B. Second Reading Ordinance 853 Regarding the Placement of Real Estate Signs Alderman Lewis

With no objections, Mayor Watson may call for the second reading of the ordinance amending theprovisions governing placement of real estate signs on corner lots in the City of Maumelle. NOACTION IS REQUIRED.

C. Second Reading Ordinance 854 Regarding the Unlawful Discharge of Fireworks Alderman Lewis

With no objections, Mayor Watson may call for the second reading of the ordinance amending theMaumelle City Code regarding the penalty for the unlawful discharge of fireworks. NO ACTION ISREQUIRED.

CITY HALL

Mayor Watson called the meeting to order at 6: 00 p.m. with seven members present. Alderman Mosley wasabsent.

Alderman Anderson gave the Invocation and led the Pledge of Allegiance.

SPECIAL GUESTS AND ANNOUNCEMENTS

Rob McGill, Academics Plus Charter School Superintendent, gave a presentation on Maumelle partnering withthe Charter School to build a safe room. Mr. McGill stated there is a 75% federal grant to build the safe room

and the school is proposing that the City split the other 25% of the cost. He noted the shelter could hold about1000 people.

Mayor Watson stated that one problem is that the space could not accommodate all residents of Maumelle and

that traveling to the shelter during a tornado was a risk. He stated that the idea could be considered in the City'sbudget meetings.

MINUTES- June 2, 2014

Alderman Johnson moved to approve the minutes of the June 2, 2014 meeting. Alderman Lewis seconded themotion and it passed unanimously by all in attendance.

FINANCIAL STATEMENT REVIEW

Alderman Lewis moved to approve the financials. Alderman Anderson seconded the motion and it passed

unanimously by all in attendance.

PROCEDURAL MOTION

Alderman Lewis moved to have all ordinances and resolutions read by title only. Alderman Anderson secondedthe motion and it passed unanimously by all in attendance.

ORDINANCE 852 APPROVING THE FORMATION OF AN IMPROVEMENT DISTRICT

With no objections, Mayor Watson called for the second reading of the ordinance establishing the MaumelleProperty Owners Multi-Purpose Improvement District No 16. The City Clerk gave the reading.

Mayor Watson noted an email from a citizen asking if the district could be re-named. City Attorney Davisstated that the ordinance was based on the petition but that she would consult the attorney for the district.

DISCUSSION OF BOND PROJECTS

Diren Hamlin, of 61 Vantage Drive, stated the City needs a year- round pool because it would be beneficial toall ages and give opportunities to kids.

Ray Andrews, of 3 Monarch Drive, stated he supports the ball field project, new senior wellness center, city halland he supports the indoor aquatic center. He asked to have the indoor pool put on the ballot.

Terry Jones, of 25 Nimrod Cove, stated it would be great for Maumelle to have an indoor aquatic center butquestioned if the City' s could afford to maintain it.

Alderman Lewis stated that since all of these issues would be voted on separately, it was important for theCouncil to express their intent for the projects and sales tax before the election.

Alderman Saunders asked if we had considered remodeling the fire station 2 and courts building as a seniorwellness center location. Mayor Watson stated that he had major concerns with that.

Alderman Norris asked if there was consideration of moving city hall to the recently purchased land on ClubManor. Mayor Watson stated that he was concerned about blighting the current city hall area if it were to move.

ORDINANCE 853 REGARDING THE PLACEMENT OF REAL ESTATE SIGNS

With no objections, Mayor Watson called for the first reading of the ordinance amending the provisionsgoverning placement of real estate signs on corner lots in the City of Maumelle. The City Clerk gave thereading.

Alderman Hogue asked why this particular subject was brought up. Alderman Lewis sated it was a requestfrom Rachel Brewer but that he thought it would benefit others as well. He noted changes he made to Ms.

Brewer' s request.

ORDINANCE 854 REGARDING THE UNLAWFUL DISCHARGE OF FIREWORKS

With no objections, Mayor Watson called for the first reading of the ordinance amending the Maumelle CityCode regarding the penalty for the unlawful discharge of fireworks. The City Clerk gave the reading.

Alderman Lewis stated it would raise the fee from $ 100 to $200, but it would not be effective this 4th of July.

Alderman Anderson asked if Alderman Lewis had looked at what other cities were doing. Alderman Lewisstated that other cities do not allow the discharge of fireworks.

MAYOR' S COMMENTS

Mayor Watson stated that Fourth Fest at Lake Willastein Park this year would include a cardboard boat race

sponsored by the Chamber of Commerce. Mayor Watson also stated the parade would begin at 4: 30 and thefireworks at 9: 30pm. Mayor Watson reminded everyone that any fireworks that would be discharged wouldhave to be on private property in groups of 25 people or less and are allowed from 4: 30 - 10: 30 PM.

