Respectfully Sheweth :-

It respectfully submitted that pursuant to the order dated

10.11.2011 passed by his lordship Mr. Justice Umer Atta Bandial, Hon'ble

Judge, Lahore High Court, Lahore. DIG/Operations, Lahore was directed to go

through the contents of the above quoted order and furnish report, who vide

his office letter No.2034/WP-Ops dated 12.12.2011 has sent the report of all

Divisional SsP/Operations Wing, Lahore, the perusal of which reveals that

SP/City Division has reported that no case against the 'Shesha Cafe' has been

registered in his respective division in the current year, whi le on the other

hand, SP/Civil Lines Division, reported that the proceedings u/s 5/7 and 9/10 of

Smoking Ordinance, 2002, has been initiated against 'Shesha Cafe' situated in

his jurisdiction. Similarly, SsP/Cantt:, Model Town, Sadar and Iqbal Town

Divisions vide their reports have stated that during the current year, 17 cases

have been registered in their divisions against the 'Shesha Smoker' under this

Ordinance. They also further stated that the efforts are being made to menace

and discourage this social evil, and if anybody is found involved in such like

activity, necessary legal action will be initiated against the violators.

SMOKING OF TOBACCO AND SHEESHA OPENLY AND AT EDUCATIONAL INSTITUTIONS

I am directed to refer to subject noted above and the letter of this

Depa11ment No. SO (CC) 6-1/2010 dated 81h October, 2010 and to state that

implementation of "Prohibition of Smoking and Protection of Non Smoker's

Healt!1 Ordinance, 2002" may be ensured in letter and spirit. Attention is invited

to.

Section 8 of above ordinance provides that "no person shall sell cigarettes or any other smoking substance to any· person who is less than 18 years of age" and

. Section 9 of above ordinance provides that "No person sl1alf ... .. Store, sell or distribute cigarettes or any other kind of smoking substance .... Within 50 meters of any college, school , or educational institution".

Section 5 of ordinance ibid read with SRO 51 (KE)/2009 dated July 101h, 2009 (copy enclosed) provides that "All public places as given in section 3 of Ordinance ibid including restaurants, hot~I lounges, clubs etc. have to be completely smoke free."

It is further added that "Sheesha" irrespective of its composition, is

a smoking substance and its use is governed by the above o_rdinance.

3. It is reiterated that a comprehensive inspection of all smoking

corners, shops and ''Sheesha" lounges I cafes may be carried out to ensure

compltance with the ordinance. Strict action may be taken in case of violations,

under intimation to this Department
