PROGRAM OVERVIEW

Introduction The 1985 Oregon Legislature created the Community Right to Know Program to provide information on haz-ardous substances within our state. Part of this program is the Hazardous Materials Incident Reporting Sys-tem (OAR 837-085-0380). Under this system, emergency service personnel responding to an incident of threatened or actual injury to a human, wildlife, domestic animal, or in which damage to the environment, or any property loss occurs resulting from a hazardous substance or waste incident are required to submit a writ-ten report of the incident to the Office of State Fire Marshal. This report must be submitted within10 work-ing days after the incident occurs. The following incidents are exempted from the reporting requirements: 1. Motor fuels which are spilled in quantities of less than 42 gallons from a vehicle, unless it enters a water-

way or is determined to endanger the public safety or immediate or surrounding environment, including groundwater; or

2. Sewage overflow; or 3. Structure fires or other emergencies where hazardous substances are involved as exposures, if the quanti-

ties exposed are less than 42 gallons. This means that a Hazardous Material Incident Report would not be required for a structure fire or other emergency if consumer quantities of hazardous substances did not di-rectly relate to the cause of the emergency or to injuries or death. If these consumer quantities caused the incident or contributed to an injury or death, a written Hazardous Material Incident Report would be re-quired.

The following incidents are subject to the reporting requirements: 4. Except for 1, 2, and 3 above, all incidents including the release or threatened release of a hazardous mate-

rial shall be reported. This includes, for example, a warranted response, based on the good intent of the caller, to a situation where no hazardous material is released or found.

This also applies to a situation whereby the emergency responders take possession of hazardous materials to abate a hazard to the public; i.e., drug lab chemicals. For both of these examples, proper documentation for state and local purposes is essential.

Data Collection is Important This report summarizes the 2001 Hazardous Material Incident Reports gathered from emergency responders. The reports submitted were not always fully completed; therefore, the statistics and numbers reported throughout this report may not always equate to the same total. The OSFM encourages those who complete the Hazardous Material Emergency Incident Report forms to complete the form in its entirety. Why is it necessary to submit a State Fire Marshal Hazardous Material Incident Report? First, the report is required by Oregon Revised Statutes and by Administrative Rule. Also, the submission of the report allows OSFM to enter the information into a database, from which reports such as this one can be created and used by any agency for analysis, budgeting, and forecasting purposes. In order to maintain an accurate and veri-fiable profile of hazardous material incidents in Oregon, it is essential that emergency response agencies sub-mit a written report after an incident.

Access to the Information Data obtained from the Hazardous Material Incident Reports is available via the internet at www.sfm.state.or.us. Specialized reports can also be created upon written request. You may obtain a Request for Hazardous Sub-stance Information form from our website at www.sfm.state.or.us. The form is referred to on the OSFM website as the Customized Report Request form. You may also call or e-mail our office to request that the Request for Hazardous Substance Information form be sent to you. The e-mail address to use in making this request is [email protected], or call 503-373-1540, extension 353. Once OSFM receives your completed Request for Hazardous Substance Information, you will generally receive a response within the next three business days. Larger requests may take additional time. Two additional Hazardous Material Incident summary reports are available on the OSFM website. They are: 1. Historical Listing of all Hazmat Incidents. This report lists all hazmat incidents reported to the Office of State Fire Marshal since July 1986.

The listing is sorted alphabetically by county, then alphabetically by cities in that county, and finally by street number.

2. Quarterly Incident Report. This report contains statewide hazardous material incident statistics and a summary for the last quar-

ter, the quarter prior, and year-to-date totals. A breakdown of the number of incidents that occurred during the quarter for each county is also provided in this report.

A total of 377 incidents were reported in 2001. The highest number of incidents were re-ported in October, equating to approximately 18% of the incidents. There was an increase in incidents in October after the September 11, 2001, tragedy. Many of these were anthrax scares, none of which turned out to actually be anthrax. December had the lowest number of reported incidents (approximately 5%).

In comparison, during the year 2000, the highest number of reported incidents occurred on Thursday (approximately 19%). During 2000, Saturday had the least number of occurrences (approximately 10%).

Some incidents involved more than one scene type. The number of incidents that occurred on public roads equated to approximately 28% of the reported incidents. Approximately 27% occurred at private structures. Approximately 17% of the incidents occurred on private land. For the ninth consecutive year, forests and private roads were the lowest involved scene types.

The above chart shows that residential areas were identified as the highest involved area of incidents re-ported, equating to approximately 37%. The second highest area was identified as commercial (34%). Forest remains the lowest involved area again this year (approximately 2%).

For incidents where the type of weather condition was identified, fair weather was again the most frequently reported condition, which was the weather condition during 264 of the incidents. The next highest weather condition was rain, which was the weather condition during 64 of the reported incidents.

Of the incidents reported in 2001, 76% were reported to have had a wind speed of 0-5 miles per hour at the time the incident occurred; while 18% had a wind speed of 6-10 miles per hour.

Monetary losses due to hazardous material incidents are divided into two categories: 1) Transportation, which includes vehicles and cargo, and 2) Fixed Property. The total estimated loss includes the monetary value of the hazardous substance spilled. Of the total estimated loss for 2001, approximately 77% came from fixed property, and 23% came from vehicle plus cargo.

More than one action may have been taken at the scene of an incident. The most frequent actions taken were to secure the area (16%) and identify the hazardous material (13%).

Approximately 23% of the reported incidents involved the source category of Other. Sources identified in the Other category include, but are not limited to: unknown, farm trucks, home oil storage tanks, mail, gas pumps, motor homes, propane tanks, barrels, and abandoned containers. Approximately 20% of the reported incidents involved commercial vehicles. Another 20% involved fixed facilities. Some incidents may have involved more than one source of release.

This chart groups the source of the release into three categories: Other, Transportation, and Fixed Facility. A total of 119 incidents reported transportation as the source of release. A total of 72 incidents reported fixed facility as the source of release, and a total of 185 incidents reported something else as the source of the release.

Miscellaneous Hazardous Materials were the most common hazard class for chemicals reported in 2001 incidents. The second most common hazard class was Acute Health Hazard.

Responders to hazardous material incidents provide an estimate of the total amount released for all substances involved. The substances are reported according to their physical state: solids in pounds, liquids in gallons, and gases in cubic feet. The chart above shows the quantities involved. During 2001, one incident reported that 600,000 cubic feet of natural gas leaked. That accounts for the high total amount of chemical released in cubic feet.

The course of emergency response is often determined by correct identification of the material involved in an incident. The graph above shows the sources used to identify the hazardous material. The responsible party was the highest used source in identifying the material involved (36%). Some of the sources in the Other cate-gory are: Clean up company, common knowledge, container/label, odor, visual, MSDS, FBI, Hazcat, and Drug Team.

The above chart shows the number of people who were injured, died, were decontaminated on scene, were treated on scene, or who were hospitalized in the Hazardous Material Incidents reported in 2001. There were two deaths: One was a direct result of the hazardous chemicals, and the other was a motor vehicle accident (MVA) which then caused the hazardous materials incident.

As seen from the comparison chart above, the source of release is generally higher for commercial vehicles, drug labs, and sources which fall into the Other category. The Other category includes, but is not limited to: farm trucks, home oil storage tanks, mail, gas pumps, motor homes, propane tanks, barrels, and abandoned containers.