Mayor Watson stated Nicole Heaps resigned from the CATA Board and asked the Council how they wanted toproceed in appointing a replacement. Alderman Hogue made a motion to appoint John Todd. Alderman Lewisseconded the motion and it passed with Aldermen Norris and Saunders voting no.

ALDERMEN' S COMMENTS

Alderman Johnson stated he and Alderman Hogue looked at memorial statues and would be talking with theVeterans Committee to gage their interest.

Alderman Hogue stated she was still accepting donations for a memorial bench for Wallace Wyeth.

CITY CLERK' S COMMENTS

City Clerk Clausen stated there would be two vacancies on the tree board and one vacancy on the PublicFacilities Board the Council would be asked to fill.

ADJOURNMENT

Alderman Lewis moved to adjourn the meeting. Alderman Anderson seconded the motion and it passedunanimously by all in attendance.

Mayor Watson adjourned the meeting at 7: 30 pm.

COUNTY OF PULASKI, STATE OF ARKANSAS,

AN ORDINANCE TO BE ENTITLED:

ORDINANCE NO. 852

AN ORDINANCE TO ESTABLISH AND LAY OFF THE MAUMELLE

MUNICIPAL PROPERTY OWNERS' MULTIPURPOSE IMPROVEMENT

DISTRICT NO. 16( MOUNTAIN TERRACE ESTATES PHASE 2) AND FOR

OTHER PURPOSES

WHEREAS, a Petition to form the Maumelle Municipal Property Owners' MultipurposeImprovement District No. 16( Mountain Terrace Estates Phase 2) has been filed with the Maumelle

City Clerk; and

WHEREAS, the City Clerk has presented the petition to the Mayor; and

WHEREAS, the Mayor has set June 2, 2014 at 6 p.m. as the date and time for a hearingbefore the Maumelle City Council for consideration of the petition; and

WHEREAS, the Maumelle City Council has determined from an abstractor's certificate ofproperty ownership that those signing the petition constitute all the owners of the real property to belocated in said district; and

WHEREAS, the Arkansas Municipal Property Owners' Improvement District Law providesthat if the governing body determines that all the owners of the real property to be located in thedistrict have petitioned for the improvements, it shall then be its duty by ordinance to establish andlay off the district as defined in the petition and to appoint the commissioners named in the petition.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF

MAUMELLE, ARKANSAS:

Section 1. That the real property described in Exhibit "A" attached hereto and made a parthereof is hereby established and laid off as the Maumelle Municipal Property Owners' MultipurposeImprovement District No. 16 for the purpose ofconstructing and installing facilities for waterworks,recreation, drainage, gas pipelines, underground trenches and excavations necessary for theinstallation of electric and telephone distribution systems, sanitary sewers, streets, including curbsand gutters, sidewalks, together with facilities related to any of the foregoing within said district.

Section 2. The following three individuals are hereby appointed as commissioners of saidimprovement district: Wayne Moore, Mary Ann Moore and Jett Moore.

Section 3. The name of improvement district shall be the Maumelle Municipal PropertyOwners' Multipurpose Improvement District No. 16 ( Mountain Terrace Estates Phase 2).

Section 4. The Maumelle City Council hereby determines that there is a need for additionalinfrastructure within the City and hereby determines that the passage ofthis ordinance will facilitateconstruction ofadditional infrastructure within the City. Therefore, an emergency is hereby declaredto exist, and this ordinance being necessary for the public health, safety and welfare shall be in fullforce and effect from and after its passage and approval.

14- 94-106. Hearing on petition and determination

Effective: July 31, 2009Currentness

a)( 1)( A) Upon the filing of the petition with the clerk, it shall be the duty of the clerk to present the petition to the mayor.

B) The petition shall be accompanied by a certificate from a title insurance company transacting' business in themunicipality:

i) Stating that the signatures on the petition constitute all of the owners of real property to be located in the district; and

ii) Identifying any mortgagee holding a first mortgage lien on real property constituting more than ten percent( 10%)in area of the real property to be located in the district.

2)( A) The mayor shall thereupon set a date and time, not later than fifteen( 15) days after the date of the presentation of the

petition to the mayor, for a hearing before the governing body for consideration of the petition.

B) Notice of the hearing shall be sent by certified mail to any mortgagee holding a first mortgage lien on real propertyconstituting more than ten percent( 10%) in area of the real property to be located in the district.

C) The notice of hearing under subdivision ( a)(2)( B) of this section shall state that any existing mortgage shall besubordinated pursuant to this section and § 14- 94- 118( b) if the mortgagee fails to appear at the hearing and object toformation of the district.

b)( 1) At the hearing, it shall be the duty of the governing body to hear the petition and to ascertain whether those signing thepetition constitute all the owners of the real property to be located in the district.

