The United Nations Charter provides the rest of the authority to do it. An autonomous independent sovereign nation-state contemplated under

Article 1 of the 1933 Montevideo Convention on Rights and Duties of States requiring the state as a person of international law possessing the

Related to the charges made against each individual among the protectors of the peace upon Mauna a Wkea; (Imperative) Command Now; Drop All Charges against each Accused Individual. Aloha Mr. Roth: Just as the Hawaiian nation is trapped within its own territory by an occupying power, you are trapping people within your criminal charges. You are making charges against those dedicated to protecting a site sacred for more than 1,000 years and threatened with desecration by the military/Industrial/astronomical/intelligence/combine that feeds off the occupying nation. I find your actions intolerable and order you to release my people from all charges. My people have the same right to be free as did the Netherlands, Belgium, Austria, Luxembourg, France, Denmark, Yugoslavia, Greece, Norway, Western Poland and others invaded by Germany during World War II. My people have the right to have their lands returned to them, including the lands where the Thirty Meter Telescope seeks to squat. If some man was going to break into your home to rape your grandmother and you stood in the doorway to block his entrance, would you expect the police to arrest you for obstruction? If you had any clue as to the nature of the traditional Hawaiian faith, you would know that this analogy is not far from the actual reality for that faith of what is happening on the Mountain. You dont hear the wailing of the kupuna on the Mountain or see their tears falling on the altar. You are miles away both physically and spiritually. You impose your religion to deny the traditional faith of the Hawaiian people. In charging people with obstruction, you criminalize what is essentially a citizen law enforcement action preventing desecration. That the Protectors have to take that action, because the responsible law enforcement agencies will not, means that the Protectors are all acting out of necessity and that no charges should be brought against any of them.

The collusion between your office, the Attorney General, other State agencies, and the TMT attorneys is revealed in the Hawai`i Tribune-Herald article published on Friday, July 10 http://westhawaiitoday.com/news/local-news/emails-offer-insight-state-s-response-protests-tmt and again in the Tribune-Herald article published on Sunday, July 19, 2015. http://hawaiitribune-herald.com/news/local-news/tmt-attorney-had-inside-track-legal-issues Where do you think this matter is headed? You can see State agencies enacting clearly unconstitutional rules in a concerted effort to suppress the First Amendment rights of the Protectors. Those rules will not intimidate the Protectors. With only limited notice, the Protectors rallied more than 700 people to the Mountains defense. What do you think will happen if the telescope tries to start construction again and a full-scale alert goes out worldwide? Quite possibly the number of arrests will collapse your legal system. Given that the issues involved include serious constitutional, civil rights, and human rights violations, how will you handle 500 people requesting and entitled to a jury trial? For people with a conscience, the day often comes when a decision has to be made on whether to go along, knowing that what is being done is wrong, or to step away from further participation in the hewa. I urge you to examine the history of the Kingdom, the history of the suppression of the traditional faith, the history of the Protectors and decide what your conscience says you should do. Let my people go! Ua Mau ke Ea o ka Aina i ka Pono, Edmund K. Silva, Jr. Alii Nui Mi cc: Na Kupuna Council O Hawaii Nei ame Moku Chief Justice Kingdom of Hawaii
