bid documents and prior CCTV footages obtained by MSD and the contractor for accuracy. When it is impossible or impracticable to obtain an aboveground walk wheel measurement, the inspector shall use his/her best judgment to determine the proper footages for verification of the contract footages found in the Master Location Data Sheet. CCTV footages provided by the contractor and/or its subcontractor(s) shall under no circumstances be used as the sole reference for determining billing quantities. Other methods for determining billable quantities may be considered by the MSD Project Engineer at the preconstruction meeting at the contractor’s request. Any such methods shall be under the direct control of MSD and shall be consistently employed through the duration of the contract.

1.2 Payment for liner pipe includes required excavation and backfill for access, providing and processing

liner, excavations for each point repair as needed to line the sewer section and grout, placement of both temporary paving patches and final permanent paving and all incidentals.

1.3 Reinstating active sewer service connections by remote cutting shall be measured for payment by

each sewer service connection actually cut in the pipe liner. Payment shall be made for the quantities measured at the unit price submitted on the unit price page.

1.4 Payment for reinstating sewer service connections includes required excavation and backfill,

providing saddles, couplers, remote cutting equipment and all incidentals to connect and reinstate sewer service connections to the new liner pipe if required.

1.5 Contract Repairs are listed as a separate bid item. The lump sum bid price for each point repair

shall include any replacement of lateral connections; locating and marking of the area; backfilling; cleaning; and restoration. All backfill, pavement restoration, and other restoration incidental to the work shall be performed in strict accordance with the requirements of the local authority in charge of the backfill and restoration. It is the responsibility of the contractor to determine and understand these local requirements prior to submitting its bid, and to include the cost of the backfill and restoration items in its bid. If more main line sewer pipe or lateral pipe must be replaced than was listed in the contract, but the replacement will occur in the same excavation trench, then no change order will be considered by MSD.

1.6 Payment for rehabilitating lateral connections shall be made based on the unit price as submitted on

the unit price page. 1.10 The following items of work shall not be measured for payment and the cost thereof shall be

considered as incidental to the contract:

A. Records and logs. B. Collection and transportation of debris. C. The contractor’s CCTV inspection equipment and associated materials and supplies. D. Bypass pumping and flow control as required. E. Providing temporary and final paving at any excavations. F. Providing temporary and final restoration of grass areas. G. Emergency after-hours response for sewer service connection back-ups.

H. Remedial trimming of deficient sewer service connection cut. I. Re-televising and re-cleaning following a point repair. J. Removal of any obstructions that may interfere with excavation of point repairs. K. Demobilization and mobilization because of suspension of work. (Note: It is not MSD’s policy to

suspend work without a justifiable reason. If the contractor’s permits, notifications, releases, etc. are in place then, generally speaking, he/she will be permitted to line).

L. Grouting of existing sewer (host) sewer main that is missing. M. All costs associated with purchasing and training of contractor personnel at the beginning of the

contract in electronically submitting the required reports. This item includes lost production time of personnel receiving training.

N. Data entry, computerized equipment, software, supplies and hardware to submit the required electronic submittals.

O. Traffic Control including arrow boards, signage, flag persons, etc. P. Right of Entry access to private property. Q. Dye testing of service connections in order to verify active taps. R. Erosion protection. S. Clearing and grubbing. T. Any damages incurred during the liner installation that are caused by the contractor’s

negligence. U. Repairs to correct defects in the finished liner. V. All permits other than street opening/excavation.

1.11 Payment for liner installations will be based on the total combined cost per lining location. MSD

assumes that the work will be completed in a short enough time to require one payment. Should this not be the case, the District will pay the contractor per this schedule: a) 60% of the total liner installation cost once the liner has been installed and active service laterals have been reinstated; b) 30% of the total job cost when all non-restoration punch list items have been addressed; c) 10% of the total job cost when all restoration has been completed. Except at the discretion of the MSD project manager, all non-restoration punchlist items must be completed within (30) thirty days. The MSD project manager reserves the right to prohibit lining on certain days to allow the contractor to address items on the punchlist.

1.12 Payment for excavation repairs will be based on the lump cost per repair location. MSD assumes

that the repair and all related restoration will be completed in a short enough time to require one payment. Should this not be the case, the District will pay the contractor per this schedule: a) 70% of the total job cost once the repair has been completed and related restoration is substantially completed; b) 30% of the repair cost when all related restoration is fully completed.

1.13 The contractor shall submit one invoice for work performed a maximum of once every 30 days, and a

minimum of once every 60 days. If no work has been performed for 30 days, MSD may request a detailed updated schedule.

Section 2. Performance and Payment Bond The cost to the contractor for performance and payment bond shall be listed as a separate bid item. The contractor shall include the cost of its performance bond in the proposal. The costs entered in the proposal should not exceed one percent (1%) of the official total bid price. This item shall be included for payment on the first partial estimate. In the event the costs entered in the proposal exceeds one percent (1%), all costs over the one percent (1%) shall be paid with the final payment.