2)( A) Except as provided in subdivision( b)( 2)( B) of this section, if the governing body determines that all the owners ofthe real property to be located in the district have petitioned for the improvements, it shall then be its duty by ordinanceto establish and lay off the district as defined in the petition and to appoint the commissioners as named in the petition if

commissioners are named in the petition and are property owners in or creditors of the district, or as is otherwise providedfrom among such property owners or creditors.

B) If at the hearing on the petition any mortgagee holding a first mortgage lien on real property constituting more thanten percent( 10%) in area of the real property to be located within the district objects to the formation of the district, thenthe governing body shall reject the petition for creation of the district.

3) The petition shall state the specific purposes for which the district is to be formed, and the ordinance establishing the

district shall give it a name which shall be descriptive of the purpose. It shall also receive a number to prevent its beingconfused with other districts for similar purposes.

c) The ordinance establishing the district shall be published within thirty( 30) days after its adoption by one( 1) insertion insome newspaper of general circulation in the municipality in which the district lies.

d) The findings of the governing body shall be conclusive unless attacked by a suit in the circuit court of the county in whichthe municipality is located, brought within thirty( 30) days after the publication.

1. Petitioners are the record title owners to all of the real property described in

Exhibit" A" attached hereto and made a part hereof as reflected by the deed records in the

Office of the Circuit Clerk and Ex-Officio Clerk of Pulaski County, Arkansas. All of said

property is located within the corporate limits of the City of Maumelle.

2. Petitioners desire that the real property described in Exhibit "A" attached

hereto and made a part hereof be laid off into a Municipal Property Owners' Improvement

District pursuant to Ark. Code Ann. Sections 14-94-101 et seq. for the purpose of (a)

constructing waterworks, sewers, recreational facilities and systems of gas pipelines, and

b) grading, draining, paving, curbing, and guttering street and laying sidewalks, together

with facilities related to any of the foregoing within said district.

3. Petitioners name the following three individuals to be appointed as

commissioners of the district: Wayne Moore, Mary Ann Moore, and Jett Moore.

4. Petitioners propose that the name of the district be Maumelle Municipal

Property Owners' Multipurpose Improvement District No. 1 fi .

WHEREFORE, the undersigned petition the City Council of Maumelle, Arkansas, to

AN ORDINANCE TO BE ENTITLED

ORDINANCE NO. 853

AN ORDINANCE AMENDING THE PROVISIONS GOVERNING PLACEMENT OF

REAL ESTATE SIGNS ON CORNER LOTS IN THE CITY OF MAUMELLE AND

FOR OTHER PURPOSES.

WHEREAS, the City of Maumelle allows signs identifying properties for sale within the

City under certain circumstances and with particular requirements in place, and

WHEREAS, provisions regulating said signs do not address those corner properties

which may need more than one sign and the City Council desires to add those provisions.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

MAUMELLE, ARKANSAS, THAT:

SECTION 1. Chapter 58. Sign Regulations, Article III. Residential and Miscellaneous, Section

58- 163, Real Estate Signs, of the Maumelle City Code, is hereby amended as follows:

Sec, 58- 163. Real estate signs.

On a lot, there may be placed one unanimated real estate sign, but such signs shall belimited to wall and freestanding signs whose permitted illumination and maximum displaysurface area shall be as follows:

1) Residential. For residential, eight non- illuminated square feet.

2) Nonresidential. For nonresidential, 32 non- illuminated square feet. No sign shall exceed

eight feet in length or height.

3) Exception. Two ( 2) signs may be allowed on corner lots that front on two streets. Two

2) signs must be separated by at least 100 feet. However, no sign shall be allowed in the rearof any residential property except when the rear of the property borders a golf course.3-)( 4) Temporary open house/directional signs. Open house/directional signs, of a size

not greater than six non- illuminated square feet, may be placed at a rate of one per companyper intersection, for a period from 9: 00 a.m. to 8: 00 p.m. on the day of the open house only,provided, that there shall be only one route designated by signs to a particular open house. Nomore than four directional open house signs may be placed within the city limits for any oneopen house on any one day. Failure to remove signs within the prescribed time period willcause a fine to be levied at a rate of$ 50. 00 per sign left on the site. Chronic violation of this

subsection shall result in a suspension of such privileges for a period of up to six months.Chronic violation shall be defined as four separate violations within a period of six months.

Violation of this suspension shall be a misdemeanor charged upon the principal broker of the

real estate company punishable by a fine of $250.00 for each such violation, and each day aviolation exists or continues shall be a separate offense.

43( 5.1 Sold signs/stickers. Sold signs/ stickers, of a size not greater than 25 percent of the

sign on which it is placed, may be placed at a rate of one per lot or tract, per company. All realestate signs and stickers shall be removed from the lot or tract within 30 days of the sale or

within 30 days after the sold sign/sticker has been placed.

