GENERAL RENTAL TERMS

1. AllgemeinesDiese Bedingungen gelten auch für alle künftigen Geschäfte zwischen den Vertragsparteien. Es gelten ausschließlich diese Allgemeinen Mietbedingungen. Allgemeine Geschäftsbedingungen des Bestellers gelten nur insoweit, als der Lieferer ihnen ausdrücklich schriftlich zugestimmt hat.

2. MietzeitDie Mietzeit wird nach vollen Kalendertagen berechnet. Die Mietzeit beginnt mit dem Versand der Geräte an den Verwendung-sort; sie endet mit dem Wiedereintreffen der Geräte bei dem Vermieter. Eine Mindestmietzeit besteht nicht.

3. Versand und GefahrübergangDer Versand der Geräte erfolgt auf Kosten des Mieters auf den üblichen Versandwegen, es sei denn, der Mieter hat ausdrück-lich eine bestimmte Versandart vorgeschrieben. Die Kosten einer Transportversicherung gehen zu Lasten des Mieters. Der Gefahrenübergang tritt ein bei Abholung bei dem Vermieter und erlischt bei Rückgabe an den Vermieter.

4. Gebrauch der MietsacheDie vermieteten Geräte sind Eigentum des Vermieters. Der Mieter hat sie in sorgfältiger Art und Weise zu gebrauchen, alle Obliegenheiten, die mit dem Besitz, dem Gebrauch und dem Erhalt der Mietsache verbunden sind, zu beachten und die Wartungs-, Pfl ege- und Gebrauchsempfehlungen des Vermieters zu befolgen. Die durch einen unsachgemäßen Gebrauch notwendig werdenden Reparaturen werden dem Mieter gesondert in Rechnung gestellt. Grundlage für die Berechnung ist der Zustands- und Reparaturbericht des Vermieters, der dem Mieter zugeleitet wird.

5. Haftung und GewährleistungDer Vermieter haftet für den funktionstüchtigen Zustand der vermieteten Geräte zum Zeitpunkt des Gefahrenüberganges unter Ausschluss weiterer Ansprüche wie folgt: Hat das vermietete Gerät im Zeitpunkt des Gefahrenüberganges einen Fehler, der seine Tauglichkeit zum vertragsmäßigen Gebrauch aufhebt oder in einem Umfange mindert, der einer Aufhebung gleichkommt, kann der Vermieter nach seiner Wahl den Fehler beheben, das fehlerhafte Gerät austauschen oder vom Vertrag zurücktreten. Für die Dauer der Aufhebung der Tauglichkeit mindert sich der Mietpreis in entsprechendem Umfang. Für Schäden, die dem Mieter beim Gebrauch der Mietsache entstehen, haftet der Vermieter nur, wenn diese auf einem bei Gefahrenübergang vorhan-denen Fehler beruhen. Die Haftung erstreckt sich auf die Kosten der Instandsetzung bis zur Höhe des Mietpreisanspruches des Vermieters, mit welchem ein etwaiger danach gegebener Schadenersatzanspruch zu verrechnen ist. Weitere, darüber hinausgehende Ansprüche des Mieters, insbesondere auf Schadenersatz, sind ausgeschlossen. Fälle der Verletzung von Leben, Körper und Gesundheit sind aus der Haftungsbegrenzungsklausel ausgenommen.

6. Haftung des MietersDer Mieter ist dem Vermieter für alle Schäden verantwortlich, die aus dem nicht bedingungsgemäßen Gebrauch der Mietsache entstehen. Darüber hinaus trägt der Mieter auch den Schaden des zufälligen Unterganges, einer zufälligen Beschädigung sowie eines Diebstahls. Der Mieter verpfl ichtet sich die Mietsachen gegen den Verlust bzw. Beschädigung zu versichern. Im Falle eines Totalschadens hat der Mieter den Wiederbeschaffungswert zu ersetzen.

7. Rechte DritterDer Mieter hat die Geräte von allen Belastungen, Inanspruchnahme und Pfandrechten Dritter freizuhalten. Er ist verpfl ichtet, den Vermieter unter Überlassung aller notwendigen Unterlagen unverzüglich zu benachrichtigen, wenn während der Laufzeit des Mietvertrages die vermieteten Geräte dennoch gepfändet oder in irgendeiner anderen Weise von Dritten in Anspruch genom-men werden. Der Mieter trägt alle Kosten, die zur Aufhebung derartiger Eingriffe Dritter erforderlich sind.

8. ZahlungDer Mietpreis ist sofort nach Rechnungserhalt fällig und ohne jeden Abzug zahlbar.

9. Rückgabe der MietsacheDer Mieter hat auf seine Kosten und Gefahr das gemietete Gerät nach Ablauf der Mietzeit unverzüglich an den Vermieter zurückzugeben.

10. KautionDer Vermieter behält sich das Recht vor, eine Kaution zu erheben. Die Kaution ist vor Überlassung der Mietsachen zur Zahlung fällig und wird nach Rückgabe des Mietgegenstandes zurückerstattet bzw. mit den noch unbezahlten Mietrechnung verrechnet.

11. SchlussbestimmungenMündliche Nebenverabredungen sind nicht getroffen. Änderungen dieses Vertrages bedürfen der Schriftform. Sollte eine Bestimmung dieses Vertrages nicht rechtswirksam sein, so bleibt die Wirksamkeit der übrigen Bestimmungen hiervon unberührt. Im Übrigen gelten ergänzend die Allgemeinen Geschäftsbedingungen des Vermieters.