5-}L0 Services or offerings directly related to the sale or lease of the property. Inaddition to the real estate signage allowed herein, no more than one sign may be placed upon

any property advertised for sale or lease which advertises services directly related to the sale orlease of said property.

a. Such services may include, but are not limited to, financing, insurance, or homeimprovement services.

b. All restrictions placed upon the size and placement of real estate signs expressed

herein shall likewise apply to signs placed under this provision.c. Signs may not be placed without the express permission of the property owner or

his or her agent.

SECTION 2. Codification. It is the intention of the City Council of the City of Maumelle thatthe provisions of this Ordinance shall become and be made a part of the Code of Ordinances of

the City of Maumelle, Arkansas, and that the Sections of this ordinance may be renumbered, re-lettered and the word "Ordinance" may be changed to " Section", " Article" or such other word or

phrase in order to accomplish such intention.

SECTION 3. Severability. If any clause, section or other part of this Ordinance shall be held byany court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional orinvalid part shall be considered as eliminated and in no way effecting the validity of the otherprovisions of this Ordinance.

SECTION 4. Repealer. All other provisions of Chapter 58 of the Maumelle City Code remainunamended hereby. All Ordinances or parts of Ordinances, Resolutions or parts of Resolutionsin conflict herewith, be and the same are hereby repealed to the extent of such conflict.

WHEREAS, the City Council is committed to the safety and peace of the City ofMaumelle; and

WHEREAS, the Maumelle City Code provisions allow for the discharge offireworks on certain dates and provide for certain penalties for discharge on other dates;and

WHEREAS, the City Council wishes to amend the penalty provision to increasethe possible fine for a violation of the ordinance.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE

CITY OF MAUMELLE, ARKANSAS, THAT:

SECTION 1. The Maumelle City Code, Chapter 26 FIRE PREVENTION ANDPROTECTION, Article III. Fireworks, Section 26- 72, Penalty for Violation of Article, ishereby amended to read as follows:

Sec. 26-72. Penalty for violation of article.

Any violator of this article shall be guilty of a misdemeanor and upon conviction, theviolator will be punished by a fine of not more than$100.00 200.00, plus court costs.

OTHER MATTERS PERTAINING THERETO.

WHEREAS, the City Council of the City of Maumelle, Arkansas ( the " City")has determined that the City is in need of an additional source of revenue to providefor one or more of the following: ( a) for any purposes for which the City's generalfund may legally be used, and (b) to pay and secure the repayment of bondsapproved by the voters and issued by the City from time-to-time to finance all or aportion of the costs of refunding the City's outstanding Capital Improvement Bonds,Series 2013 and Series 2014 ( the " Refunding Bonds"), and the design, construction,

improvement and equipping of a Maumelle City Hall and related city

administrative offices; a Senior Wellness Facility; athletic fields for T-ball and

softball and a new indoor swimming pool complex and facilities related thereto or insupport thereof( the " Capital Improvement Bonds"); and

WHEREAS, Title 26, Chapter 75, Subchapter 3 of the Arkansas Code of 1987Annotated ( the " Authorizing Legislation") provides for the levy of a city-wide salesand use tax or taxes at the rate of 0. 125%, 0. 25%, 0. 5%, 0. 75% or 1%, or any

combination thereof; and

WHEREAS, the City is proposing to levy a new sales and use tax at the rateof one-quarter of one percent (0. 25%), the net collections of which will be distributed

to the City and used for the purposes described above, under the AuthorizingLegislation;

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City ofMaumelle, Arkansas:

Section 1. Under the authority of the Authorizing Legislation there is herebylevied a one-quarter of one percent (0. 25%) tax on the gross receipts from the sale at

retail within the City of all items which are subject to the Arkansas Gross ReceiptsAct of 1941, as amended ( A.C.A. § 26-52- 101, et. seq.), and the imposition of an

excise ( or use) tax on the storage, use, distribution or other consumption within the

City of tangible personal property subject to the Arkansas Compensating Tax Act of1949, as amended ( A.C.A. § 26- 52- 101, et. seq.), at a rate of one-quarter of one

percent (0. 25%) of the sale price of the property or, in the case of leases or rentals, ofthe lease or rental price (collectively, the " Sales and Use Tax"). The Sales and Use

Tax will be levied and the net collections received after deduction of the

administrative charges of the State of Arkansas and required rebates (the "Net

Collections") shall be used for one or more of the following: (a) for any purposes forwhich the City's general fund may legally be used, and ( b) to pay and secure therepayment of the City's Refunding Bonds and the Capital Improvement Bonds. The

Sales and Use Tax shall be levied and collected on the gross receipts, gross proceeds

or sales price in the maximum amount allowed from time to time under Arkansas

law, subject to rebates and limitations as required for certain single transactions as

from time to time required by Arkansas statutes.

Section 2. All ordinances and parts thereof in conflict herewith are herebyrepealed to the extent of such conflict.

Section 3. This Ordinance shall not take effect until an election is held on the

question of levying the Sales and Use Tax, at which election a majority of the

electors voting on the question shall have approved the levy of the Sales and UseTax.

WHEREAS, the City Council of the City of Maumelle, Arkansas ( the " City")has passed on 2014, Ordinance No. the "Tax

Ordinance") providing for the levy of a one- quarter of one percent (0. 25%) sales and

use tax within the City (the "Sales and Use Tax"); and

WHEREAS, the purpose of this Ordinance is to place before the electors of

the City at the general election on November 4, 2014, the question of the levy of theSales and Use Tax;

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City ofMaumelle, Arkansas;

Section 1. That there shall be submitted to the electors of the City at thegeneral election to be conducted on November 4, 2014, the question of the levy of theSales and Use Tax.

The results of the election shall be proclaimed by the Mayor, andhis Proclamation shall be published one time in a newspaper published in the Cityand having a general circulation therein, which Proclamation shall advise that theresults as proclaimed shall be conclusive unless attacked in the courts within thirty30) days after the date of publication.

Section 5. A copy of this Ordinance shall be ( a) filed with the Pulaski CountyClerk at least 70 days prior to the election date, and ( b) shall also be given to the

Pulaski County Board of Election Commissioners so that the necessary electionofficials and supplies may be provided. A certified copy of this Ordinance and theTax Ordinance shall also be provided to the Commissioner of Revenues of the State

of Arkansas as soon as practicable following its adoption.

Section 6. The Mayor and City Clerk, for and on behalf of the City, arehereby authorized and directed to do any and all things necessary to submit thequestion of the levy of the Sales and Use Tax to the electors of the City at theNovember 4, 2014 general election as herein provided and, if the levy of the Salesand Use Tax is approved by the electors, to cause the Sales and Use Tax to becollected in accordance with the Authorizing Legislation, and to perform all acts ofwhatever nature necessary to carry out the authority conferred by this Ordinance.

Section 7. All ordinances and parts thereof in conflict herewith are herebyrepealed to the extent of such conflict.

Section 8. The provisions of this Ordinance are separable and if an article,

phrase or provision shall be declared invalid, such declaration shall not affect the

EFFECTIVE JANUARY 1, 2008.]

In order to provide time for the preparations for election set forth in this subchapter and

to provide for the accomplishment of the administrative duties of the Director of the

Department of Finance and Administration, the following effective dates are applicablewith reference to any such ordinance levying such tax:

1)( A) The ordinance levying the tax shall not be effective until after the election hasbeen held.

B) Following the election, the mayor of the city shall issue his or her proclamation ofthe results of the election with reference to the local sales and use tax, and the

proclamation shall be published one ( 1) time in a newspaper having general circulation inthe city.

C) Any person desiring to challenge the results of the election as published in theproclamation shall file such challenge in the circuit court of the county in which the cityis located within thirty( 30) days of the date of publication of the proclamation.

D)( i) The mayor of the city shall notify the director of the rate change afterpublication of the proclamation has occurred and ninety ( 90) days before the

effective date of the tax.

ii) If no election challenge is filed within the thirty-day challenge period, the ordinanceshall become effective on the first day of the first month of the calendar quarter after aminimum of sixty ( 60) days' notice by the director to sellers and after the expiration ofthe full thirty-day period of challenge.

E) The rate change shall become applicable on the first day of a quarter after onehundred twenty ( 120) days' notice by the director to sellers on a purchase from a printedcatalog in which the purchaser computed the tax based upon local tax rates published inthe catalog; and

2)( A) h1 the event of an election contest, the tax shall be collected as prescribed in

subdivision( 1) of this section unless enjoined by a court order.

B) A hearing of these matters of litigation shall be advanced on the docket of the courtand disposed of at the earliest feasible time.

ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY OF

MAUMELLE, ARKANSAS AT THE NOVEMBER 4, 2014 GENERAL

ELECTION THE QUESTIONS OF ISSUING BONDS UNDER

AMENDMENT NO. 62 TO THE CONSTITUTION OF THE STATE OF

ARKANSAS IN THE MAXIMUM PRINCIPAL AMOUNT OF $30, 190,000

FOR THE PURPOSE OF REFUNDING THE CITY OF MAUMELLE,

ARKANSAS CAPITAL IMPROVEMENT BONDS SERIES 2013 AND

SERIES 2014; AND FOR THE PURPOSES OF FINANCING VARIOUS

CAPITAL IMPROVEMENTS TO THE CITY FACILITIES TO BE

PAYABLE FROM AND SECURED BY A CONTINUING ANNUAL AD

VALOREM PROPERTY TAX LEVIED AT THE MAXIMUM RATE OF

6. 60 MILLS ON THE DOLLAR OF ASSESSED VALUATION OF

TAXABLE PROPERTY IN THE CITY; PRESCRIBING OTHER

EMERGENCY.

WHEREAS, the City of Maumelle, Arkansas ( the " City") is a city of the first classduly organized and existing under the laws of the State of Arkansas ( the " State"); and

WHEREAS, the City Council of the City has determined the need to issue bonds in theaggregate amount of not to exceed $ 30, 190, 000 ( the " Bonds") for the purposes of( i) refundingthe City' s outstanding Capital Improvement Bonds Series 2013 and Series 2014 issued in theoriginal aggregate principal amount of $15, 545, 000 ( the " Prior Bonds"); ( ii) financing variouscapital improvements ( together, the " Capital Improvements") including a portion of the costsof financing the design, construction, improvement and equipping of a Maumelle City Hall andrelated city administrative offices; a Senior Wellness Facility; athletic fields for T-ball and

softball and a new indoor swimming pool complex and facilities related thereto or in supportthereof( the " Capital Improvement Bonds"); and ( iii) paying the costs incidental to the issuanceof the bonds as specifically described in Section 2 of this Ordinance; and

WHEREAS, issuance of bonds for each separate purpose is subject to the approval of

the electors of the City; and

WHEREAS, the City Council has determined that in order to secure and retire theBonds it will be necessary to continue to levy the existing ad valorem tax on taxable propertywithin the City at a rate not to exceed six and six tenths ( 6. 60) mills on the dollar of the

assessed value of taxable property in the City originally approved by the electors of the City atthe special election held on November 16, 1999, and reauthorized at the special elections held

on December 7, 2004 and again on October 9, 2012.

NOW THEREFORE, BE IT ORDAINED, by the City Council of the City ofMaumelle, Arkansas:

Section 1. There shall be submitted to the electors of the City at the general electionto be held on November 4, 2014, the questions of issuing Bonds for each of the purposes andin the respective amounts specified in Section 2 of this Ordinance. The principal amounts

include all or a portion of( i) the costs of refunding the Prior Bonds, ( ii) the costs of the Capital

Improvements, and ( iii) expenses of authorizing and issuing the Bonds. The maximum rate of

the tax to be levied and pledged to secure and retire the Bonds shall be stated on the ballot.

The tax shall not be extended or collected for a longer time than is necessary to pay the Bonds.

Section 2. The ballot shall be in substantially the following form:

The bonds that are approved may be combined into a single issue of bonds ( the

Bonds"), which may be issued at one time or in series from time-to-time. If the RefundingBonds in Question # 1 are not approved, no other bonds will be issued. If any or all of theBonds are approved and issued, the City will continue to levy the continuing annual ad valoremtax, without increase, on all taxable property located within the City of Maumelle at a rate ofsix and six tenths ( 6. 60) mills on the dollar of the assessed value of the taxable property ( theTax") which will be levied in 2014 for collection in 2015 and in each year thereafter, until

the Bonds are paid, the collection of which shall be pledged to secure and retire the Bonds. If

no Bonds are approved and issued, the City will continue to levy the Tax until all outstandingCapital Improvement Bonds Series 2013 and Series 2014 are repaid in full.

Section 3. If approved, the City may elect to group one or more of the projects setforth in Section 2 of this Ordinance into a single project or projects in order to achieve cost

savings, greater operating efficiency and functional utility or for other purposes deemed by theCity Council to be in the best interest of the citizens of the City.

Section 4. The City Clerk is authorized and directed to give notice of the electionby one publication in a newspaper having general circulation within the City. Publication shall

be made not less than ten ( 10) days prior to the date of the election or as otherwise provided bythe laws of the State of Arkansas.

Section 5. The election shall be held and conducted and the vote canvassed and the

results declared under the law and in the manner now provided for municipal elections, and

only qualified electors of the City shall have the right to vote at the election.

Section 6. The Mayor shall proclaim the results of the election by issuing aproclamation and publishing the same one time in a newspaper having general circulation inthe City. The results as proclaimed shall be conclusive unless suit challenging the results isfiled in the Circuit Court of Pulaski County within thirty ( 30) days after publication of theproclamation.

Section 7. A copy of this Ordinance shall be ( a) filed with the Pulaski Circuit Clerkat least 70 days prior to the general election date, and ( b) shall also be given to the Pulaski

County Board of Election Commissioners so that the necessary election officials and suppliesmay be provided. A certified copy of this Ordinance and the Tax Ordinance shall also beprovided to the Commissioner of Revenues of the State of Arkansas as soon as practicable

following its adoption.

Section 8. Subject to the approval of the electors, the issuance of the bonds for the

purposes and the amounts specified in Section 2 of this Ordinance is hereby authorized. The

Bonds shall be issued under the authority of Amendment 62 and the Authorizing Legislation.

Section 9. The City hereby approves and ratifies the engagements of Stephens Inc.and Crews & Associates, Inc., as underwriters for the bond financing, and Wright, Lindsey &Jennings LLP, Attorneys at Law, as bond counsel.


Section 10. This Ordinance shall constitute an " official intent" under United States

Treasury Regulation Section 1. 150-2 for the reimbursement from proceeds of the Bonds forexpenditures made by the City prior to the date the Bonds are issued for Capital Improvementsand expenses of authorizing and issuing the Bonds.

Section 11. The provisions of this Ordinance are hereby declared to be separable andif any provision shall for any reason be held illegal or invalid, such holding shall not affect theremainder of this Ordinance.

Section 12. All Ordinances and parts thereof in conflict herewith are hereby repealedto the extent of such conflict.

Section 13. Emergency. It is hereby ascertained and declared that there is animmediate need to accomplish the refunding of the Prior Bonds and for the CapitalImprovements described in this Ordinance in order to promote and protect the health, safety,and welfare of the City and its inhabitants, and that the improvements can be accomplishedonly by the issuance of the Bonds. It is, therefore, declared that an emergency exists and thisOrdinance being necessary for the immediate preservation of public peace, health and safetyshall be enforced and take effect immediately from and after its passage.

WHEREAS, on June 26, 2014, at a public hearing, a majority of the members of thePlanning Commission approved a motion to recommend adoption of the updated land use map tothe Maumelle City Council; and

WHEREAS, the City Council has reviewed the recommendations of the PlanningCommission, the recommendation of staff, has obtained facts, statements and other information

concerning the request to adopt the updated land use plan; and

A RESOLUTION TO AMEND THE 2014 GENERAL FUND BUDGET.

WHEREAS, the City of Maumelle seeks land upon which to build a fire station; and,

WHEREAS, the City Council desires to purchase property on Club Manor Driveconsisting of approximately 6.04 acres from Maumelle Assisted Living Center, LLC; and

WHEREAS, the total cost to purchase the land is $ 855, 083. The General Fund will pay atotal of$669,612. The remainder of$ 185,471 will paid with bond proceeds held with the trustee.

MEMORANDUM OF AGREEMENT

This Memorandum of Agreement is entered into on this day of

by and between Pulaski County, Arkansas (County) and the City of

Maumelle (City) pursuant to the authority of ARK. CODE ANN. § 25-20- 101 et seq., and will

become binding on all parties upon ratification by the Quorum Court of Pulaski County

and the governing body of the City.

WITNESSETH:

That the County and City entered into a Memorandum of Agreement executed

February 15, 1990 and an Amendment to Memorandum of Agreement executed

September 10, 1990, concerning the costs of operating a regional jail facility by the

County. That Agreement expires this year. The County and City wish to have this

Memorandum of Agreement replace and render moot all previous Agreements.

WHEREAS, the County recognizes that it has a responsibility to maintain and

operate detention facilities ( hereinafter "jail"); and,

WHEREAS, the City acknowledge the shortage of operational revenues of Pulaski

County due to increases in the numbers of detainees in the facility and the continuously

rising costs associated with operations; and,

WHEREAS, the County and City acknowledge the need for a strong and

economically viable jail in the area; and,

WHEREAS, the County has committed its maximum tax resources available to the

construction and operation of the regional jail to serve the County and City; and,

WHEREAS, the City and the County desire to enter into a contractual agreement

whereby City funds are made available to the County to assist in the operation of a

regional jail.

IT IS THEREFORE hereby agreed that:

Section 1. Payments. To help defray operation costs of the jail, the City

agrees to pay $51, 247.00 in year one.

Section 2. Annual Increases In following years, the amount to be provided by

the City set out in Section 1 will be increased by 3% per annum.

Section 3. The payments identified above shall commence in January 2015.

Section 4. When the facility is open and accepting new inmates, the County will

notify the City who will transport any arrestee awaiting a jail bed.

Section 5. Any arrestee in need of emergency medical treatment will receive said

treatment before being brought to the facility.

Section 6. If the City fails to ratify this agreement, the County may, at its option,

enter into agreements with respect to any other municipalities within the county.

Section 7. The duration of this agreement shall be ten ( 10) years, subject to

extension by agreement of the parties.

Section 8. Notwithstanding anything contained in this Agreement to the

contrary, if the City fails to appropriate funds for subsequent periods within the term of this

Agreement, the City shall not be obligated to make payments beyond the then- current

fiscal appropriation period provided that once an appropriation is made, the

City is obligated to provide funds for that appropriation period and the County is obligated

to house the City's prisoners for that period to the extent required by Ark. Code Ann.

12-41- 503. However, once the city fails to appropriate funds, the County is no longer

required to house the City's prisoners pursuant to the Agreement. The County may,

however, at its option, choose to house that City's prisoners and charge the per diem

rates currently approved by ordinance for such housing.

7 BE IT ENACTED BY THE QUORUM COURT OF PULASKI COUNTY, STATE8 OF ARKANSAS, AN ORDINANCE TO BE ENTITLED:9

10 AN ORDINANCE ESTABLISHING A DAILY FEE TO BE CHARGED11 MUNICIPALITIES FOR KEEPING PRISONERS OF MUNICIPALITIES IN12 THE PULASKI COUNTY REGIONAL DETENTION FACILITY, AND FOR13 OTHER PURPOSES..

15 WHEREAS, in the absence of an agreement on jail costs between a county and16 all municipalities having law enforcement agencies in the county, Ark. Code Ann.17 12-41- 506 authorizes the quorum court to, by ordinance, establish a daily fee to18 be charged municipalities for keeping prisoners of municipalities in the county19 jail; and,

20

21 WHEREAS, the fee established for keeping municipal prisoners must be based22 upon the reasonable expenses which the county incurs in keeping such23 prisoners; and,

24

25 WHEREAS, municipalities whose prisoners are maintained in the county jail shall26 be responsible for paying the fee established by the quorum court; and,27

28 WHEREAS, the current interlocal agreement on jail funding expires in August29 2014; and,

30

31 WHEREAS, efforts at negotiating a new agreement on jail costs have been32 unsuccessful; and,

33

34 WHEREAS, revenues from the municipalities are vital to funding the continued35 operation of the Pulaski County Regional Detention Facility.36

37 NOW, THEREFORE, BE IT ORDAINED by the Quorum Court of Pulaski County,38 Arkansas:

40 Article 1. The daily fee to be charged municipalities for keeping prisoners of41 municipalities in the county jail shall be42

43 Article 2. " Prisoners of municipalities" are defined as those persons arrested44 and surrendered to the Pulaski County Regional Detention Facility45 by the law enforcement agency of any municipality. If the person is

1 held for trial or sentenced to the Pulaski County Regional Detention2 Facility for violating a municipal ordinance, the municipality shall be3 responsible for paying the daily fee at all times of incarceration. If

4 the person is held for trial or sentenced to the Pulaski County5 Regional Detention Facility for a misdemeanor offense, the person6 remains a municipal prisoner until the date of conviction to serve a7 term in the Pulaski County Regional Detention Facility. If the

8 person is held for trial for a felony offense, the person remains a9 municipal prisoner until the person is charged with a State offense

10 and bound over to Circuit Court for trial.11

12 Article 3. SEVERABILITY: If any part of this Ordinance is held invalid, such13 invalidity shall not affect any other portion of this Ordinance.14

1s Article 4. REPEALER. All laws and parts of laws in conflict with this16 Ordinance are hereby repealed.17

18 Article 5. EMERGENCY CLAUSE. It being necessary to protect the health,19 safety, and welfare of the citizens of Pulaski County, Arkansas, and20 emergency is hereby declared to exist. This Ordinance shall21 become effective immediately upon signature.22

The documents you sent concerning the above are currently under review by our legal staff and the Arkansas MunicipalLeague. In order to give this a comprehensive review I would kindly request the backup documentation on the perprisoner daily cost. The only thing I received is the gross calculation. I would like to see the actual jail expenditurenumber for 2013 used to come to these numbers; the number of prisoner days by jurisdiction; and what authority isbeing cited for the definition of" prisoners of municipalities" in your proposed ordinance. I noticed that the proposedordinance does not have the daily cost number identified.The amount you cite for Little Rock as current Inter- Local cost does not factor in the additional funds collected by the

city and remitted to the County on a monthly basis which are dedicated to the operation of the county jail of$ 446,819,bringing the total remitted to the county for 2013 to $2, 213, 081.96.

The Mayor and City Council are accepting resumes from residents interested in servingon the City' s Tree Board. Two citizens will be appointed to three-year terms ending June30, 2017. An applicant must be a resident of Maumelle. Desired backgrounds for

applicants include land development, forestry, landscaping or horticulture, utility

industry, and City Beautification Committee, but any with a desire to serve areencouraged to apply. The Director of Planning & Zoning and the Director of Parks andRecreation serve as permanent non-voting members of the Board. Resumes should be

Dear Sam,

A long overdue compliment on the way you operate the Maumelle Police Department and theway you protect our city and enforce the laws.

Over the last eighteen months or so, I must report sheepishly, that my wife, Sloane, and I

have had a few traffic- related encounters with Maumelle police officers. ( Odom Boulevard is so

nice that it's hard to remember the speed limit, especially at two a.m., which was the time of one

of my encounters as I returned home from a shift at the newspaper.)Without exception, your officers were polite, courteous, efficient and professional. I realize

my descriptions are slightly redundant, but I can't find enough good words to say about them.And ifyou wonder whether your tickets and warnings have a good effect, here's Exhibit A:

Since my two a. m. meeting last year, every time I turn onto Odom, north or south, I try toremember to set my cruise control at thirty-five miles- per- hour so that I don't even have tothink about it. Your officers have better things to do thatc correct an hold newspaper hack.
